Rege presente.
After reiding of the letter from the commissioners at London to the generall anent the marching of the armie, togidder with the letter from the generall to the committe for the armie, the questioune anent the marching of the armie over the bridge of Bervick, with the opinioune of the committe being represented to the king and parliament, it is agried that it be remitted to the generall ather to march over the bridge of Bervick conforme to the agreement betuix oure commissioners at London and the parliament of Ingland, or otherwayis that the armie march over one bridge to be bigged above Bervick in some commodious place for that effect. And it is concludit be the parliament that one instructione be drawin to the generall permitting the electioune heirof to his excellencie at his awin optione to march be any of the two bridges he thinkis expedient. And his majestie declaired that he should caus big the said bridge and haif it in readines upon his awin chargis, and that he had gevin ordour heiranent alreadie to the governor of Bervick. And it is speallie agreed that, incaice the bridge to be built be ather insufficient, or not in readines against the appointed tyme, that then the armie should march along the bridge of Bervick.
Anent the propositiounes maid be the committe appointed for the disbanding of the armie, the kingis majestie and estaittis remittis the same to the committe, whom they authorise with power and commissione for that effect. With power to thame to sett downe and conclude all instructiones and ordours necessar for that effect, and to graunt all commissiones or make proclamationes only for that purpose, which shall be als sufficient as gif they wer done in plaine parliament.
The lieutenant generall obtained libertie to goe from the parliament to attend the armie in thair retreate, bot the haill rest of the officiars of the armie who ar members of parliament, and als the generall commissioneris, ar commandit to stay and attend the parliament.
It is agreed be his majestie and estaittis of parliament that all members of parliament may come and sitt in any committe and that, albeit they be not named, yit they ar not excludit from being present, except whair depositiones of pairties or witnesis ar taking upon oath of secrecie; in quhilk caice none to be present bot these of the committee. And that the committe may call any member of parliament to thame whom they pleas.
It is concludit be his majestie and haill estaittis that ilk estaite shall meitt apairt be thameselfis at sevin hours in the morning and shall sitt from thence to nyne hours; and that the haill estaittis and bodie of the parliament shall conveine and meitt togidder at nyne hours and sitt to twelfe; and that the committees shall meitt at thrie hours in the efternoone and sitt till sex hours.
The estaittis nominattis the Erles of Roxburgh, Southesk, Mar and Lord Elphingstone for the nobilitie, the Lairdis of Dundas, Cambo, Athernie and Houstone for the baronis, Richard Maxwell for Edinburgh, the commissioners of Glasgow, Dumbartane and Irwing to revise all actis and articles past or presented formerlie in this parliament sence the first calling thairof, that these of ilk estate may give accompt thairof to their awin bodie, and the bodie to report thair thoughtis thairupon to the parliament gif thair be any thing in these actis quhilks they wald haif altered, added or diminished.
Article for pacificatione of the north red in audience of his majestie and estaittis, who appointis ane dowble thairof to be gevin to ilk estaite that they may be advysit thairupon.
Supplicatioune be Sir Jhone Hay, clerk of register, desyring libertie to stay at his awin hous and not to enter in prison conforme to the proclamatione for two or three dayis inrespect of his indispositione, being red in audience of his majestie and estaittis of parliament, who command the petitioner to obey the proclamatione, bot suspendis the executione heirof till the morne. The supplicant, then exhibiting to the parliament ane certificate upon oath from the physicianes of his indispone and danger of his health be imprisonment, Doctor Arnot, Doctor Kincaid or Doctor McClure being alwayis one, and appointis any of the saids three doctours whom the supplicant pleasis to call to goe and consult with him. And will haif consideratione the morne of the said certificate and desyre of the supplicatione.
Supplicatione be the maissir of counsale and sessione, complaining that they wer excludit from the parliament be the Erle Marshell, contrair to thair rightis and possession, red in audience of his majestie and estaittis of parliament, who appointis the Erle Marshell to see the same and be advysit thairwith whill the morne.
The Lord Burghley desyrit to be excused when his indispositione should force him to be absent, quhairunto the president answered that he was confident that the Lord Burghley wald not willinglie be absent.
Appointis everie estaite to think upon the committe for revising the registers whill the morne.
Anent the overture for the copper coyne, remittis the same to the committe nominate for revising the articles or papers presented to this parliament since the first calling thairof.
Anent the propositione maid to his majestie for ratifeing the actis maid in this sessione of parliament conforme to the accompt maid to him upon Mooneday last be some appointed be the estaittis for that effect, the kingis majestie declared that he wald take the same to his royall consideratione.
Anent the act for granting ane commissione to heir all accompts etc., appointis the estaittis to think thairupon whill the morne.
Appointis the proclamatione for dispensatione with the sitting of inferiour judicatories to be readie the morne, including commissariats.
