Our soverane lord, with advyse and consent of the estats presentlie conveened in parliament, ratifies and approves the act past in exchekker anent the declaratione of James Mellvill of Hallhill in favoures of the burghe of Bruntiland, quhairof the tennour fallowes, viz.: Apud Dalkeith decimo sexto die mensis Januarii anno domini millesimo sexesimo trigesimo octavo. The quhilke day the lordis of excheker sittand in full nomber anent the oppositione made be the baillies of Bruntiland to the passing of the Laird of Hallhilles signatour, compeired personallie James Mellvill of Hallhill and judiciallie declaired that the said signator presentlie past in his favoures wnder the name of pertinentes is not includit nor comprehendit the burghe of Bruntiland, nor port of the same and priviledges perteaneing therto, and sicklyke declaires that the de novodamus conteinit in the said signatour sould not be usit aganes the said burghe of Bruntiland nether be way of actione nor exceptione in sua fare as consernes the multores of the said burghe conteynt in the said gifte de novodamus, bot according to the former rightes of the saidis multoures standing in the persone of the said Laird of Hallhill and his predicessoures befor the dait of the said gifte de novodamus without ony farder strenthening therof in prejudice of the said burgh and ther priviledges, be vertew of the said gifte de novodamus, in sua farr as concernes the saidis multoures, quhairwpoun the saidis lordis ordeaned this present act to be mad. Our soverane lord and estates of parliament ratifies and approves the contract and appoyntment of the dait the tuentie fyfte and tuentie ane dayes of Julii and August, jM vjC therttie eight yeeres, quhairby Gilbert, now erle of Erroll, with consent of Johne, erle of Kinghorne, his tutour testamentar for his entres, and the said Erle of Kinghorne, for himselfe, as tutor testamentar and in name and behalfe of the said Erle of Erroll in respect of his pupillaritie for the tyme, with consent of certane otheres persones thairnominat, annellied and disponit to his majesties right trust cusigne and counssellour George, erle of Kinnoull etc., his aires maill and assigneyes, the landis, lordshipe and barronie of Errole and certane otheres landis, barronyes, teyndis and otheres therinconteyned, with the minut of contract wherwpoun the samene proceedit and the infeftment of recognitione and all otheres infeftmentes, takes and otheres rightes and securities made to the said George, erle of Kinnoull, or ony of his authoures, of and conserneing the landis, barronyes and otheres mentionat in the said contract or of any pairt or pairtes therof, in all poyntes, articles and clauss therincontenit and eftir the formes and tenors therof. Our soverane lord and estates of parliament ratifies and approves the act of adjornell givine and pronunced befor the justice, of the dait the tuentie nynt of Julii, jM vjC thertie sex yeeres, be the quhilke Patrike Dumbar of Killboyuke and Alexander Dumbarr, appeirand of Bracco, with certane otheres, ther servantes and complices, are declaired and adjudged fugitives fra his majesties lawes at the instance of the relictes and bairnes, kin and freendis of umquhile Niniane Dumbare and of umquhile Robert Dumbar, and at the instance of his majesties advocate, for the cruel murther and slaughter of the said umquhile Niniane and Robert Dumbares be the said Patrike and Alexander Dumbares, ther serveantes and complices, wnder trust and assurance in maner mentionat in the criminall letters raisit therwpoun and act and doome foirsaid; togidder with the signatoures of escheates and infeftmentes granted to James Dumbarr, sone to Williame Dumbare of Hemperigs, of the escheat and landis perteaneing to the saidis persones denunced as said is, vacand in his majesties handis throw the said doome givine upoun the cryme foirsaid, being murthure wnder trust, quhilke is declaired to be treasounable be the act of parliament mad in the yeere of God 1587, cap. 51, intitulat, 'Murther or slaughter wnder credit is treasoun', in the haill heedis, poyntes and articles therof. Our soverane lord and estates of parliament ratifies and approves the warrand delyverance of the lords of secreet counsell granted in favoures of the takismen of the teynd herring of Dumbar, quhairby it is ordeanit that none of the fisheres and couperes of herring attending the herring drove and fishing at Dumbar presume nor take wpoun hand to weit thair nettis or buy any herring till first they come to the admirall, his deputes or clerkes resident at Dumbarre, and give wpe to him the name of the skipper and owner of ther boat, and that they act themselffes to keepe ordour the tyme of the fishing, and that they shall make payment of the assyse, teynd and other dewties payable be them, and alse that they shall requyre and thankfullie pay ther teynd before they depairt, wnder the paine of tuentie pund to be payed be the owner of the boat if he be present, and if he be absent by the skipper, by and attour the reparatioune of the wronges to be done be them to any of the leidges, beereing certificatione to them that failyies that they shall be decerned to have incurred the said paine and executione shall pas againes theme for payment therof and for satisfaction of the pairties skaithed, in the haill heedis, articles and circumstances therof. Our soverane lord and estates of parliament ratifies and approves the chartour and patent granted be his majestie to the baillies, counsell, commontie and inhabitantes of the burghe of Southquenesferrie, dismembring the said burgh of Southequeenesferrie fra the kirke and parochin of Dalmenie and erecting the samene in ane severall paroche kirke, and giveing to them and ther successoures the advocatione, donatione and right of patronage of the said paroche kirke of South Queenesferrie with the nomination and presentatione of the minister serveing the cure at the said kirke, they payand to them the stipend mentioned in the said chartour, togidder with the power and libertie givine to them to stent and tax ther neighthoures and inhabitantes of the said burghe for payment of ther proportionall pairtes of the said stipend, in maner conteyned in the said chartour, quhilke is of the dait at Theobaldis, the nynt day of Julii, jM vjC therttie fyve yeeres; togidder with the contract and appoyntment made betuixt the minister and patrone of the said kirk of Dallmenie, quhairof the said burghe of Southqueenesferrie wes ane pairt of befoir, and the saidis baillies, counsell and commontie of the said Southqueenesferrie one the other pairt, anent the dismembring of the said burghe and paroche fra the parochine of Dallmenie, with the act of commissioune of surrenderes ratifieing and approveing the said contract and erecting the said kirke of southqueenesferrie in ane severall paroche kirke, quhilke act is of the dait the first day of Julii, jM vjC therttie fyve yeeres. And sicklyke ratifies and approves the chartour of erectione of the said burghe of Southqueenesferrie in an free burghe royall and in ane free port, heavine and herberie with the haill liberties, priviledges and immunities perteaneing to ane free burghe royall, togidder with the minut and small customes, anchorages, pryme gilt and otheres liberties whatsomevir perteaneing to the said free port and heavine in maner contenit in the said chartour of erectione, quhilke is of the dait at Newmerkat, the tuentie ane day of November jM vjC therttie sex yeeres, in the haill heedis, clauss, articles and conditiones, specified and conteyned in the saidis chartoures, contractes, actes of commisioune and otheres respective foirsaidis. And willis and grantes that this present ratificatione shall be alse effectuall as if the samene wer word be word insert heerin, reserveand and exceptand furthe heerof to George Dundas of that ilke that pairt of the mure commonlie callit the Ferrie Mure, as the samene is designit in the instrument of divisione made therof betuixt the said Laird of Dundas and the saidis baillies and counsell of the said burgh, and alse reserveand to him the heritable right of the Wester Loaneing, leading to and fra the said mure, exceptand allenerlie to the saidis baillies, counsell and commontie of the said burghe and ther successoures in all tymecomeing, passage, frie ishe and entrie to and fra the said mure and burgh, conforme to the declaratione made be the saidis baillies and counsell of the said burghe in favoures of the said Laird of Dundas of the dait the sext day of Julii lastbypast in this instant yeir of God jM vjC fourtie ane yeeres, alsweell anent the said mure as loaneing in maner therinconteynit, and conforme therto in all poyntes. Attoure, his majestie and estates foirsaidis, be thir presentes, erectes the said burghe of Southqueenesferrie and kirke therof in ane free burghe royall and severall paroche kirke, quhairof the right of advocatione and presentatione perteenes to them as said is, and gives to the proveist, baillies, counsell and commontie of the said burghe and ther successoures power and libertie to stent the burgess and inhabitantes of the said burghe for payment of the minister serveing the cure at the said kirke and his successoures of the modified stipend contenit in the said act of commissione of surrenderes and chartour of erectione foirsaid ratifieing the samene, and that proportionallie according to the rait and proportione of the goodis, landis and abilitie of everie ane of the saidis baillies, commontie and inhabitantes of the said burgh. And it is heerby declaired that this present ratificatione shall be nowayes prejudiciall to the Erle of Dumfermeling and his successoures as baillies of the lordshipe and regalitie of Dumfermeling anent whatsomevir jurisdictione, rightes, liberties and priviledges perteaneing therto as bailyie foirsaid within the boundis of the said burghe used and wont, and that the proveist, baillies, counsell, commonties and induelleres of the said burghe shall be lyable and astricted in all tymecomeing as they have beene in tymepast to the jurisdictione of the regalitie of Dumfermeling and to doe, observe and performe all dewtie and obedience thairwnto sicklyke and in the samene maner as if the foirsaid erectione abovementioned and this present ratificatione therof had never bene made nor granted.

Our soverane lord, with advyse and consent of the estates of parliament, hes ratified and approvine and, be thir presentes, ratifies and approves the erectioun of the kirke of Creichtoun and confirmes the fundatione therof, and declaires that the colledge kirke of Creichtoun shall be the paroche kirke, and hes converted and, be thir presentes, convertes and appropriates all and sindrie teyndis, fruites, rentes, emolumentes and other dewties whatsomevir dew to the vicares or prebendares thairof to the said kirke of Creichtoune and to the ministeres now serveing the cuire and that shall happine to serve the cuire at the said kirke in all tymecomeing, with the rentes and emolumentes that perteened to the ministeres or viccares of old, or to the ministeres now serveing the cuire at the said kirke, and wherof the saides ministeres, viccares and prebendares or any of them have bene in possessione at any time; and decernes and ordeanes that this present ratificatione and act of converting and appropriating in maner foirsaid is and shall be ane good, valied and sufficient right to them and ther successoures for brooking and joysing the samene perpetuallie in all tymecomeing, provyding that the erectione and conversione be not prejudiciall to the right honorabll Sir Patrik Murrey of Elibanke, knycht, and his rycht he hes of these landis quhilkes are holdine be him of the proveist of the said kirke, and of the takes of the teyndis belonging to him within the said parochine, bot that he shall bruike these in tymecomeing as he does presentlie.
