Forsameikle as the conventioun of the estaits have thought fitting that the sowme of eicht hundreth thowsand pund be advanced by this kingdome by way of loane, and that fyve pairts thairoff be payed be the shyres out of the spiritualitie and temporalitie, and the saxt pairt by the barrounes, and to the effect that the said fyve parts be layed on in ane equall proportioun, the estaits gives warrand and commissione to the m[arquis] of Argyll, the earles of Marschell, Sutherland, Cassills, Lauderdaile, Southesk (or in his absence, Loure), Balmerinoch, Burghlie, Humbie, Deinmilne, Greenock, Garthland, Broddie, Halkertoun, Lag and Dawick, the commissioners for borrowes Sir Johne Smith and James Denniestoun for Edinburgh, Thomas Durhame for Perth, Patrik Leslie for Aberdein, Johne Rutherfurde for Jedbur (or in his absence, Gideon Jack for Lanrek), Mr Robert Barklay for Irveing, Mr Alexander Douglas for Bamff, Thomas Bruce for Stirling and James Airth for Pittinweime, or any fyftein or moe of them, their being fyve of each estaite, to tak tryell and informatione by all such lawfull meanes as thei shall think convenient for the tyme, according to ther best knowledge and conscience, to appoynt and sett doun without partialitie what thei shall judge to be the just and equall proportioun of that sowme that is to be advanced by each severall shyre. And the conventioun declares that there salbe no leading caise heirefter, and is to be sett doun in the act as is expressit in the act of parliament.

Procedure: recommendation
Recomendation in favors of Thomas Cunynghame

The estaits of this kingdome recommends to the conventione of borrowis, quhilk is to be at Dumbarten, to grant warrand and commissioun to Thomas Cuninghame, merchant in Campheir, authoriseing him in the interim whill ane conservator be estableished to advert to the priviledges of the merchants of this kingdome treadeing ther or any other place in the Low Cuntreyes, and to assist them in injoyeing the same, and to ingadder such duetis as are imposed upon staple waires and commodities thair, and to be comptable thairfoir to the borrowes. As also with power to him arbitrarly to decyde in all causes of the merchants, skipperes and factoures quhilks useit to be judgeit be the conservator, and quhilk thei for themselffis and these whom they represent sall submit to him as arbitrator, without prejudice alwayes of his matie[s] richt of presentatione of a consservator.

Warrand for trying some Dunkirkers

Forsameikle as upon informatioun made to some of his maties counsell be [...] Giffin, merchant in Glasgow, upon oath that severall persounes who are now presentlie in the Dunkirk ship which is in Leith were about a yere since in a friggott quhilk broucht over [...] O'Neale to Ireland, order wes geven for sequestratione of some of the saids persounes till they should be examined. And the conventioun of estaits finding it necessarie that this bussines be exactlie tryed, they doe thairfoir approve of the saids proceidings of the counselleres foirsaids, and gives warrand and commissioun to the generall of the artaillarie and to the commissioners of the burgh of Kinghorne and Quenisferrie to call befoir them the capitane and companie of the said Dunkirk ship, and to try the treuth of this informatioune and quhat persounes are in the said ship presentlie, or if any be put away, and to put them to thair oathes thairupon and as they shall think fitting to give warrand for sequestratioune of the persounes, and to report.
