Ordinance of parliament in favoures of the Lady Ridhous and hir sister

The quhilke day the suplicatione givine in to the parliament be Lady Ridhous and hir sister, craveing command to the commisseris of Edinburghe to sit and minister justice in ane proces persewed at ther instances agais Sir James McGill of Cranstounriddell, being red and considerit be the saidis estates, they grant the desyre therof and ordeanes the commisseris of Edinburghe to sit, proceid and minister justice in the foirsaid process at the instance of the saidis supplicantis againes the said Sir James McGill as accordis of the law.

The quhilk day the estates of parliament, haveing red and considerit the supplicatione givine in to them be the Laird of Lochtour craveing delyverie of his signatour, and that the compositione therof, which is in Maister Patrike Brounes handis, may be receeved from him be the thesaurer deput, the saidis estates, eftir report made be the president of the committie for the billis anent the foirsaid supplicatione, ordeanes the foirsaid thesaurer deput to receive the compositione of the signatour of Lochtoures escheit fra Maister Patrike Broun and to grant the reseat therof, and to delyver the foirsaid signator to the supplicant.

Act in favoures of Sir Jedion Baillie of Lochend anent his waird and mariage

Oure soverane lord and estates of this present parliament, considering that umquhill Sir Jedeon Baillie of Lochend, knight barronet, being wpon the publick service of the cuntrie, was deidlie woundit and hurt at that lamentable accident which fell out at Dunglas upon the 29 of August 1640, of the quhilkis woundis he within few dayes thereftir deceist, and withall considering that by ane express act of that sessioun of this present parliament haldin the moneth of Junii 1640 and by diverse preceiding actes of parliament and ancient lawes made in the tymes of his majesties umquhill darrest father and otheris his majesties royall progenitoures of woorthie memorie, it is statut and ordeaned that whosoevir beis slaine or dies or getis deathis woundis in the armies and hostes raisit for defence of the cuntrey and of the saidis woundis shall happine thereftir to deceis, that the aires and successoures of the persones sua deceisand shall have the benefiet of the waird, mairiage and releiffe and nonentres freilie disponit to them, and shall entir freilie to ther landis halding few without payment of the dowble of the few duetie or any other compositione for ther said entrie, quhilkis actes respective are alsweell extendit to vassellis holding of our said soverane lord as of any other superiour whatsoevir within the kingdome, spirituall or temporall. And his majestie and estates of parliament, being willing that Sir James Baillie of Lochend, knight barronet, eldest laufull sone and air to the said umquhhill Sir Jedione Baillie, and failyieing of him the nixt air or aires and successoures of the said umquhill Sir Jedione Baillie, bruike and enjoy the benefiet of the foirsaids actis of parliament, seeng to the certane knowledge of the saidis estates the said umquhill Sir Gedione died in the publict service as said is, therfor our said soverane lord, with the advyse and consent of the estates of this present parliament, hes statute and ordenit, and be the tennour heirof statutes and ordeanes, that the said Sir James Baillie, and faiyieing of him be deceis wnentried the nixt air or aires and successouris of the said umquhill Sir Gedione Baillie, shall have, bruike and enjoy the haill benefiet, proffiet and commoditie of the waird, releiffe, nonentres and mariage falloweing and vacand be and throw the deceis of the said umquhill Sir Gedione ay and whill the laufall entrie of the righteous air or aires therto; and sicklyke that the said Sir James Baillie, and failyieing of him as said is the nixt air or aires and successoures foirsaidis of the said Sir Gedione, shall have frie entrie be ther superiouris to all landis, teyndis and otheris rightes whatsomevir quhilkis pertenit to the said umquhill Sir Gedione or wherin he died infeft, and that frielie, without ony payment of the entrie, doubling of the fewe duetie or other compositione for the same; and ordeanes this present act to be extendit alsweell to all landis and wtheris haldine be the said umquhill Sir Gedione of his majestie or of his hienes darrest sone, prince and stwart of Scotland, as of any other superiour or overlord, spirituall or temporall whatsoevir, within this kingdome. Lykeas his majestie and estates of parliament doe heirby requyre and command his majesties thesaurer principall and deput and keeperis of his majesties sealles and registeris and all superiouris quhatsomevir to whom the said Sir Gedione was vassell and of whom he held ony landis, teyndis or wtheris that they and everie one of them for ther owne pairtes respective doe forthwith entir and receive the said Sir James Bailyie, and failyieing of him wnentreit the nixt aire or aires and successouris of the said umquhill Sir Gedione, to all landis, heritages, teyndis and wtheris quhilks perteaned to him the said tyme of his deceis and that the same be past and exped frielie, without payment of ony compositione, doubling of the few duetie or wther entrie quhatsomevir, notwithstanding of the minoritie and les aige of the saidis aires respective, wheranent his majestie and estates foirsaidis heirby dispenss, and if neid beis to pas and exped the gifte of the waird, mariag, releife and nonentres falling be the deceis of the said umquhill Sir Gedione, frie of any compositioun whatsomevir, and that in favoures of Sir James Baillie of Lochend, knycht barronet, sone and air of the said umquhill Sir Gedione, and failyieing of him be deceis wnmaried and wnentered of the nixt air or aires foirsaidis, or in favoures of ony otheris to ther use and behove, and if neid beis, our said soverane lord and estates of parliament ordeanes lettiris of horneing to be directed upoun the simple chairge of ten dayes, chairgeing all the superiouris of whom the said umquhill Sir Gidione held any landis, teyndis or wtheris rightis immediatlie to entir and resave the said Sir James Baillie, his sone, and failyieing of him be deceis wnenterit the nixt air or aires of the said Sir Gideon, and that frielie conforme to the tennour of this abovewrittine act in all poyntes. And sicklyke his majestie and estates foirsaidis ratifies and approves the gifte granted be the king for himselfe and as administrator to the prince, his darrest sone, to Sir Patrike Hammiltoun of Litle Prestone of the waird, nonentres, releiffie and mariage of the said Sir James Baillie, and failyieing of him be deceis wnmaried the mariage of ony other air or aires maille or femall, daited the 16 of November 1640, togidder with the assignatione therof maide or to be mad to the said Sir James Baillie in all and sindrie heidis and conditiones of the said gifte and assignatioune, and holdis this generall ratificatione thairof als sufficient as if the said gifte and assignatione war word be word insert heirintill, quhairanent our soverane lord and estates of parliament dispenss.

It being represented to the estates of parliament that Collonell Lindesay is seeke for the present and therby withholdene from the dischairge of his place of constable of the castle of Edinburghe and fra the attendance incombent therto, the estates of parliament for supplie heirof permittis and gives libertie to him to substitut any in his place whom he will trust and for whome he will be ansuerable.

The quhilke day the supplicatioun givine in to the parliament be Sir Williame Baillie of Lameingtoun, craving suspensione of the chairge of horneing directed againes him for his tenth and tuenteith penny be the collectour of the presbetrie of Lanarke, being red in audience of the parliament, the estates of parliament dischairges the executione of the chairge of horneing, and in the meane tyme recommendis to the auditouris to doe diligence for ending the accomptis.
