Our soverane lord, considering that his majestie was latlie pleased to condischend to the humble desyre of his majesties estates of parliament to nominat by ther advyce and approbatione his officers of estate, of whome his majesties heighe thesaurer is one, and that his majestie for the present is not resolved upoun the nominatione of any particular persone to enjoy the said place but heath, with advyce of the saidis estates, takine present course to supplie the want of a principall thesaurer by a committee; therfore his majestie, with consent of the saidis estates, makes, nominats and constitutes Johne, erle of Loudoune, heighe chancellor of this kingdome, Archbald, erle of Argyle, lord Campbell and Lorne, Williame, erle of Glencairne, lord Killmares, Johne, lord Lindesay of Struther, and Sir James Carmichaell of that ilke, knight, thesaurer depute, his majesties commissioneres to the effect wnderwrittin, and gives and grantes to them, or any three of them, the full place and power of his majesties heighe thesaurer, comptroller, collector and thesaurer of his majesties new augmentationes [with all liberties, priviledges, immunities, benefitts and emoluments quhatsumever perteining to the said place of heighe thesaurer, comptroller, collector and thesaurer of his majesties new augmentationes]†, and that in alse ample maner and quality as the samene was in the persones of any of his majesties heighe thesaureres in any tyme of before. With power to them, or any three of them, to wplifte, gather and intromet with all and sindrie his majesties rentes, revenewes, customes, imposts, casualityes, commodities, dueties and otheres whatsoevir anywayes belonging to his majestie within this kingdome or to his majesties darrest sone, the prince, and that of all yeires and termes bygone and yeerlie in tyme comeing. And with power to them, or any three of them, with advyce of the remanent commissioneres of excheker conteyned in his majesties commissione wnder the great seale, and according to the tennour therof, to pas, compone and subscryve signatoures, giftes, confirmationes, escheates, lyferentes, remissiones, tutories, giftes by foirfaultour, recognitione, wairdis, mariages, releeffe, nonentress, legittimationes, presentationes, takes, rentalles, licences, dispensationes and otheres dispositiones, writtes and securities whatsoevir perteaneing to the saidis offices or any of them or to the power and priviledges thairof, but prejudice allwayes to the said Sir James Carmichaell, thesaurer depute, of his giftes of the office of thesaurary deput, whole liberties, power and priviledges therinconteyned, which are holdene as heerinexprest, bot adding or pairing to him in the poynt of receiveing and without derogatione in any sort to this present act and commissione. And it is declaired that the yeerlie fees and other casualities due to his majesties principall thesaurer, and especiallie the soume of four thousand pundis Scots money, shall be devydit equallie amongest the saidis first foure of the saidis commissioneres by the said thesaurer deput who heath right to his owne fee and casualities by vertewe of his giftes granted to him therwpoun. And his majestie, with consent foirsaid, ordeanes the lordis of his majesties privie counsell, sessione or excheker to grant and direct lettires at the instance of the saidis commissioners for ansuering and obeying them, ther challmerlanes, wnder receiveres and officeres of all and sindrie of his majesties rentes, casualities, customes, imposts and dueties belonging to the said office, and that endureing the tyme of this present commissione, which shall endure to the nixt parliamente.

The quhilk day, the kingis majestie and estates of parliament ordeanes Johne, lord Loudoune, chancellor, to receive the lordis and otheres of his hienes privie counsell and the senatoures, ordinare and extraordinar, of the colledge of justice respective, and take ther oathes in ther said admissione therto, conforme to the actes of this present parliament made anent the nominatione and electione of the saidis counsellouris and sessioneres to thair saidis places respective, and conform to the commissione granted be the king and parliament to the secreet counselle.
