Procedure: regarding Master John Stewart's trial

The Lord Elphingstone desyred he might be liberat of being assessor to the justice in Maister Johne Stewart his criminall process in respect he is within degrees, defending to the Erle of Argyle, persuer of the proces.

The estates adjoyne these four formarlie nominat to the justice or any three of them, which nomber they appoynt to be a quorum, and ordeanes the same to be subjoyned to the formar ordinance and delyverance.

Procedure: Lord Elphinstone commanded to act as an assizer in the trial of Master John Stewart

It being represented by the thrie assessouris adjoyned to the justice for Maister Johne Stewartis proces that the Lord Elphingstoune was the fourt assessour nominat be the parliament is wnwilling and refuiss to joyne with theme in respect foirsaid, the estates of parliament commandis the said Lord Elphingstone to accept the said office and to proceid in doeing his duetie therin to the end of the proces.

Anent the supplicatione presented be Angus Fergussone craveing ane proces persuit aganes him befor the Erle of Athole and his baillies to be advocat to the justice generall, the estates of parliament ordeanes the Erle of Athole to be wairned be ane maisser to heir the desyre of the supplicatione granted and in the meanetyme dischairges the said Erle of Athole and his deputis.
