[Supplication of Hector Bannatyne of Kames for nullification of a legal sentence made against him]

Supplicatioun Laird Bannatyne of Kames

Wnto the kingis maist excellent majestie and estaittis of parliament, humblie meanes and schawes Hector Bannatyne of Kaymes that quhair I, being appoyntit commissioner for the shirreffdome of Bute to attend this present parliament, trew it is and of veritie that Niniane Stewart of Eskoge intendit summondis and actioun aganes me befoir the commissars of Edinburgh for reduceing of ane decreit recoverit be me aganes him befoir the commissar of the Iyles. The quhilk actioun he hes caussit call, and I not being hable to attend the said caus or to informe the saidis commissars thairanent be ressoun of my attendance of the said parliament, he hes thairupone obtenit decreit reductive pronuncit aganes me be the saidis commissars in the said caus, quhairthrow I am gritlie prejudgit, notwithstanding that by lait act of parliament all proces and actioun befoir inferior judges aganes the memberis of parliament ar declairit null. Heirfoir I humblie beseik your majestie and estaittis of this present parliament to repone me aganes the said sentence reductive and to declair the samyne null, conforme to the said act of parliament according to justice.

Red in audience of his majestie and estaittis of parliament, who finds the desyre heirof reasonable and thairfoir finds the decreit within written null, and reponis the supplicant against the same. And ordanis ane act to be extracted heirupon.

[Proposition concerning the order of business]

9 October 1641

It is the opinioun of the noblemen that the methode of proceiding fittest for accelerating the accommodatioune of the bussines is to considder quhidder the particularis represented be the committie be the subject and grundis of the parliaments desyres to the king and the best motives to induce his majestie to the granting thairof. And this being condiscendit upoun, it is thought fit that sum of ilk estaitt be appoyntit to treatt with the king and knaw his majesties plessair in the particularis and give ane accompt to thair severall bodies, that upoun commoun resolutioun all bussines may be drawin to concord and conclusioun with consent of the severall estates. And when the committie makis thair report, that they mak the samene altogidder joyntlie to everie estate that thair be no discrepance in the report.
