Our soverane lord, with advyse and consent of the estates of this present parliament, hes ratified and approvin and, be the tennour heerof, ratifies and approves the chartour and infeftment granted be his hienes umquhill darrest father, wnder his hienes great seale, of the dait the penult day of Merch the yeere of God jM vjC and nynteene yeeres, to his hienes lovitt Sir Alexander Foulles, feare of Collingtoune, knycht, designed be the said chartour Alexander Foules, sone lauchfull and appeirand air to Sir James Foulles of Collingtoun, knicht, who is now deceist, and Dame Elizabethe Hepburne, younger, relict of umquhill Sir Johne Stewart of Ardinleis†, knycht, shereff of But, and than future and now present spous to the said Sir Alexander, and to the longest liver of them tuo, in conjunctfie, and to the aires maill then laufullie to have bene gottine betuixt them, quhilkis failyieing to the said Sir Alexander, his aires maill and assigneyes whatsomevir, off all and haill the landis and barrony of Collingtoun lyand within the shereffdome of Edinburghe, comprehending all and sindrie the landis, anuellrent, teyndis, teyndshaves, alsweell personage as viccarage, of the landis of Collingtoun and Oxingangis and viccarage of Hailles, and of all and sindrie the teyndshaves of the toune and landis of Craiglockhart, with mylnes, alsweell cornemylnes as walkemylnes, and all otheres mentionat and conteyned in the said chartour; as lykewayes ane other chairtour made and granted be his majestie, with advyse and consent of his hienes thesaurair, comptroller and collectour generall of his majesties new augmentationes and otheres therinexprest to the said umquhill Sir James Foulles of Collingtoune, knycht, in lyferent for all the dayes of his lyftyme, and to the said Sir Alexander Foules, younger, of Collingtoun, his eldest sone, his aires and assigneyes whatsomevir heritablie off all and sindrie the teyndshaves of all and sindrie the toune and landis of Craig Lockhart, with toftes, croftes, outsettes, pairtes, pendicles, and pertinentes therof, of old unit to the parochine of Saintcuthbert and now to the parochine of Hailles, within the sherefdome of Edinburghe, quhilke chartour is of the dait the last day of Julii 1633 yeeres; as also ane lettir of dispositione mad and granted be ane noble and potent erle Johne, erle of Traquair, lord Lintoune and Caverstoun, heighe thesaurer, comptroller and thesaurer of his majesties new augmentationes, with advyse of certane commissioneres appoynted be his majestie, subscryveres of the said dispositione, to the said Sir Alexander Foules of Collingtoune, his aires and assigneyes, off all and sindrie the annuities adebted to his majestie in ony maner of way furth of the teyndis of the landis of Collingtoune, with the four aikeres of land belonging to the corne mylne thairof, the brae lyand to the walkemylne of the samene estimat to ane aiker of land, landis of Oxingangis and Beales†, portione of Bonalay, landis of Dreghorne, that pairt of the landis of Swanstoune and landis of Craiglockhart, all lyand with the said parochine of Hailles and shereffdome of Edinburghe, and that alsweell of all yeeres and croptes then bygone as in all tymecomeing thairefter, quhilke dispositione is of the dait at Edinburgh, the tuentie nynt day of Julii jM vjC threttie sex yeeres, registrat in the bookes of excheker wpoun the penult of the samene moneth; and in lykemaner ane act of secreet counsell of the dait the third day of Julii 1634 yeers, quhairby the lordis of secreet counsell hes fund and declaired the benefice of the preceptorie of Saint Anthonies to have beene of langtyme bygone and to be in all tymecomeing supprest and extinct, and hes ordeaned the gifte of the said preceptorie granted be his majestie to Maister Williame Wishart, than persone of Restallrige, with the signatour and warrand therof to be cancellit and deleit furth of the register wherin the samene is insert, and that no gifte of the said preceptorie be granted or past to or in favoures of ony persone whatsomevir in tyme therefter in maner and for the cause exprest in the said act, as in the saidis tuo chairtours, lettir of dispositione and act of counsell respective at mair lenth is conteyned, in all and sindrie heedis, articles and clauss therof whatsomevir, and all that hes fallowed or may fallow therwpoun. Attoure, our said soverane lord, with advyse and consent foirsaid, decernes and ordeanes that the foirsaidis rightes and securities now ratified and approvine shall be good and valied rightes to the said Sir Alexander Foulles and Dame Eleizabeth Hepburne, his spous, and to ther aires, assigneyes and successoures whatsomevir, for bruikeing and joysing of the landis, teyndis, mylnes, multoures and otheres thairinmentionat at ther pleasour perpetuallie and in all tymecoming conforme to the saidis rightes heerby ratified in all poyntes, and declaires this present ratificatione therof to be alse sufficient as if the samene wer word be word insert heerintill; quhairanent our said soverane, with consent of the estates of parliament, hes dispensit and heerby dispenses for evir.
