[Report of the committee regarding the confluence of people to Edinburgh]

Particulars represented by the comittie to the kingis majestie and parliament

13 October 1641

At the meitting with the lord generall, lord chancellar and utheris of that committie appointit by the parliament for setting doune sume solid cours for preveining any prejudice may arryis be the confluens of pepill to the toune and by thair frequent repair upoun the streitts and that all proceidingis maybe peaceabill and regular:

1. It is thocht necessar that all these in Edinburgh, Cannogait, Leythe and suburbes within the toune of Edinburgh's jurisdictioun wha hes ony persones ludgeit within thair housis or in chalmeris or rowmes set be thame sall give up in roll the names of all these sua ludgeit ather within thair housis or in severall chalmers and rowmes as said is, with thair designatioun to whome they belong and upoun whome they depend, to the proveist and bailleis of Edinburgh; that thairby baythe the numberis and the occasioun of thair being in toune may be knowine, and that according as they sall change thair ludgeing that the rolls be accordinglie renewit and gevin up to the magistratts in maner foresaid.

Item, that all these in the Potteraw and Wast Port whairof the Laird of Inverleythe is superiour and these of the remanent suburbis and uther pairts neir adjoyneing to the toune and not within the tounes jurisdictioune sall lykewayis give up ane list and roll of all persones ludgeit within thair housis, chalmers or rowmes to the lord generall, his excellence, to the effect foresaid. And it is represented that publict proclamatioun may be maid to the effect abonewrittin by warrand frome the parliament and that the magistratts of Edinburgh and utheris superiours foresaidis sie the samene put to executioun within thair jurisdictiounes respective; and that these wha failyeis to give up the saidis rollis eftir the proclamatione sall tyne thair fredomes and liberteis, and sall pay for ilk failyie ane hundrethe pounds to thair magistratts and be farder punishit in thair persones as the parliament sall think fitte.

2. It is thocht expedient that thair be strong guardis keipit be the toune of Edinburgh bothe for night and day of sic numberis and at sic places as the magistratts be the advyis and appointment of the lord generall sall think fitte, and that the guardis be not injured, resistit or forced be no persones of whatsoever qualitie under the pane of deathe to the resisters and forceris; and the injurers of the guards to be punished be his excellence according to the demerite of the delinquent and qualitie of the fact. And that it may be declairit that what salbe done be thir guardis in performance of thair dewteis againes ony persones the tyme of thair resisting or forceing of the saidis guardis sall infer no hazard nor perrell of law againes these of the guard, actoris thairof. As also that the placeing and ordouring of thir guardis salbe without prejudice of the constable, merschell, towne of Edinburgh or any other pairteis thair richtis and liberteis quhilkis sall remaine unimpairit heirby.

3. It is thocht fitting that these regiments quhilkis ar yt undisbandit salbe drawine neir toward Edinburghe, to the effect the samene may with the greatter conveniencie be mustered and moneyis provydit for thair pay that thaireftir they may be licentiat; and that in the meane tyme these regiments may be quartered in sic maner and in sic places neir about the toune as the lord generall sall think fit and expedient.

4. It is lykewayis represented that no man of whatsoever qualitie keip with him any mae then his awine domestik servands, and that all persones wha hes not necessarie attendance at this present parliament salbe ordanit to repair to thair severall homes and duellingis.

5. Item, that all persones of whatsumever qualitie wha ather hes alreddie brocht thair friends, followars and dependars to Edinburghe or ony pairts adjoyning thairto that they presentlie dismis thame bak to thair awine housis, and that all these wha hes gevine ordour to thair friends, followars or dependers to repair heir to Edinburgh that they imediatlie discharge thair incumeing and that proclamatioun be maid at the mercat croce of Edinburgh to this effect above writtin.

6. It is lykewayis thocht expedient that with all diligens proclamatiounes be maid at all the heid burghes of ilk schyir discharging all convocatioun of his majesteis leigis within any pairt of this kingdome under whatsumever pretext, and that thir proclamationes be maid under sic paines and penalteis as the kingis majestie and parliament sall appoynt, under the panes contained in the acts of parliament.

7. It is in lykemaner thocht expedient that notice be presentlie tane of the haill officers and sogeris and what of thame hes gottine pay and wha wants. And that these wha hes ressavit pay may be ordanit to reteir aff the toune unles the lord generall sall tolerat thair stay upon thair necessar bussines in toune represented and knowne to his excellence. And for sic as yit wants thair pay, that cours may be takine for the samene.

8. It is also thocht fitting and represented that ordour be presentlie taikine for leaveing of 40 or 50 horsmen to attend the lord generalls ordours for the good and peace of the kingdome, and thir to be levied and payed upon the publik charge.

Red, voitted and past in parliament as the same stands corrected under the clerk's hand, togidder with the animadversion maid be the noblemen. And his majestie and estaittes of parliament commandis the same to be published be open proclamatione at the mercat croce of Edinburgh, and that the same be granted, and that the same be drawin up in instructions to the generall from the king and parliament.
