Act anente the election of the officers of estate, counselloures and sessionars

Oure soverane lord and the estates of parliament, considering that as there was ane article in the treaty anent the maner of choosing and placeing of officeres of stat, counselloures and sessioneres wherof the ansuer was remitted to be determined by his majestie and this parliament, and his majestie being willing to give this his ancient and native kingdome all satisfactione possible that fit and qualified persones shall ever fill these places, and considering that his majesties residence (because of his great effaires) will be more ordinarie in England then heir, wherby the qualificatione of persones may not at all tymes be so weell knowne to him, therfor his majestie, with advyse and consent of the estates of parliament, declaires for himselffe and his successoures that he will nominat and make choise of such able and qualified persones to fill these places as shall be fittest for his service and may give most contentment to the estates of parliament, which nominatione and choise his majestie will make with the advyse and approbatione of the saides estates of parliament dureing there sitting. And if any of the saidis places shall happine to waike and most be provydit in the intervall betuixt parliamentes, his majestie will choose and nominat officeres of state and counselloures with the advyse and approbatione of the counsell, all that nomber being warned upoun fyftene dayes calling to meit theranent, and most pairt of the whole consenting, and in lykemaner the sessioneris, with the advyse and approbatione of the most pairt of that house; which electiones mad in the intervall shall be allowed or disallowed in the nixt ensuein parliament as the kingis majestie and the parliament shall thinke expedient. And the officeres of state, counsellouris and lordis of sessione so nominat and chosine by his majestie and the parliament or allowed by his majestie and them shall be provided ad vitam vel culpam, and they all shall be lyable to the censure of the kingis majestie and parliament.

Dispensation to the shereffe of Clakmanane

The quhilk day, anent the supplicatione givine in to the parliament be Williame Home of Aittoun and Sir James Baillyie of Lochend and Dame Magdalene Carnagie, lady Lochend, Sir Patrike Hammiltoune, the said William Home and Williame Butter, his tutoures testamentares, desyreing dispensatione and warrand to the shereffe of Clakemannane and his deputes to sit and hold courtes in the actiones intentit or to be intentit at the supplicants instance againes the aires and executores of the umquhill Erle of Stirveling and lord Alexander for the causs contenit in the said supplicatione, as the supplicatione at mair lenth beires; quhilke supplicatione being this day red in audiance of the kingis majestie and estates of parliament, and the desyre thairof considderit be them, his majestie and estates foirsaides grantes dispensatione to the said shereffe of Clakmanane and his deputes to sit and hold courtes and to proceed and minister justice in the actiones respective mentionat in the said supplicatione ather allreddy intentit or to be intentit befor them for payment of the soumes of money and causs respective thairinspecifeit, wnto the finall end and deceisione of the samene actiones, as accordis of the law; for doeing wherof, his majestie and estates of parliament hes dispensit and heirby dispenss in maner foirsaid.

Commissione for heiring of the accomptes of Monro, Cochrane and Lord Sinclare

The quhilk day the kingis majestie and estates of parliament, taking to consideratione the petitiones givine in be Generall Major Monro, for himselfe and the officeres of his regiment, craveing payment to them and the souldieris of the regiment of bygone arreirages befor they disband, and heirwith also considering that the Lord Sinclare, his regiment, and Collonell Cochrane, his regiment, are in the like conditione with Monro, his regiment foirsaid anent the payment of ther bygone arreirages befor they be disbandit, his majestie, with the advyce of the estates of parliament, hes for the bettir facilitating and furthering of the payment of the saidis regimentes, officeris and souldieris, that therwpoun they may the more ordourlie disband, givine and granted and heirby gives and grantes full power and commissione to Archbald, lord Douglas, Johne, lord Maitland, James, lord Carnagie, David, lord Elcho, Sir Johne Hammiltoune of Barganie, Johne Crawfuird of Killbirnie, Mungo Campbell of Laweres and Sir Patrike Murrey of Elibanke, in absence of Sir Williame Mure of Rowallane, Edward Edgar and Johne Byneing, merchandis burgess of Edinburgh, Maister Alexander Weddirburne, clerke of Dundie, and Hew Kennedy, burges of Air, or to any seavine of the haill nomber abovewrittin, to heir, consider, sit and conclud the haill comptes, asweell tuo pairt as third pairt of the samene accomptes, of the three regimentes abovementionat, and to sit and meit therwpon for that effect dureing the tyme of the sitting of this present parliament, or quhill the samene accomptes be fitted and concludit, and eftir the heiring, fiting and concluding of the samene haill accomptes, asweell tuo pairt as third pairt thairof, of the foirsaidis three regimentes abovewrittin, ordeanes the commissioneris respective abovenamed, or any seavine of the haill nomber foirsaid, to report the ending and conclusione of the saidis comptes and what they find and conclud therintill to the parliament to be considerit by them, that accordinglie ordour may be takine for payment of the saidis officeris and souldiers of the foirsaidis three regimentes as the parliament, eftir consideratione of the saidis auditoures abovenamed ther report foirsaid, shall find expedient. And in the meanetyme, for the more summare expeditione and outredding of the saidis comptes, ordeanes the saidis commissioneres respective abovenamed to meit at all such convenient tymes and dyets dureing the siting of the said parliament as may best further and advance the fitting and ending of the three regiment comptes respective foirsaidis.
