At Edinburgh, the ellevent day of August 1643 yeares, we under subscryveing, by vertew of ane warrand from the commissioners of the conventioun of estaits of the dait the tent day of the said moneth of August, have peruseit the accompt of James Hammiltoun of the Boogis written on the uther syde, and have fund the samyn justlie calculated and the particular articles thairoff justlie instructed by resepts of Alexander Mure and warrandis from the lords of counsall, the said James Hamiltoun being alwayes obleist to deduce thairoff such sowmes as Williame Thomsoune or any uther commisseres of the airmie have payed for fraucht of the saids victualles to Ireland, and being lyable to report sufficient ressaits from the said Alexander Mure or utheres resaveres of the airmies victualls for the number of bolls of meill farther barganed for, being 5,000 bolls of meill conteined in the tuo last articles of the accompt, which are presently to be sent upon the publict hazard according to the tenor of the former contracts made with him. Whilk was delyverit to Alexander Mure, receater of the victuall for the Scottish airmie at Carickfergus, according to his recept daitit the 25 of August 1642, for the whilk 10,000 bolls we wer compleitlie payit by the ordinance of the counsell at London.

The estaites, haveing red and considered the act of counsell underwrittin made in favoures of the marqueis of Argyll, have allowed and allowes and approves the samyn, and ordaines it to be insert and registrat in the books of conventioun, wherof the tenour followes:
At Edinburgh, 10 August 1643
Forsameikle as the marqueis of Argyll hes be publict warrand and otherwayes advanced certane greate sowmes of money for furnisching victuall, hering and utheres necessares for the use of the Scottis airmie in Ireland, extending to the sowme of fourscoir on[e] thousand, thre hundreth seventie seven punds, ten shilling v d. Scottis, as the particular compt thairoff revised and allowed be the commisser of the airmie under his hand doeth appeare; and the lords of privie counsell finding that the said sowme hath bein undertane and advanced be the said marques for the necessarie good of the airmie, and that it is just that his lord have releiff and repayment thairoff, they doe therfoir declaire and ordaine that the said sowme, with the annualrent thairoff from the times of Lambes last, to be als tymeouslie and thankfullie payit to him, and is als just a debt upon the airmie as any uther sowmes advanced for furnisching the airmie be contract with the counsell, and that thei will have a cair to sie the same payit with the first publict course that shall be tane for releiff of the said airmie or payment of any sowmes that have bein advanced for furnisching thairoff. It is alwayes heirby declaired notwithstanding the tuelff thowsand pund Scotts lent be the said marques upon the act of counsell, commissioneres of peace and common burdings is compted as a pairt of the said sowme, yet the same (with the lord marques, his awin voluntar consent) is only to be payit when payment shalbe made to otheres who advanced upon that securitie. And the haill sowme abovewrittiin being payit, all former actis, contractis or bands for the samen or any pairt thairoff shalbe voyde of non effect.

Forsameikle as the king's matie and estaits of this realme in the late parliament, taking to thair consideratioune the rebellioun in Ireland and danger upon that occasioun threatned against the Protestant religioune, did thairupon and out of thair affectione to the kingdome of Ingland mak offer to the said kingdome of a supplie of ten thowsand men from this kingdome for suppressing of that rebellioun, to be interteined be the parliament of Ingland according to the capitulatione made theranent by the commissioneres sent from the parliament of this kingdome, with instructiones sent from the lords of privee counsell theroff; and accordinglie the said supplie being put over upon the greate charges of this kingdome, such have bein the greate necessities and wants of that airmie, als weill officeres as souldieres, not only throuch default of thair ordinarie pay, but also of victuall in the spairest measure and all other necessaries, that the lords of privee counsell, unto whom the caire of thatt airmie was intrusted by the parliament and who did accordingly undertake for the same, have bein put to greate truble and charges, both by ingadgeing them selffis, and with them also the commissioners for the peace and common burdings; as also by thair joynt invitatioune of the well affected subjects of this kingdome to contribute sowmes of money for intertainment of that airmie and payment of the arreares thairoff, which they are obleidgeit to pay with the ordinarie annualrent; and howsoever considerable sowmes have bein by thair painfull endevoures received, notwithstanding such have bein the pressing miseries of that airmie in regaird of the unhappie distractiounes†disableing the parliament thairoff, according to thair obleidgement to intertein them, as they have expressit in thare severall declaratiounes sent to the lords of his maties privee counsell; and such have bein the difficulties occurring to the saids lords of privee counsell, commissioneres of peace and common burdings tutcheing the farther interteinment of that airmie, which they fund impossible for them any longer to undergoe as they wer moved from thair affectione to his maties service and sense of the distresse of thair breithrein; for this and uther the lyk extreame exigence neirly importing the good of this kingdome to call this conventioun of estaits, by whose authority they micht more warrantably proceid in materes of so greate importance. And the saids estaits haveing accordingly taking to thair consideratioun the conditioun of the said armie, and the wholl course and procedoure concerneing the same as is befoir expressit,
Therfoire, and for diverse uther consideratiounes moveing the saids estaits, they have thoucht fit, statute and ordained, lykas by thir presents they statute and ordaine the sowme of tuelff hundreth thousand merks Scottis money, togidder with the sowme of ane hundreth thowsand merks money foirsaid as allowance for charges of ingathering of the samen to collectors, clerks and other necessarie memberes, and for allowance of exemptiounes, for mortificatiounes and the lord chancellour and fyftein ordinary lords of the sessioun, persounes exeimed as is efter specifit, to be upliftit be way of loane out of the severall shireffdomes and borrowes of this kingdome, in maner as is efter devydeit, viz: the saids borrowes on[e] sixt part of the principall sowme, extending to 200,000 merks.
And the severall shireffdomes of this kingdome to pay the remnent of the saids sowmes, conforme to a particular roll made and sett doun thairanent and subscryved in presence of the saids estaits by the lord chancellar, to remaine in record in the books of conventioun and collectione. Which wholl sowmes of money to be lent as said is, als weill to burgh as landward, shalbe delyvered to the collectoures and utheres haveing power from the saids estaits betuixt the date heiroff and the second day of February nixt to come 1644 yeares. And becaus the sowmes of money presently to be lent are not to be ingathered aff the shyres, as taxatiounes have bein, or by the devisiounes of temporalities and spiritualities, but rather is thoucht fitt that the samen may be uplifted out of the lands, teinds and utheres as they lye locallie in every shireffdome promiscuously, conforme to the said roll subscribit as said is; thairfoir it is thoucht necessarie that severall subcollectoures be appoynted throuch the wholl kingdome in ilk shyre or shyres, on[e] or more, which subcollectors or collectoures so to be appoynted shalbe chargit with the wholl sumes of moneyes to be sent by the shyre or shyres wher he or they shalbe collectoure.
And to the effect the saids subcollectoures may have letters of releiff against the severall persounes to be contained and sett doun in the rolles efter mentioned,

It is ordained that the conveiner or conveineres of the shyres befoir named shall cause intimat the said meiting at the mercate croce of the heid burgh of the shyre with all convenient diligence, and at everie parosch kirk theroff immediatly efter divyne service upon any Sunday preceiding the 22 day of September nixt, and to meit ilk shire at the places following, viz: the shireffdome of Orkney at the toune of Kirkwall; the shireffdome of Caitnes at the toun of Thursay; the shireffdome of Sutherland at the toun of Dornoch; the shireffdomes of Innernes and Cromertie at the burgh of Innernes; the shireffdome of Narne at the burgh of Narne; the shireffdome of Elgin at the burgh of Elgin; the shireffdome of Bamff at the burgh of Bamff; the shireffdome of Aberdein at the burgh of Aberdein; the shireffdome of Kincairne at the burgh of Stanehyve; the shireffdome of Forfar at the burgh of Forfar; the shireffdome of Perth at the burgh of Perth; the shireffdome of Fyfe at the burgh of Couper; the shireffdome of Clekmennan at the toun of Clekmennan; the shireffdome of Stirling at the burgh of Stirling; the shireffdome of Renfrew at the burgh of Renfrew; the shireffdome of Dumbarten at the burgh of Dumbarten; the shireffdome of Argylle at the burgh of Inverara; the shireffdome of Bute at the burgh of Rothesay; the shireffdome of Lanerk at the burgh of Lanerk; the shireffdome of Air at the burgh of Air; the shireffdome of Wigtoun and stewartrie of Kirkcubricht at the burgh of Wigtoun; the shireffdome of Dumfreis at the burgh of Dumfreis; the shireffdome of Roxburgh at the burgh of Jedburgh; the shireffdome of Selkirk at the burghe of Selkirk; the shireffdome of Peibles at the burgh of Peibles; the shireffdome of Berwick at the toun of Duns; the shireffdome of Hadingtoun at the burgh of Hadingtoun; the shireffdome of Edinburgh at the burgh of Edinburgh; [and] the shireffdome of Linlithgow at the burghe of Linlithgow; and there the saids conveineres, or any of them with such uther commissioneres as shalbe convened for the tyme, shall cause call by name and surname the heritoures, lyferenteres, titulares, taksmen of teinds, propper wodsetteres, pensioneres, ladieterceres and others within the said shireffdomes who brooke any benefeitt to landward wherby any proffet or commoditie aryseth, and by consent of them, or most pairt of them conveined for the tyme, shall mak choyse of a select number of persounes to be joyned with the foirsaids commissioneres choysen by the conventioun, to the number of eicht persounes in the foirsaids shyres where there are sextein choysen by the conventioun, and to the number of thre persounes in the rest of the shyres, being judicious, consciencious and understanding men, who shall (asweill these nominated as these to be ellected) give ther solemne oathes judicially at ther solemne† meitinges in presence of the said conveiner or conveineres, who are heirby authorized to tak ther oathes to doe uprichtly and impartially according to ther best knowledge and informatioun in the particulares following.
With power to the saids commissioneres, or most pairt of them conveined for the tyme, to mak choyse of a clerk for wreitting and formeing of the rolls efter specifit, and doeing everie uther thing incumbent to the charge efter following.
Which commissioneres so nominate and elected shall use all lawfull meanes according to the tyme, and, if neid be, shall direct out summons at thair awin instance against any persone or persounes within the said shyre to compeir befoir them and give them informatioune upon oath, or utherwayes with certificatioune of a pecuniall sowme not exceiding fourtie lib. toties quoties incaice of contempt and refuisall.
And with power to the saids commissioneres to use all legall way to informe themselffes of the just and trew worth of every persoune or persounes, thair present yeares rent of this crope and yeir 1643 to landward, as weill of lands and teinds as of any uther thing wherby yeirlie proffeit and commoditie aryseth.
And that the worth of everie persoune or persounes, ther lands, teinds and other commodities where gressumes and interestes have bein payit, be valued and set doun not only as they pay to the heritoures, lyferenteres and uthers, thair maisters, but as the same are worth and may pay presently without respect of gressumes or entresses, and to devyde the saids rolls in particular paroches by making a roll for every severall paroch within the said shyre; which roll shall contine everie particular persounes name, surname and designatioune with thair saids yeares rent and commoditie within the said paroch, whither in victuall, money or uther commodities.
And the said victuall and commodities to be converted into money by the saids commissioneres upon thair former oathes, according as in every parosch the pryces of severall spaces of victuall and commodities shall rule for the tyme; deduceing aff the saids rentis and commodities what is payit furth thairoff to ministeres, schoolmasters, superiors, taksmen, lyverenteres, colleidges and colleidges†as the saidis lyverenteres, takismen and superiouris shalbe chargeit upon the saids lyverenteres, taksmen and superiours by articles apairt, togidder with any rent, if any they have, within the said parosche.
As also becaus it is necessary to be knowen what the said deductiones of ministeres and schoolmasters stipendis and exemptiones extends to, it is appoynted and ordained that at the end of everie on[e] of the saids rolls, articles shalbe set down thairoff, viz: one for the saids deductiounes of ministeres and schoolmaisteres stipends, and another for the saids exemptiounes of everie paroch.
It is lykwyse appoynted that in the setting doun of the saids rolls, this yeares constant land rent salbe distinguisched from the uther casuall rent, wherby yeirly rent salbe distinguished from the uther casuall rent whereby yeirly proffeit and commoditie aryseth.
And for performeing and perfytting of the saids rolls, the saids commissioneres and otheres forsaids shall appoynt ther severall dyetts of meiting betuixt the first Tuesday of October nixtocum and the 15 day of November thairefter, which is appoyntit to be the last day peremptorlie for perfytting and delyvering of the said rolls.
And which rolls so perfytted and concludeit salbe subscribit by the saids persounes nominat and to be elected as said is, or most pairt thairoff conveined for the tyme, and which particular rolls of every particular persone of every paroch salbe keipit in retentis within the said shyre in some trustie persoune or persounes hands, not to be made publict nor showin except to the collectour of the said paroch, who most mak use thairoff in uplifting of the sowmes due to be payed by the said parisch unles upon occasioun of questioun betuixt pairtie and pairty, or betuixt the said collector and pairty. And efter perfytting of the which rolls, the saids commissioners shall draw up aff the saids particular rolls of parisches a generall roll containing as many severall articles as thair are severall paroches or parcells of paroches (if any be devydit within severall shyres); which articles shalbe sett doun in maner following, viz: A. B. for himselff and remanent heritoures, lyferenteres and otheres within the paroch of D. for thair propper rent of the said paroch, extending to the sowme of [...] (victuall and other commodities being converted into money), thair pairt of the said loane extends to [...], and so forth throuchout the rest of the wholl paroches.
In the which roll thair most be sett doun in cumulo the deductiounes of ministeres and schoolmaisteres stipends (iff any be) in ane article.
Item, in another article mortifyed and exeimed rents (if any be), and siclyk in setting doun of the said article for the wholl parosch it must be distinguisched what thairoff is constant land rent and quhat is casuall rent; which generall rolls, containing only ane article for everie paroch within ilk shyre, being so sett doun and subscryveit by the commissioneres or most pairt theroff conveined for the tyme, and containing the saids articles of deductiounes and exemptiounes and distinctiounes in maner foirsaid, shalbe delyvered by the saids comissioneres or thair clerk to the subcollectoures of the said shyre appoynted or to be appoynted for that effect betuixt and the said 15 of November nixt to come, and by the said subcollectour to the clerk of the said collectioune, that the same may be a grund and warrand for raiseing of letteres thairupone against the saids collectoures of severall parosches or persounes nominat in the saids generall rolls for every parisch.
And if any of the saids commissioneres heirby nominate and to be ellected for setting doun of the said roll shall refuise to accept or be negligent in doeing thair faithfull diligence therin, it is heirfoir statute and ordained that letteres shalbe direct to messingers of airmes to command and charge every on[e] of the foirsaids persounes to accept the said commissioun within 24 houres efter they be chargeit, and to doe thair exact diligence therin untill the finall close theroff; and to delyver the saids rolls subscryveit by them betuixt and the said 15 day of November nixtocum under the paine of rebellioune etc.; and if thei falye, to denunce and escheat etc.; and incaice the saids stent rolls shall not be set doun, perfytted, subscryveit and delyverit betuixt and the said 15 day of November nixtocome, in that caice letteres shalbe direct against the saids commissioneres nominat and to be elected to pay the wholl sowmes of money to be sent by the said shyre; which commissioneres are ordained heirby to be the first payeres thairoff incaice they shall refuise or falye to sett doun, perfytt and delyver the saids rolls betuixt and the said 15 day of November nixtocome under the paine of rebellioun etc.; and if they falye, to denunce and escheit etc.
And it is heirby declaired that in the caice foirsaids of thair neglect as said is and of thair first payment of the sume to be lent by the said shyre, in that caice, and efter payment thairoff made by them, they sall have letteres of releiff against the wholl heritoures, lyferenteres and otheres of the said shireffdome, conforme to the roll when it salbe made up or subscryveit by them or most pairt of them as said is
It is heirby also declaired that it salbe lawfull and leissum to every persoune or persounes (excepting the commissioneres nominat and to be elected as said is) interest in the sumes to be lent by the said shyre who cannot conveniently come to the saids meitings to send thair procurators authorized by them in writ, who shall have such lyk power in doeing everie thing as they micht doe themselffis if they wer personallie present.
It is heirby lykwayse declaired that incaice any of the heritoures, lyferenteres, titulares, taksmen of teinds, propper wodsetteres or otheres within the said shyre shall not convein at the day and dayes appoynted or to be appoynted for that effect, it shalbe leissume to the saids persounes heirby nominate, or most pairt of them conveined for the tyme, to mak and set doun the saids rolles, perfeit, subscryve and delyver the samen in maner foirsaid, and that the sowmes of money so to be lent by the saids shyres may be uplifted and inbrocht.
It is statute and ordained that letters shalbe directed for chargeing the wholl subcollectoures within ilk shyre or shyres to mak payment of the wholl sowmes of money due to be payit by the saids shyres wheroff they are or shalbe appoynted subcollectoures, conforme to the said roll subscryveit by the said lord chancellar in presence of the said conventioun at the said terme of Candlemas nixt under the paine of rebellioun etc.
And for the saids subcollectoures, ther releif aff the said shyres, it is statute and ordained that letteres salbe directed chargeing the severall collectoures of everie parochin within the said shyre or shyres, or persounes nominat in the saids particular rolls for payment to the said subcollectour or his deputies, of the sowmes contained in the saids rolls, and that within tuentie dayes nixt efter they be chargeit, if they be within this kingdome; and if they be without the same, by oppen proclamatioun at the mercate croce of Edinburgh [and] peir and shoir of Leith upon threscoir dayes wairneing under the paine of rebellioun etc.; and if they falye, to denunce and escheit and to poynd and distreinzie etc. And for releiff of the said collectour of every severall parochin or persounes nominat in the saids particular rolls, it is heirby statute and ordained that letteres shall be directed for payment making to them of the sowmes contained in the said particulare rolls against every particular persone or persounes contained in the saids rolls within eicht dayes efter they be chargeit, if they be within this kingdome, and if they be without, the same be oppen proclamatioun at the mercate croce of Edinburgh [and] peir and shoir of Leith upon 60 dayes wairneing under the paine of rebellioun etc. With power to poynd and distreinyzie thair readiest goods and geir that shall be fund upon the ground of any of thair saids lands who shall not tymeouslie pay, whither the saids goods pertein to these lyable in the said loane or not. Which goods being so poynded, it shall not be necessarie to carie them to the marcat croce of the heid burgh of the shyre, but only to use the ordinarie way of poynding and appryseing upon the ground of the saids landis, togidder with the sowme of tuentie merks for ilk hundreth merks failye.
And for inbringing of the burrowes pairt of the said loane, ordaines letteres to be direct chargeing the provest and baillies of ilk burgh to mak payment of thair part thairoff (conforme to ane roll to be subscribit by the clerk of the burrowes or conforme to the old roll) to the said collectour generall, his deputies and officeres in his name haveing his power to receave the samyn at the said terme above specifit; and if they falye, to denunce and escheit etc.
And for thair releiff, that letteres be direct chargeing the provost, baillies and counsell within each burgh to convein and elect certane persounes to stent thair nichtbours and to conveine and set the samyn, and to mak a stent roll thairupone as effeires within tuentie four houres nixt efter the charge, under the paine of rebellioune etc.; and if they failzie, to denunce and escheit etc.
And siclyk the said stent roll being made and set doun as said is, to charge the burgeses, induellares and inhabitantes within each burgh to mak payment of thair pairt of the said loane to the said provist and baillies, conforme to the said roll to be geven out therupon within thre dayes nixt efter the charge, under the paine of rebellioun etc.; and if they falye, to denunce and escheit etc.; and if neid beis, that the said provest and baillies poynd and distreinzie as they shall think expediate.
It is alwayes provydeit that no persoune quhatsoever be stented within burgh for any lands or possessiounes which he haith to landward.
It is heirby lykwayse declaired that the charges to be geven for payment of the said loane may be execute alsweill against these that are without the cuntrey as these that are within the cuntrey befoir the said time of payment, but that the executioun of denunciatione and poynding shall not be execute untill the said time of payment be bygone, and the severall dayes of the charges respective foirsaid be also bypast.
And inrespect that the foirsaids wholl sumes of money so to be lent be the saids shyres and burrowes is for releiff of the greate sowmes of money alreadie taken on as said is, and to be advanced for supplie of the said airmie in Ireland, which should be repayed by the parliament of Ingland out of the first end of the arreares due to that airmie,
Thairfoir the saids estaites have not only ratified and approven the foirsaid act of counsell, with concurse of the saids commissioneres for conserveing the peace and commissioneres of the common burdings, but also have of new statute and ordained, lykas they be thir presents statute and ordaine that alsweill these who have alreadie advanced money or victuall or who have ingadged themselffes for payment of the pryces of victuall, money and uther provisioune, by warrand of the saids lords of councell alone, or by warrant of them joyntly with the saids commissioneres of peace and common burdings, but also the wholl foirsaids sowmes (wherof the saidis former advancement are a pairt) are heirby ordained to be repayed out of the first and readiest of the saids arreares, conforme to the tenour and upon the conditiounes mentioned in the said act of counsell, with concurse foirsaid.
And incaice the samyn shall not be repayed by the parliament of Ingland betuixt and the said second day of Februare nixt to come, it is heirby statute and ordained, lykas the saids estaites by thir presents statutes and ordaines that the wholl foirsaids persounes who have by warrand foirsaid advanced money, victuall or uther provisioun to the said airmie preceiding the dait heiroff, conforme to the particular compt thairoff regisrat in the books of conventioun of the dait heiroff, shalbe repayed, ilk man of his severall sowmes, togidder with the interest theroff, conforme to the tenour of the foirsaid acts; and that out of the first and readiest of the sowmes of money to be uplifted by vertew of this present act, and that by the collectour, subcollectour and utheres haveing warrand and power to resave the samyn betuixt and the last day of Februarii nixtocome.
So that it shall not be leissum to the saids collectoures or utheres to dispose upon any of the saids moneyes so to be lent without the consent of these who have lent the said money or victuall wntill they be first satisfied.
And incaice the said parliament of Ingland shall not happin to pay and delyver the saids bygone arreares, at leist so much thairoff as shall repay the saids sowmes to be lent as said is betuixt and the first day of Junii nixt in the yeare of God 1644 yeares,
And seing it is agried and condiscended unto that the burden be equally according to every mans estait, in that caice it is declaired that when the wholl valuatiounes of the wholl kingdome shalbe knowen in maner and conforme to the rolls above specifit,
Thairfoir it is appoynted and ordained that a survey shalbe made of the wholl foirsaids rolls and compaired on[e] with another, to the effect it may be sein and knowen if any shyre or shyres have payit more out of the hundreth merkis (victuall and uther commodities being turned into money) then uther shyres have; and being so fund, that some may be appoynted befoir this present convention dissolve, or by the nixt parliament, or by committies from ather of them, to sie the just proportioun, which, according to thair foirsaids rents, would fall upon every shyre, that these who have payed more then thair just proportion may have repayment aff the shyres who have payit lesse, to be collected and inbrocht by such persounes as this present conventioun, the estaits of parliament or committies from ather shall appoynt.
And becaus the foirsaids wholl sowmes of money (alsweill to burgh as landward) extendis to a greate sume of money and wilbe [a] considerable burthein upon this kingdome, and that the same is wholly payed out of the land rentis, trade, burrow landis and other land rent and yeirly commoditie without consideratioun or laying any burding upon money, bank or annualrent, thairfoir it is statute and ordained, lykas the saids estaites statutes and ordaines that everie debtour of money upon annualrent (alsweill to burgh as landward) shall have retention of the said terme of Candlemes nixt of six of each hundreth merkes or punds quherin he is lyable of annualrent to his creditoures at the said terme, provydeing that the remanent of the said annuell rent out of the which the said debtour shall crave retentioun shalbe thankfullie payed at the leist within thre monethes efter the said terme off payment of the annualrent, otherwayes no retentioun to be allowed.
And siclyk it is heirby declaird that this present act nor no clause therin shalbe any ground of suspensioun to any debtour for retentioun of the said principall sumes addebtit by him and byrun annualrents, but that everie creditour may sute, crave and charge for the same efter the day of payment thairoff.
And it is heirby declaired that if any persoune or persounes within or without burgh shall upon thair oath declaire to thair magistrattes within burgh and commissioneres of the shyres without burgh that they pay annualrent to strangeres duelling without this kingdome of whom they cannot have retentioun foirsaid, in that caice the saids magistrattes within burgh and commissioneres without burgh shall defaulk proportionally to the saids persone or persounes such a pairt of thair loane as they shall find agreiable to equitie and reasone. And siclyk, inrespect that the foirsaides sumes of money so to be sent are in hope of payment thairoff from the parliament of Ingland,
It is heirby declaired that the wholl creditoures within this kingdome (alsweill to burgh and landward) who shall grant retentioun to thair debitoures in manor foirsaid shall have thair proportionall repayment with the rest of the cuntrey; and that either from his debitoures, if it please the creditour to trust him thairwith, or utherwayse to tak assignatioune from the debitour upon the parliament of Ingland as a pairt of the same due to the debitour for his releiff.
And because the enemies to religioun and peace of this kingdome are daylie making devisiounes and waiting all occasiounes wherby they may draw to factiones, make insurrectiounes and stirre up otheres to the dissobedience of the lawes and common resolutioune, for the goode of religioune, his maties honour and saiffitie and the weill of this kingdome,
Thairfoir, and for the reasounes contained in the act of the saids estaits made anent the levie of some horse and foote for preveening any such divisiounes, distractiones, insurrectiones, factiounes and dissobedience to the saids common resolutiounes,
The saids estaites have voluntarly grantit, statute and ordained, lykas they be thir presents voluntarly grants, statutes and ordaines ane taxt of 120,000 lib. Scottis money to be uplifted for the interteinment of the saids men, horse and foote to be levied as said is, in maner and for the use conteined in the said act. Which sowme of 120,000 lib. Scottis money foirsaid shalbe payed to the said generall collectour, his deputies and officeres and utheres haveing power and warrand from him at the said terme of Candlemes nixt, viz: on[e] sixt pairt thairoff, extending to the sowme of 20,000 pund, by the borrowes of this kingdome, and the remnent thairoff, extending to 100,000 lib., by the severall shyres of this kingdome, conforme to a particular roll thairoff subscryveit by the said lord chancellour in presence of the said conventioun of estaits.
For inbringing and ingathering quhairoff, the same maner of way salbe followed and the same kynd of letteres direct, the lyk diligence useit and receaved as for the foirsaid sowmes of money heirby lent for the supplie of the airmie in Ireland, conforme to the preceiding tenour of this present act.
And it is statute and ordained that no suspensioun salbe grantit to any persounes whatsoever without consignatioun of the sumes chargeit for in the clerk of the said conventioun, his hand, unles the reasounes therroff can be instantly verefied or made notour at the passing of the said bill, either in presentia in the tyme of session or by four or fyve of the lords of sessioun in tyme of vacance; to the which suspensiounes the saids lords of sessioun salbe only judges in such forme and maner as they are and have bein in materes of taxatioun.
It is heirby statute and ordained that the generall collectour sall tak sufficient and responsall cautioune from every subcollectour to doe his exact diligence in everything committed to his charge, alsweill in bringing in of money as all other diligence, conforme to the bands to be made by them and ther cautioners theranent.
It is lykwyse statute and ordained that the collectors of every parisch shall aither be a sufficient and responsall man himsellf, or otherwayes shall give sufficient cautioun for his intromissioun and diligence, the which diligence, to be done as weill by the saids subcollectoures as by the saids collectoures or paroches respective, is heirby understoode to be all ordinary executioun of horning registrat in due tyme and poynding, untill they be stopped by deforcement, are to be received for diligence allenerly.
Lykas it is heirby statute and ordained that the said collectour generall shall resave the saids diligence of registrat hornings in due tyme, and executiounes of deforcement from the saids subcollectoures and collectoures respective, provyding the same be delyverit to the said collectour generall befoir the 15 day of Merch nixt to come, otherwyse no diligence to be received; but they to be lyable for payment in solidum.
It is lykwayes ordained that the subcollectoures of everie parochin shall not be obleidgeit to carie the money received by them farther then thair awin paroch, and at farthest to the heid burgh of the shyre; and the subcollectour shalbe obleidgeit to receave the samyn and mak payment theroff to the generall collectour as is above specified.
And becaus these who taks paines in the saids collectiones, as weill the said subcollectoures, collectoures of paroches, clerkes in the shyres, clerk of the said collectioun and utheres to be imployed in the said service, will deserve to have certane fies and allowance granted to them,
It is thairfoir statute and ordained that ane roll be made thairoff, ather by the saids estaits or by some to be appoynted from them, which rolls, being so made and sett doun, the same sall be registrat in the books of conventioun and extracts geven farth thairoff, to the effect every man may know his awin due.
It is heirby declaired that no exemptioune salbe granted to any persoune or persounis whatsoever, except only the lands rentis, annualrents and uther dueties mortified to colledges, scholls, hospitalls and for upholding of kirks and brigges, and the lord chancellour and fyftein ordinarie lords of the sessioun allenerly.
It is alwayes declaired that this present maner of ingathering of the said loane and taxatioune shall nowayes prejudge any persoune whatsomever in succeiding taxatiounes, but that every man's richt and clame and all the prejudice that may aryse anent the samyn or maner thairoff, wherby any man may instruct enorme lesion and that he was unequally stented, is heirby specially reserveit hinc inde.
The particular roll of the severall quantities and sowmes of money to be lent by ilk shyre for the supplie of the airmie in Ireland, extending in the haill (to be lent be the saids shyres) to the sowme of ellevin hundreth thowsand merks, conforme to the act of conventioun of estaits of the dait of thir presentis; and quhilk roll be the said act is appoynted to be subscribit be the lord chancellar in presence of the said conventioun, to remaine in record in the saids books of conventioun and in the books of collectione of the said conventioun, and extractis geven furth theroff be the clerk of the said collectione for a ground and warrand of making up the rolls of ilk shyre.

Allowance grantit by the conventioun to collectoures, clerks, subcollectoures and utheres for thair service in the ingathering of the 1,200,000 merks of loane and 120,000 pund of taxatioun
The clerk of the committie of the shyre, half a merk of each hundreth merks which is chargeit upon the wholl shyre; to the subcollectour of each shyre, on[e] and ane half of each hundreth charged upon the shyre; to the subcollectors of Orkney and Caithnes and ather of them inrespect of ther distance and multitude of iles, fyve hundreth merks over and above thair on[e] and ane halff chargeit upon the shyres; and to the subcollectour of Argyll and Bute joyntly, 500 merks over and above thair on[e] and ane halff to be charged on the shyre.
To the collectour of every paroch, tuo of each hundreth chargeit upon the paroch.
To the clerks of the collectioun, the clerk of the secreit counsell for thair paines and charges, on[e] of every hundreth of the wholl, to be devydeit as the generall collectour and they shall agrie.

The quhilk day the earle of Lindsay and utheres commissioneres appoyntit to meit with the Inglisch commissioneres presentit and exhibite tuo paperes delyvered to them by the Inglisch commissioners, wheroff the tenour followes:
August 12 1643
Wee, the commissioneres appointed by both housses of the parliament of Ingland, are by our instructiones commanded to put ther brethrein of Scotland in mynd that the popisch and prelaticall factioun which began with them about thir yeares 1638 and 1639, and then intrudeit to mak way of the ruine of the kingdome of Ingland by theres, have not abated any parte of thair malice toward the nation and church of Scotland, nor are at all depairted from thair designe of corrupting and altering religion throuch the wholl illand, thouch they have inverted the maner of thair procedings, conceiving now that they have ane easyer way to destroy them if they may first prevaill over the parliament and kingdome of Ingland.
In which respect it is the desyre of both housses that the tuo nations may be strictly united and joynd togidder for thair mutuall defence against the papists and prelaticall factioun and there adherentes in both kingdomes, and not to lay doun airmes till these, thair implacable enemies, shalbe disarmed and subjected to the authoritie and justice of parliament in both kingdomes respectively; and as ane effectuall meane heirunto, they desyre ther breithrein of Scotland to raise a considerable strenth of horse and foote for their ayde and assistance to be forthwith sent against the papists, prelaticall factioune and otheres, thair adherentes now in airmes in the kingdome of Ingland.
And for the better incouragement of the kingdome of Scotland unto this necessary and so much desyred unione and conjunctioun, we are by both housses authorized to assure thair breithrein that if they shalbe annoyd or indangered by any force or airmy, ather from Ingland or any uther place, the lords and commons of Ingland will assist them with a proportionable force and strenth of horse and foote to what thair breithrein shall now afford them, to be sent into Scotland for the defence of that kingdome from the invasioun of the Irisch rebells or other enemies dureing such tyme as the Scottisch airmie salbe imployed in the defence of the kingdome of Ingland.
And to the end that nothing should be wanting in the parliament and kingdome of Ingland to facilitate this work wherin the true reformed religioun not only in these tuo kingdomes but thruchout all Europe is so heichly concerned, we are further authorized to consider with thair breithrein, the estaits and kingdome of Scotland, of what uther articles or propositiounes are fitt to be addit and concludeit wherby this assistance and unione betuixt the tuo natiounes may be made more beneficiall and effectuall for the securitie of religioun and libertie in both kingdomes.
All which being takin into the serious and Christian consideratioun of the richt honorable the lords and utheres of the conventioun of the estaits of Scotland, wee hoope thair will not neid any arguments or motives to perswade and exceite them to give thair consent and that with all convenient speid to the desyres of both housses of the parliament of Ingland, seing they have now fully declaired as by what thei have done alreadie, so by what they are yet desyreous to doe, that the true estait of this cause and quarrell is religioun, in the reformatioun wherof they are and have bein so forward and zealous as that there is not any thing expressed to them by thair breithrein of Scotland by thair former or letter declaratiounes which they have not seriously takin to heart and earnestly endevoured to effect, notwithstanding the subtill, malicious and industrious oppositiounes; that so the tuo kingdomes micht be broucht into a neir conjunctione into one forme of church governement and directory of worship or catechisme etc., and the fundatioun layed of the utter extirpatioun of poperie and prelacie out of both, the most readie and effectuall meanes wherunto is neir conceaved to be that both natiounes sould enter into a strict unione and league for thair mutuall defence, according to what is alreadie expressed in the desyres of both housses.
And to induce the persuasione of this (if there wer cause), we micht observe that in the many declaratiounes made by the generall assemblie or estaites of Scotland since the begining of these commotiounes in this illand to thair breithrein in Ingland, ther have bein sindrie expressiounes manifesting the greate necessity that both kingdomes, for the securitie of thair religioun and libertie, should joyne in this strict union against the papistes, prelattes and thair adherentes, and in the endevoures of ane uniformitie betuixt the churches of both kingdomes; the apprehensioun and foresicht of which hath causet the popisch and prelaticall factioun in forrane parts, as weill as in these his majesties dominiones, strictly and powerfully to combyne themselffes to the hindrance of this so necessarie work and the universall suppressioun of the Protestant religioune in Europe; a course not much different from that which they tooke in the yeare 1585 when the wisdome and zeale of this natioun to countermyne so wiked a conspiracie, and from the due sense of the mutuall interest of these tuo kingdomes in religioun and libertie, fund a necessitie of entering into a league of this nature, alsweill considering that thairby no lesse saiftie micht be exspected to both natiounes then danger by forbearing the samyn.
And thoch we doubt not in so necessary a good work many difficulties may aryse to disappoynt or at least retard the same till the disease become desperate, yet wee are als confident that the hearty and brotherly affectione of this natioun to the parliament and kingdome of Ingland will easily breake thruch them; and the rather because in the lyk caices of difficulty and danger, as not only at the tyme of the league above mentioned, but not long befoir and lykewyse since when any opportunity hath offered it selff, particularly during the sitting of this present parliament, the kingdome of Ingland haithe bene verie readie and willing to lay to heart the dangeres of the kingdome of Scotland as thair awine, and to deduce no meanes in the reach of thair power for redresse or preventioun of the samen.

Wee, the commissioneres appoynted by both houses of the parliament of Ingland, are by our instructiones commanded to represent to thair breithrein of Scotland the greate miseries and calamities broucht upon that church and kingdome of Ingland by the affectioun of papists and prelattes, wherby they are disabled for the present to mak payment of those greate debts owing to this kingdome for the remander of the brotherly assistance and for the arreare of the airmie in Ireland; notwithstanding of which, we are commanded to tak caire for the stateing and satling all debts, accompts and demandis betuixt the tuo natiounes of Ingland and Scotland; and when the samyn shalbe reduced to certainty, we are to treate and compound for the tyme and maner of satisfactione for the said debts. And first tutcheing the remander of the brotherly assistance, inasmuch as the warre upon the subjects and people of Scotland begun and prosecuted in the yeares 1639, 1640 and 1641 was procured by the factioun of papists, prelattes and thair adherentes, which occasioned the comeing in of thair breithrein into that kingdome, and of the ingadgement thairupon made for thair satisfactioun, we are commanded to signifye that both houses of parliament doe thairupon think it most just and reasonable that sufficient lands of papists, prelattes and such uther malignantes as have adhered unto them bee, by the directione and appoyntment of both housses, sit furth, out of which recompence shalbe made for the forbearance of that money untill such tyme as satisfactioun be geven for the discharge of all the said debt, with the interest due upon the samen. And as for the arreares due unto the Scottisch airmie in Ireland, we are to desyre that since it is impossible for the state of Ingland by reasoune of the manifold trubles and burdings which lye upon it to mak present payment, they would therfoir think of some uther way how satisfactione to thair content may be made, ather out of the confiscat lands in Ireland by way of adventure, according to the raites and proportions at which they are to be delyverit to the Inglisch adventureres, or ells by estalment at fower equall payments within two yeares efter peace shalbe setled in Ingland, or in provision of victuall and apperell to be delyvered at reasonable raites within this kingdome or elsqher, or in any uther way within the power of the tuo housses, it being thair earnest desyre to give thair breithrein full contentment therin so far as God shall inable them therunto. In persuance wheroff, we are authorized to treate and conclude for the discharge of both the aforementioned debts and such further payments as sall growe due wntill satisfactione be made in any of the wayes befoir specifit. And incaice thair breithrein shall not approve of any of these wayes, we are then to receave any such further or any other propositiounes concerning the samyne as in thair wisdomes shalbe thocht fittest. We are also to mak knowen to thair brethrein of Scotland that by reasoun of these unexpected trubles in Ingland that natioun is in lykmaner altogidder disinabled to countinue the charge of the airmie in Ireland, least thairfoir it sould become too greate a burthen to this natioun by the dissabilitie of payment from Ingland, wee are to desyre that the said airmie may be dismissed from that service in some short tyme; only such garisoune to be keipit on foote as thair breithrein shall think fitt to retaine for the guard of Carictfergus and Coleraine, according to the treatie in that behalff made.

The conventioun of estaites gives heirby commissioun to the committee formerly appoynted to meit with the Inglisch commissioners by act of the 9 of this instant to joyne with the committie appoyntit by the generall assemblie in considering of the particulares contained in the paperes exhibite by the Inglisch comissioneres, and to acquaint the assembly with such paperes as they have receavit from the saids commissioners.
