Conforme to the quhilke ordinance abovementionat, compeired Johne, erle of Mare, Johne, erle of Wigtoune, Johne, erle of Kinghorne, George, erle of Seaforth and David, erle of Southeske as cautionores for the saidis James, erle of Montrose, Archbald, lord Naper and Sir George Stirling of Keire; and alse compeired Sir Lodowicke Houstoune of that ilke as cationer for the said Sir Archbald Stewart, Sir Johne Spotswood, cationer for the said Sir Robert Spotswood, Maister William Hay, cationer for the said Sir Johne Hay, and Gabriell Cunynghame as cationer for the said Lieutennent Collonell Stewart; and the saidis persones cationeres abovenamed became judiciallie acted and obleist as cautioners for the persones abovenamed for whom they are cationeres respective as said is, and that as cautioneres for the saidis persones supplicantes to the effect, for the cause and with certificatione respective abovementionat conteent in the said act and conforme thairto, and dureing the tyme abovewrittin therinspecified. The quhilk day, anent the supplicatione givine in to the parliament be Alexander Cunynghame, merchand burges of Craill, makeand mentione of the detriment susteent be him in Ingland for refusing to give oathes prejudiciall to the covenant, being keeped eighteene monethes in prisone in the fleete at Londone and lossing the benefite of his trade to the worth of ane hundreth pund sterling, with fourscoir ten pundis sterling of chairges and tuo hundreth pundis as the losse of his calling and fourtie pundis to the officeres of the jayle, which is in all four hundreth and threttie pund sterling, and therfor desyreing the parliament so to take the samene to consideracion, as the supplicant may have reparatione. Quhilke supplicatione being upoun the fourteene day of August last red in audience of the parliament, they fand the desyre thairof just and reassonable, and declaired they would take the samene in due tyme to consideracione and provyde course for the supplicantes reparatione, conforme to the desyre of the petitione. Lykeas therefter the foirsaid supplicatione being againe motioned in parliament the fyfte of November instant, the samene wes then appoynted to be givine to the kingis advocate to be delyvered be him to the secreeter to be presented to his majestie. Lykeas wpoun the eight of November, his majestie, being made acquant with the foirsaid petitione, was gratiouslie pleased to referre the consideracion therof to the parliament, quherwpon the parliament wpoun the ellevint day of November instant referrit the consideracione therof to the committee wnderwrittin, viz: the Erle of Glencairne and Lord Lindesay for the nobility, the lairdis of Lugtoun and Cambo for the barrones, and the commissioneres of Saintandroes and Dumbartane for the burrowes, quho wpoun the fyfteene day of November instant fand the desyre of the petitione verie reassonable and thought it expedient that ane warrand be granted to the commissioneris for satisfieing the supplicant of the soume of foure hundreth and therttie pundis sterling. And the foirsaid supplicatione being of new agane this day moved to the kingis majestie and estates of parliament, and the samene with the severall reportes and delyverances respective before rehearsit being takine to consideracione, the kingis majestie and estates of parliament decernes and ordeanes the foirsaid soume of foure hundreth†pundis sterling to be payed to the said Alexander Cunynghame, supplicante, be the commissioneris out of the first and reddiest moneyes in ther handis for the cause conteened in the foirsaid supplicatione.

The quhilk day the kinges majestie and estates of parliament, haveing hard the petitione givine in be Capitane Williame Stewart, sone to Harie Stewarte of Cougan, esquyer, in Ireland, proporting that he is to petitione the parliament of England for the reperationes of the great loisses and sufferingis susteened be his said father wpoun occasione of his constant adhering the Nationall Covenant of the subjectes of this kingdome, and in regaird the petitioner himselfe hes bene also ane sufferer for that same cause and was forced to reteir himselfe to this his native cuntrey quhair he did serve as a captane faithfullie the tyme of the late troubles and since heath caried himselfe worthilie as a good patriote in particulares of great consernement, therefore desyreing his majestie and the estates to recommend the petitioner and his father there condition and cause to the parliament of England, as the petitione more fullie proportes. Quhairwith his majestie and estates, being weel advysed and knoweing perfytlie the generous and loyall cariage of the said Capitane Williame, wherof they doe by these presentes give trewe and faithfull testimony; they doe therfore recommend him, his father and ther cause to the favorable heiring of his majestie and the parliament of England that they may find that measour of ther favour and benignitie in wpseting ther loiss as may obleidge the estates of this kingdome to the lyke retributione as occasione shall offer.

The quhilk day, anent the supplicatione givine in to the kingis majestie and estates of parliament be Johne, lord Sinclaire, beirand that in the begining of thir troubles he was imployed toward the northerne pairtes of this kingdome for giveing informatione to them of the reassones and groundis of the proceeding in reformatione and advanceing of the good cause, and bringing ane regiment if it ware possible from thence hither, which voyage the supplicant wndertooke and by Godis assistance overcame the difficulties and past throughe the most pairt of that divisione committed to his chairge with such traine and expenss as was necessare for the publict end and his securiti, and not onlie be trewe informatione brought the people to that conformity which heath evir since continowed them in quyetnes, bot did levie and bring from thence ane compleet regiment, which yit doeth continue in the north for good wse and heath therby relived the publict of the greater expenss of ane greater regiment formerlie imployed in these places. And sieing all these bygone troubles are happily quyeted, the supplicant representes these to the king and parliament, desyreing to take the premiss and his supplicatione givine in therupon to consideracion that he may have exonoracion and approbatione of his service and that such course may be takine heiranent as shall seeme expedient, as the foirsaid supplicatione in the selfe at more lenth proportes. The Lord Borthwicke protestite that the reiding and calling of the rolles as they stand red and callit this day, nor his ryding and sitting in this parliament, doe nowayes prejudge him of that place and preceance due to him conforme to his birth rightes and infeftmentes, bot that it shall be laufull to him, according to his birth rightes and infeftmentes, to cleame place and preceance in parliamente and all other private and publict meetingis as accordis of the law; and heirwpon askit instrumentes.
The Laird of Cambo, for the shereffdome of Fyiffe, protestit that the reiding and calling of the rolles as the samene standis this day callit and the ryding of the commissioneres of shyres in this present parliament should nowayes be prejudiciall to the place and ranke due to the said shereffdome of Fyffe and commissioneres therof in parliament.
The Laird of Weddirburne, for the shereffdome of Berwike, protestit that the reiding and calling of the rolles and ryding, sitting and voyceing of the commissioneres of shyres in this present parliament should nowayes be prejudiciall to the shereffrdome of Berwik and commissioneres therof anent ther ranke and place in former parliaments and in parliamentes heirefter.
The Laird of Cessnocke, in name of the haill barrones, protestit that the reiding and calling of the rolles, the ryding, sitting and voyceing of the commissioners this day in this present parliament should nowayes be prejudiciall to any of the shyres of this kingdome and ther commissioneris anent the places and rankes dewe to the saidis haill shyres and ther commissionares in any parliamentes heirefter.

The quhilk day, in presence of the kingis majestie and estates of parliament conveened in parliament, Alexander, erle of Galloway gave in ane list of these to whome he was content to submitt all contraversies betuixt him and the toune of Wigtoune and all otheres who had givine in supplicationes againes him befor the parliament, viz: Erles of Mare, Eglingtoune, Seaforth, Lauderdaill and Southeske and the Laird of Lage. As also the toune of Wigtoune gave in ther list, viz: the Marqueis of Argyle, the Erle of Glencairne, Sir Thomas Hoipe of Carse, Williame Rige of Ethernie, James Cochrane, commissioner for Edinburgh, and Johne Semple, commisssioner for Dumbartane. And either of them nominat the Lord Chancellour and the Lord Ballmerino, president of the parliament, or any of them being present, or to four for ilke pairtie nominat as said is, with the oversmane to decyde in all contraversies betuixt the saidis pairties, betuixt and the fyfteene day of Januar nixtocome, with power to the saidis judges and oversmane to prorogat etc.; and ordeanes the samene submissioune to be recordit in the bookes of parliament.

Our soverane lord and estates of parliamente, considering that the pryces of all merchandice doe daylie ryse to exceeding great dearthes, which is alledged to be occasioned throw extraordinarie customes and impositiones, for remeid wherof, his majestie, with advyce and consent of the saidis estates, doeth dischairge all and sindrie whatsoevir customes and impositiones exacted by the customeres which are not allowed and approved by the actes of parliament, and especiallie the late custome of tuo and ane halfe per centum and late newe impositione of four pund wpoun the tunne of wyne, and all raising of his majesties customes directlie or indirectlie without consent of parliament. And becaus that the too much troubling of merchant estate and draweing of maisteres and marineres from there ordinarie chairges doeth much impede the trade, therfore his majestie, with advyce and consent foirsaid, dischairges the taking of merchantes, maisters and marineres oathes in the mater of customes. And to the end that the subject of trade may not be restrained with wnnecessary customes, therfor his majestie, with consent foirsaid, declaires that all goodis and merchandyce imported from forrane places to this kingdome and out paying inward custome shall be free of all outward custome, according as is wsed in England and Ireland. Lykeas his majestie declaires that he consented to the act abowewrittin wpoun this conditione: that commissione and warrant be granted to the exchekker to establishe the booke of raites, according as the pryces of merchandyce now reules; and his majestie permitted the optioun to the burrowes, wherwpoun the burrowes, haveing advysed, they made choyce to be reuled by the booke of rates anent the customes and consented that commission should be granted to the exchekker to establishe the booke of rates, according as the pryces of merchandyce now reules. In respect wherof, our soverane lord and estates of parliament ordeane a commissione to be drawne wpe to the excheker to the effect foirsaid, and extracted thairupoun for establishing the book of rates according as the pryces of merchandyce now reulles. And therfor our said soverane lord and estates of parliament ordeanes the act abovementioned to stand as a law in maner and to the effect beforerehearsed.

Our soverane lord, considering that his majestie was latlie pleased to condischend to the humble desyre of his majesties estates of parliament to nominat by ther advyce and approbatione his officers of estate, of whome his majesties heighe thesaurer is one, and that his majestie for the present is not resolved upoun the nominatione of any particular persone to enjoy the said place but heath, with advyce of the saidis estates, takine present course to supplie the want of a principall thesaurer by a committee; therfore his majestie, with consent of the saidis estates, makes, nominats and constitutes Johne, erle of Loudoune, heighe chancellor of this kingdome, Archbald, erle of Argyle, lord Campbell and Lorne, Williame, erle of Glencairne, lord Killmares, Johne, lord Lindesay of Struther, and Sir James Carmichaell of that ilke, knight, thesaurer depute, his majesties commissioneres to the effect wnderwrittin, and gives and grantes to them, or any three of them, the full place and power of his majesties heighe thesaurer, comptroller, collector and thesaurer of his majesties new augmentationes [with all liberties, priviledges, immunities, benefitts and emoluments quhatsumever perteining to the said place of heighe thesaurer, comptroller, collector and thesaurer of his majesties new augmentationes]†, and that in alse ample maner and quality as the samene was in the persones of any of his majesties heighe thesaureres in any tyme of before. With power to them, or any three of them, to wplifte, gather and intromet with all and sindrie his majesties rentes, revenewes, customes, imposts, casualityes, commodities, dueties and otheres whatsoevir anywayes belonging to his majestie within this kingdome or to his majesties darrest sone, the prince, and that of all yeires and termes bygone and yeerlie in tyme comeing. And with power to them, or any three of them, with advyce of the remanent commissioneres of excheker conteyned in his majesties commissione wnder the great seale, and according to the tennour therof, to pas, compone and subscryve signatoures, giftes, confirmationes, escheates, lyferentes, remissiones, tutories, giftes by foirfaultour, recognitione, wairdis, mariages, releeffe, nonentress, legittimationes, presentationes, takes, rentalles, licences, dispensationes and otheres dispositiones, writtes and securities whatsoevir perteaneing to the saidis offices or any of them or to the power and priviledges thairof, but prejudice allwayes to the said Sir James Carmichaell, thesaurer depute, of his giftes of the office of thesaurary deput, whole liberties, power and priviledges therinconteyned, which are holdene as heerinexprest, bot adding or pairing to him in the poynt of receiveing and without derogatione in any sort to this present act and commissione. And it is declaired that the yeerlie fees and other casualities due to his majesties principall thesaurer, and especiallie the soume of four thousand pundis Scots money, shall be devydit equallie amongest the saidis first foure of the saidis commissioneres by the said thesaurer deput who heath right to his owne fee and casualities by vertewe of his giftes granted to him therwpoun. Our soverane lord, with advyse and consent of the estates of parliament, considering that the burghe of Lauder is the speciall and heede burghe within the bailliarie of Lauderdaill and shereffdome of Berwicke, and that ther is great quantities of nolt, sheepe, wooll and wther bestiall to be sold within the said bailliarie and shereffdome, and that one of the dayes appoynted for holding of one of there faires is altogider wnproffitable in respect of the shortnes of the day, foulnes of the weather that uses to be at that tyme, deepnes of the soyle and greatnes of the water of Leidder runeing neir the said burghe, whilke hinderes both the bestiall and goodis thane to be transported to and from the said burghe, and the leiges and people to come and goe therto (without great hazard), sua that the inhabitantes, not onlie of the said burghe, bot also of the whole shereffdome and boundis round aboute and otheres haveand to doe in the faires therof, greatlie desyres and hes earnestlie supplicat his majestie and his hienes commissioneres and estates of parliament that there be ane faire and mercat holdine and keeped in the said burghe of Lauder upoun the tuentie tuo day of July, callit Sanct Magdalene hir day, being in the middest of sommer quhen the bestiall, nolt, sheep, woole and otheres merchandyce of that kynd which ar verie plentifull and aboundis in these pairtes are at best, and may most commodiouslie be transported to and from the said burghe, and when the people may most convenientlie and saiflie repaire therto to sell and buy, and without danger of the wateres lyand therabout, quhilke his majestie and estates of parliament hes thought reassonable and meete. Excepting forthe of this present ratificatione the restraint of the exportatione of yairne, the dischairge wherof the king and estats remitts to the commissione grantit for manufactories to be considerit and determinat be that commissione according as the weaveres shall qualifie befoir that commissione the expediencie and necessitie of the said restraint. Reservand lykewayes wnprejudged be this ratificatione the priviledge granted to manufactories by the said commissioun appoynted for establishing thairof, and ordeanes the saidis weaveres in whose favoures this ratificatione is granted to doe thair worke alse weell, alse chaipe and alse tymouslie as any otheres of ther crafte and trade at the seight of the magistrats and toune counsell of Edinburgh. Our soverane lord, with advyse and consent of the estates of this present parliament, considering that ther wes ane act of parliament formit and set doune and presented and givine in before his majestie and estates of the parliament haldine at Edinburghe in the moneth of July 1633 yeeres be the proveist, baillies and counsell of Edinburgh for the soume of tuellffe thousand merkis money of this realme to be wplifted yeerlie off the haill inbabitantes and induelleres within the said burghe, the lordis of his majesties counsell and sessione beinge onlie excepted, according to the quantitie and proportione of the maill they pey or the houss where they reseid, may pay to be applyed only for the sustentatione of the ministeres within the said burgh of Edinburghe, quhilke being dewlie considered be his majestie and estates of the said parliament haldine at Edinburgh in the said moneth of Julii 1633 yeeres, his majestie, with the advyse of the estates of the said parliament, wes gratiouslie pleased to remitt and reccommend the same to the lords of his majesties privie counsell, to whom his majestie and estates foirsaidis gave full power and commissione to consider, advyse and try the samene act with the equitie, necessitie and expediencie therof, and to decerne, statut and determine therine as they shall thinke expedient for the good and weell of his majesties leiges, and ordeanit the decreit, statute, ordinance and determinatione to be mad, givine and pronunced be the saidis lordis of privie counsell anent the said act to have the strenth, force and effect of ane sentance and act of parliament in all tymecomeing, as the said act and reference of the parliament made to his majesties privie counsell at lenth beeres. Lykeas the saidis lords of secreet counsell, be ther decreet and act of the dait the eighteene day of Merche 1634 yeeres, fand and declaired that the course and order prescryved and set doune in the act foirsaid, givine in be the saidis proveist, baillies, counsell and commontie of Edinburghe to his majestie and laite parliament foirsaid, tuitching ther ministeres stipendis and setling therof, is a werie good and faire course tending to the weell of the said burghe and setling the ministrie therof in ther stipendis, with this speciall provisione and exceptione: that the lordis of his majesties secreet counsell and the lordis of the sessione shall nowayes be subject to contribut to this impositione; and with certane other declarationes mentionat in the said decreet or act of counsell, as in the samene act or decreet of the saidis lordis of secreet counsell of the dait abovewrittin at mair lenth beires. And sicklyke ther was ane act made be the saidis lordis of secreet counsell of the dait the ellevint day of Julii 1637 yeeres, finding that the memberes of the colledge of justice, the advocates, clerkes, wretteres, are exempted from the said act of parliament, wherby all the inbabitantes within the said burghe of Edinburghe (except the lordis of secreet counsell and sessione) are made lyable to be taxed towardis the payment of the saidis ministers stipendis, according to the proportione of the maill of the houss wherin they dwell, and declaired them to be includit in the foirsaid exceptione made in favoures of the saidis lordis of counsell and sessione in regaird of the saidis advocates, clerkes and writters ther voluntarrie offer to contribut a proportionall taxt towards the payment of the saidis ministeres stipendis, as in the said act of secreet counsell at mair lenth is conteyned. Quhilke act givine in to his majestie† of the said laite parliament 1633 yeeres, and the reference thairof foirsaid to the saidis lords of privie counsel and ther saids act and decreet fallowing therwpoun, ware ratified and approvine be his majestie be his hienes lettir of ratificationes wnder his hienes great seale off the dait at Quhythall, the nynteene day of Januar 1636 yeeres, as the said ratificatione wnder the great seale of the dait abowewrittine at mair lenth beeres. And also there wes ane act made in the bookes of sederunt of the sessione of the dait the tuentie nynt day of Julii 1637 yeeres, makeand mentione of the offer made be the advocats, clerkes, wretteres and remanent memberes of the colledge of justice for themselves and ther successoures in the saidis places and offices respective to pay yeerlie in maner mentionat in the said decreet to the proveist, baillies, counsell and commountie of the said burghe and there thesaureres, collectoures and others to be appoynted be them present and to come, and that all to the behuife of the saidis ministeres serveing the cure within the said burghe, all and haill the soume of ellevine pennies money of this realme forth of ilke tuentie shillingis of maill, quhilkis sall be payed be the saidis memberes of the colledge of justice for ther houss, challmeres and boothes occupyed and possessed be theme or otherwayes according to the same proportione effeirand to the stent of the houss, challmeres or buithes possest be them be heritadge, lyferent or favour, and that yeerlie and termlie at tuo termes in the yeir, Whitsonday and Mertimes in winter, be equall portiones, beginand the first termes payment therof at the feist and terme of Whitsonday jM vjC threttie sevine yeeres wnder the speciall reservatione and conditione made be the saidis advocats, clerkes, wretteres and remanent memberes of the said colledge of justice that the said voluntar offer should nowayes be prejudiciall to them of all ther priviledges, liberties and immunities quhatsomevir, and that the said offer wes accepted be the saidis proveist and baillies of the said burghe of Edinburgh for themselves and in name of the counsell and commountie thairof, and ther successoures proveist, baillies, counsell and commontie of the said burghe with the express provisione, conditione and reservatione of the priviledges foirsaidis, to the quhilke voluntar offer and acceptatione foirsaid the saidis lordis of counsell and sessione interponit ther decreet and authoritie. Therefore our said soverane lord and estates of this present parliament, finding the mater abovewrittin to be reassonable and to tend to the advancement of religione and furtherance of the ministeres serveing the cure within the said burghe of Edinburghe to competent stipendis haife ratified and approvine, and be thir presentes ratifies and approves the foirsaid act quhilke wes givine in to his majestie and estates of the said former laite parliament, the reference therof abovewrittin to the saidis lordis of privie counsell, the foirsaid decreet or act fallowing therwpoun givine and pronunced be the saidis lordis of privie counsell, the foirsaid letter or ratificatione of the same act, reference thairof and decreet of the saidis lordis of privie counsell wnder the great seale, the foirsaid other act of the saidis lordis of privie counsell and the foirsaid act made in the saidis buikes of sederunte of sessione of the daites respective abovementionat, in all poynts, heidis, articles, clauss and conditiones thairinconteint, efter the formes and tennoures therof; and declaires this present ratificatione of the same to be alse valied, effectuall and sufficient in all poyntes and respectis as if the samene wer at lenth and word be word insert heerintill, dispensand be thir presentes with the not inserting therof; and ordeanes the first termes dueties respective abovespecified conteyned in the saidis actes respective to be and begine at the said feist and terme of Whitsonday in the said yeer of God jM vjC therttie seavine yeeres, and sua furth yeerlie and termlie thairefter at the saidis tuo termes in the yeer, Whitsonday and Mertimes in winter, be equall portiones perpetuallie in all tymethaireftir, and sicklyke ordeanes lettires, executorielles and executione to be derected, usit and execut heerwpoun, and wpoun the saidis actes respective abovespecified in maner thairin exprest, conforme to the tennour therof.

Our soverane lord and estates of this present parliament, considering that the thretteene act of his majesties laite parliament haldine at Edinburghe in the moneth of Julii 1633 yeeres, intitulat, 'Anent regalities of erectiones', conteynes in the end therof that it wes declaired, decerned and ordeaned that the landis and barrony of Bruchtoun, comprehending the tonnes, landis, burghe in barrony, mylnes and otheres mentionat in the infeftmentes granted be his majestie wnder his hienes great seale to his hienes right traist cusigne and counsellour Robert, erle of Roxburgh, of the dait the [...] day of [...] jM vjC threttie yeires, shall not be comprehendit in the said act, excluding the same all utterlie therefrom to remaine with the said Erle of Roxburghe, his aires and successoures efter forme and tennour of the infeftmentes maid to him and his authoures of the same. And sicklyke that there is ane other act made in the said parliament, being the fourteene act therof, being intitulat 'Anent superiorities of kirkelandis', wherby the same are declaired to apperteene to his majestie and his successoures in maner therinspecified, lykeas be contract past betuixt the said Erle of Roxburgh, with consent of our said soverane lord, for his majesties right and entres to the landis, barrony and otheres thairinspecified. And alse our said soverane lord for himselfe, with consent of his majesties thesaureres, comptrolleres, collectoures and thesaureres of his hienes new augmentationes, principall and deputie, therinnominat, and of the remanent lordis of his hienes exchekker, his majesties commissioneres, and with consent of the said Erle of Roxburghe and Dame Elizabeth Ker, Lady Bruchtoun and them all with ane consent and assent one the one pairt, and the proveist, baillies, ministeres and counsell of the citie of Edinburghe as feoffes intrust and governoures of Heriotes Hospitall, and alse the saidis proveist, baillies and counsell of Edinburghe, for themselfes and thair successoures, representing the body and commontie of the good toune of Edinburgh to ther owne behuife respective one the wther pairt, off the daite at Halyrudhouse and Whythall, the nynteene and ellevine dayes of November and December the yeere of God 1639 yeeres anent the alienatione and dispositione maid to the saidis proveist, baillies and counsell of the said burghe of Edinburghe, for themselves and ther successoures, representing the whole bodie and commontie of the same burghe, heritablie and irredeemablie, off the burghe of regality callit the Cannongait and of sindrie other proper landis, superiorities, priviledges of regalitie and justiciarie and wtheres particularlie mentionat in the said contract, and anent the alienatione and dispositione made to the saidis proveistes, baillies, ministeres and counsell of the said burghe of Edinburghe, feoffes in trust above designed to the use and behove of the foirsaid hospitall, callit Heriotes Hospitall, heritablie and irredeemablie, off all and haill the toune and landis of Bruchtoune and certane wther landis, mylnes, fewfermes, priviledges of regalities and wtheres priviledges, liberties and otheres particularlie mentionat in the said contracte. Our said soverane lord, with consent of the foirnamed persones mentionat in the same contract, declaired that the foirsaid exceptione or declaratione in favoures of the said Erle of Roxburghe subjoynt in the latter pairt of the said therteene act of the foirsaid parliament haldin in Julii 1633 yeeres intitulate, 'Anent regalities of erectiones', wes, is and shall be holdine in all tyme thereftir wnderstuid as insert and repeited in the foirsaid act fourteene intitulate, 'Act anent superiorities of kirke landis', be the quhilke contract also our said soverane lord faithfullie promitted in verbo principis to ratifie and approve the foirsaid contract and appoyntment and infeftmentes appoynted to fallow therwpoun in the nixt parliament to be holdine thereftir within the said kingdome of Scotland, and to dissolve the landis, mylnes, superiorities and otheres conteanit in the said contract disponit in maner foirsaid from the croune, and to make and grant new infeftmentes therof to the saidis proveists, baillies, counsell and commontie for themeselves for ther owne wse, and to the saidis proveist, baillies, ministeres and counsell for the use foirsaid in maner abovedevydit, as in the said contract of the dait foirsaid seene and considered be his majestie and estates of this present parliament at mair lenth is conteint. Therfore, and for implement and fullfilling of his majesties promeise abovewrittin anent the makeing and granting of the ratificatione and dissolutione respective eftirmentionat, our said soverane lord, with advyse and consent of the estates of this present parliament, be thir presentes ratifies and approves the foirsaid contract and appoyntment of the dait abovewrittin, togidder with chartoures, infeftmentes falloweing and exped wpoun the said contract, daited [...], with the precepts and instrumentes of seasing falloweing upon the saidis chartoures in all poyntes, heedes, articles and clauss therinconteaned efter the forme and tennour therof, and declaires this present ratificatione of the same to be ase valied and effectuall in all respectes as if the samene were at lenth and word be word insert heerintill, dispensand be thir presents with the not inserting therof. And sicklyke his majestie, with consent of the estates of this present parliament, dissolves the landis, mylnes, superiorities and otheres mentionat in the said contract and therby disponed in maner foirsaid from his majesties croune and patrimonie therof, to the effect the samene may perteene and perpetuallie belong to the saidis proveiste, baillies, counsell and commontie of the said burghe of Edinburgh for there owne wse, and to the saidis proveist, baillies, ministers and counsell of the said burghe for the use foirsaid in maner above devydit, to be holdin of his majestie and his successoures in maner and for payment of the dueties at lenth set doune in the foirsaid contract conforme to the tennoure of the same contract and of the foirsaidis chartoures and infeftmentes falloweing therwpoun in all poynts. And lykewayes his majestie, with consent of the estates of this present parliament, declaires that the foirsaid exceptione or declaratione conceaved in favors of the said Erle of Roxburghe subjoned to the later pairt of the said therteene act of the foirsaid parliament holdine in Julii jM vjC thertie three yeeres, intitulat 'Anent regalities of erectiones' wes, is and shall be in all tymecoming wnderstuid as insert and repeited in the foirsaid subsequent act of the samene parliament being the fourteene act therof intitulat 'Anent superioritie of kirke landis'.
