Our soverane lord, with advyse and consent of the estates of parliament, ratifies and approves the chartour made, givine and granted be our soverane lord, with advyse and consent of Sir James Carmichaell of that ilke, knycht, barronet, his hienes thesaurer deput, and remanent lordis and otheres of his hienes excheker of Scotland, his majesties commissioneres, to Sir James McGill of Cranstounriddell, knycht, barronet, ane of the senatoures of the colledge of justice, his aires maill and assigneyes whatsomevir heritablie, off all and haill the toune, landis and barrony of Cousland, with the tour, fortalice, maner place, houss, biggingis, yairdis, orchyairdis, mylnes, multoures, dowcates, tennentes, tennendries, service of free tennentes, advocatione and donatione of chaiplanries thairof and all ther pertinentes, lyand within the parochine of Innereske and shereffdome of Edinburgh, as for the principall; and of all and sindrie the lands wnderwrittin and fewfermes therof perteaneing to his majestie as ane pairt of his hienes propertie and lordshipe of Fyffe, lyand within the stewartrie and shereffdome thairof: off all and haill the landis of Largo and fewfermes thairof, extending yeerlie to fyve chalderes aites, three chalderes and eight bolles beer and ane chalder and tene bolles wheate; all and haill the landis of Ardeth, with the pertinentes and fewfermes therof, extending† to the soume of four chalderes, four bolles beer and three chalderes and four bolles wheat; and all and sindrie the landis of Rathellet, with the pertinentes and fewfermes thairof, extending yeerlie to tua chalderes, four bolles beere and tua bolles wheate, and that in speciall warrandyce and securitie of the said toune, landis and barrony of Cousland, with the pertinentes and teyndshaves therof wnderwrittin, principallie disponit in maner and to the effect mentionat in the said chartour, quhilke proceedis and is granted upoun the said Sir James McGill, his owne resignatione, to whom the samene perteenit heritablie of befoir be the resignatioune of George, erle of Kinnoull, sonne and air of umquhile George, erle of Kinnoull, his father, and the new gifte and dispositione conteyned in the said chartour made be his majestie, with consent foirsaid, to the said Sir James McGill and his foirsaidis heritabllie, of all and haill the saidis landis and barrony of Cousland, with the toure, fortalice, maner place and other pertinentes therof foirsaidis, and the dispositione contenit in the said chartour made be his majestie, with consent forsaid, to the said Sir James McGill and his foirsaidis, off all and sindrie the teyndshaves and personage teyndis of all and haill the saidis toun, landis and barrony of Cousland, with the pertinentes, perteaneing to his majestie as ane pairt of the lordshipe of Dumfermeling and patrimony therof, in maner mentionate in the said chartour as for principall, and the new gifte and dispositione thairincontenit, made and granted be his majestie, with consent foirsaid, to the said Sir James and his foirsaidis heritablie, off all and haill the said landis of Largo, Ardeth and Rathellet, with the pertinentes and fewfermes therof respective abovewrittin, also perteaneing of befor to the said Sir James McGill as said is, and that in speciall warrandyce and securitie of the saidis toune, landis and barrony of Cousland, with the pertinentes and teyndshaves and personage teyndis therof, principallie disponit as said is sua that if it shall happine the said Sir James McGill and his foirsaidis to be onywayes impedit or troubled or molested in the peaceable possessioune of the saidis toune, landis and barrony of Cousland and teyndshaves therof, or in the uptaking and intrometting with the mailles, fermes, proffittes and dewties therof or ony pairt of the samene, or the samene to be evictit be the restauratione of umquhile Johne, sometyme erle of Gowrie, reductione of his foirfaultour, or for ony other cause or occasione, that then and in that caise it shallbe leisome to them alse ofte to have ingres, regres and acces in and to all and sindrie the saidis landis of Largo, Ardeth and Rathellet, with the pertinentes and fewfermes therof respective abovewrittin, givine in warrandyce in maner foirsaid to be bruikit and possest be them ay and whill they may bruike and possese the saidis† and barrony of Cousland, with the pertinentes and teyndshaves thairof, without impediment, to be haldine of or soverane lord and his hienes successoures in free blenshe ferm, fie heritadge and frie barrony for yeerlie payment to his hienes and his successoures for the said toune, landis and barrony of Cousland, with the pertinentes, and for the saidis landis of Largo, Ardeth and Rathellet, with the pertinentes and fewfermes therof, off ane penny at the feist of Whitsonday in name of blenshe ferme; and for the saidis teyndshaves and personage teyndis off the saidis toun, landis and barrony of Cousland, with the pertinentes, of the soume of threescoir sex pundis therteene shillingis four pennyes money foirsaid at the feist of Candlemes, also in name of blensche ferme, as the said chartour wnder his hienes great seale, of the dait at Halyrudhous, the eight day of September lastbypast jM vjC fourtie one yeeres instant at mair lenth beeres, in all and sindrie the heedis, poyntes, clauss, articles, circumstances and conditiones thairincontenit, and efter the formes and tennoures therof in all poyntes. And our said soverane lord, with advyse and consent of the said estates of parliament, willis, grantes, decernes and ordeanes that this present ratificatione of the said chartour is and shall be of alse great strenth, force and effect to the said Sir James McGill, his aires maill and assigneyes foirsaidis, for bruiking and joysing of the saidis landis, barrony, teyndis and otheres abovewrittin, principall and warrandyce conteyned in the said chartour heritabllie, irredeemeablie and perpetuallie for evir, as if the said chartour heerby ratified wer totallie ad longum de verbo in verbum insert and conteyned heerin, and notwithstanding the samene shall not be sua done, quhairanent, and with all other defectes and imperfectiones whilkes may be proponit or alledged aganes the said chartour, or this present ratificatione thairof, our said soverane lord, with advyse and consent of the saidis estates of parliament, for his hienes and his successoures, hes dispensit and be thir presentes dispenses for evir. And alse our said soverane lord, with advyse and consent of the saidis estates of parliament, willis, grantes, decernes and ordeanes that the said chartour and this present ratificatione therof is and shallbe ane good, valied and sufficient right and securitie to the said Sir James McGill and his foirsaidis for bruikeing of the saidis toune, landis and barrony of Cousland, with the teyndis therof and ther pertinentes, as principall, and the saidis landis of Largo, Ardeth and Rathellet and fewfermes thairof, with ther pertinentes, in speciall and reall warrandyce and securitie thairof, in maner thairincontenit perpetuallie in all tymecomeing, notwithstanding of whatsomevir objectiones or impedimentes that may be proponit or alledged in the contrair.
