Procedure: ordinance regarding the army
Ordinance anente the armie

The instructiones from the estates of parliament to the commissionaris at Londone, concerneing the commissionaris lettir written to the generall for disbanding the armie and delay of payment of the 80,000 lib. sterling of brotherlie assistance, togidder with ane lettir from the parliament to the commissioneris and ane wther lettir from the parliament to the lord generall,

Being all these red in presence of the estates of parliament, the saidis estates approves the samene (anent the payment of the souldieris in the castle, ordeanes and commandis Stephine Boyd, merchand burges of Edinburghe and collectour of the castle rentis thairof, to pay the souldieris of the castle out of the first and reddiest of the castle rentis), and appoyntes the saidis lettiris and instructiones to be subscryved be the president of the parliament, quhilke was accordinglie done, and the estates ordeanes the Erle of Dumfermling to carie the samene as ane verie fiting above all exceptione.

Commission for examination of witness at London upon the lybell againest the incendaries

The quhilke day the estates of parliament, now conveened by his majesties speciall authoritie, taking to there consideratione the hazard of the perishing of the probatione necessar to be deduceit for proveing of the sommondis, or any member or article therof depending befor them againest these incendiaries citit to the parliament, and speciallie againes Johne, erle of Traquair, Sir Robert Spotswood, Sir Johne Hay, clerke of register, Doctor Walter Ballcanquell and Maister Johne Maxwell, sometyme pretendit beshope of Ros, hes for preventing of that hazard givine and granted and be thir presentes gives and grantes full power and commissione to Johne, erle of Rothes, Johne, lord Loudoune, Sir Patrike Hepburne of Wauchtoun, Sir Williame Douglas of Cavers, Johne Smyth, baillie of Edinburghe, and Hew Kennedy, burges of Air (or ony thrie of them, the Erle of Rothes or the Lord Lowdoun being allwayes one of these thrie), with power to them to choose ane clerke to examinat, take and ressave the oathes and depositionis of Williame, erle of Stirvling.

And ilke ane of them severallie wpoun sicke poyntes, heidis, articles and memberis respective of the said sommondis, and wpoun the severall factis and crymes therinspecifiit, and wpon all interrogatouris which they shall receive wnder the handis of the kingis advocat, procuratouris of the estat, or any of them, in sua far as they know and shall be speired at them theranent, and wpon every particular interrogatour resulting therwpoun for cleiring of the treuth and veritie therof, and for this effect to cause them be solemnelie suorne and examinat wpoun ther great oaths anent there knowledge theranent to examine betuixt the [...] day of [...] and the [...] day of [...] nixtocome. And farder, because the estates are informed and wnderstandis that thir persones underwrittine, viz: my lord privie seale of England, my Lord Pembroke, my Lord Whartoun, my Lord Mandaveill, the Erle of Dover, the Beshope of Canterburrie, [...] are also necessar witness to be usit in the said mater and will not be lyable to compeir befor the saidis commissioneris but at there pleasoures, not being natives of this kingdome, therfor the saidis estates gives full pouer and commission to the sex commissionaris abonenamed (or any thrie of them, the Erle of Rothes or the Lord Loudoune being one of thrie as said is) to intreat the parliament of England, or any subalterne judicatorie of that kingdome, to grant and direct preceptis and warrandis for causing and compelling the persones abovenameit, or any of them, to compeir befor the saidis commissionars, or any thrie of them as said is, to be examinat and to depone wpon ther great oath anent the treuth and veritie of the premiss or any poynt, member, heid or article therof, and wpon ther knowledge theranent, or wtherwayes to deale with the parliament of England, or any subalterne judicatorie, that they would give order for examinating the saidis witness (who are not natives) in the premiss. And ordeanes the saidis commissioneris (or any thrie of them, Rothes or Loudoune being one as said is) to cause the saidis persones to be deiplie suorne wpoun ther great oathes to depon the treuth anent the premiss or any poynt, article or member therof, and wpon the interrogatouris to be proponit and speired at them for cleering of the samene. And also ordeanes the saidis commissionaris, or ony thrie of them as said is, to cause the depositiones of the whole persones to be received as said is, to be authenticly writtine, subscryved and closed be the receiveris therof, and thereftir reported with all convenient diligence to the parliament of Scotland the [...] day of [...] nixtocome, with continouatione of dayes, that thereftir they may proceed and minister justice in the forsaid process aganes the incendaries abovenamed as they in equity and justice shall find the samene to deserve.

Order: to the keeper of Edinburgh Castle
Order of parliament to the keeper of the castle of Edinburgh anent his cariage concerneing these in the castle

The estates of parliament, haveing considerit the petitione presented be Collonell Lindesay craveing directione for his cariage at this tyme when the Erle of Montroise, his freendis and advocatis are to meit with him, they ordeane the said Collonell Lindesay to permit no more of the Erle of Montrose, his freendis or advocatis, to come into the castle at one tyme then he may command and be maister of with his owne garisone, wpon his owne perrell, and findis no necessity that the collonell be present at the consultationis of the advocatis with the Erle of Montroise.

Procedure: ordinance regarding Colonel Lindsay
Ordinance anent Collonell Lindsay his pay for keeping the castle of Edinburgh

The estates of parliament modifies the soume of 200 merkis Scotis money monethlie of pay to the said Collonell Lindesay for keeping of the castle of Edinburgh, by and attoure the soume payed to him be the toune of Edinburgh, and ordeanes the samene pay to be givine from the tyme of his entrie to the castle be order from the committie of estats, whose commissione granted be them to Collonell Lindesay the estates of parliament ratifies and approves ab initio and heirby renewes the samene comissione to him; and findis no necessity of payment to ane minister in the castle, seing the presbetrie of Edinburghe have appoynted some of ther nomber to supplie that place in the castle. And alse the estates ratifies and approves the pouer and warrand givine be the committie of estates to Stephine Boyd for wplifting the castle rentis of Edinburgh, and appoyntes and ordeanes the said Stevine Boyd to pay the said Collonell Lindesay and his souldieris and porteris in the castle out of the said castle rentis.

Order: regarding the interrogatories produced by the procurators of the estates
Ordere anent the interrogatoris produced be the procuratoris for the estates against the Erle of Montroise

It being voited in parliament be the estates therof whether or not the Erle of Montroise should be ordeanit to ansuer to these interrogatoures produceit againes him be the procuratoris of estate, in respect the samene interrogatouris ar exhibit eftir his citatione, the saidis estates findis that he aught to give ansuer therto.
