Anent the supplicatioune gevin in be the noblemen and gentlemen of the north, craving that the Marquis of Huntlie should be declaired answerable for Jhone Dowgar and his complices, the supplicantis and the marquis being present with thair procurators, the marquis askit instrumentis that the supplicantis produced certaine articles for cleiring the supplicatioune, quhilk he desyred may ad longum be insert in the instrumentis and protested for remeid of law. And Sir Lues Stewart for him askit instrumentis that the names of the particular persones complainers ar not condiscendit upon, bot that it is acknowledgeit in the supplicatione that the persones greved ar not present.

The Marquis of Huntlie alledgit the kingis advocat cannot sitt in this caus betuix him and the noblemen and gentlemen of the north becaus he hes consulted with the pairteis in this bussines. 2. He hes consulted with the Laird of Frendraucht in this bussines or upon ane supplicatione of the lyke nature.

The Marquis of Huntlie allegit the Laird of Auldbar cannot sitt in the articles to voite in this caus, becaus he is tutour to the Erle of Erroll quha hes subscryved the complaint and is ane pairtie, and is brother to the Erle of Kinghorne, quha is also tutour to the Erle of Erroll, and hes subscryved the supplicatione, and is ane pairtie interest.

The advocate denyed the alledgeance proponed against him.

The lordis commissioneris general and articles finds that quhair it is libellit that Jhone du Gar and his two brother sones haif thir thrie yeirs bygane committed greate heirshipes, etc., and that during the tyme of the saidis oppressiounes they had and as yit hes thair actuall residence upon the Marquis of Huntlies lands, quhair they wer intertained, supplied and assisted by his baillies, chalmerlanes and tenentis, finds that part of the supplicatione relevant to be provin by witneses, to be presented as ane article to the parliament for inferring that desyre of the supplicatione, for exhibitione of the said Jhone du Gar and his brother sones befoir the justice, and declairs they will haif particular consideratione of the witneses. And ordaines the supplicants to condiscend upon the lands quhair the said Jhone du Gar and his brother sones had thair residence.

Maistir James Baird condiscendit that the lands quhair the said Jhone du Gar and his brother sones had thair residence the tymes libellit was Cabrach, Glenrinnies, Auchindowne, Strabogie, Blakwater, Culblaine.

The twa supplicationes by the Erle of Erroll and minister of Turreff, craving that the depredationes committed upon thame may be omitted out of the act of pacificatione and the guds restored becaus the samyn wer takin away under trust, albeit efter the 13 Aprill, continewed till the act of pacificatione be drawin up and treated of.

Anent the petitioune presented by the Lady Luss, craving intertainement for hir children from the Laird of Balvie, intromettor with the rentis and estate of Luss, the lordis commissioneris general and articles nominattis the Erles of Lauderdaill and Southesk to peruse the defenses and answer gevin in be the parties, befoir quhom ordaines the Laird of Balvie to appeir and to mak knowin the rent of the land and the burthenis which reallie affect the said estate and maner of the purchassing of his rightis, that they may report the same to the articles or otherwayis declairis that, gif Balvie failyie in obedience of the premises, they will hold the rent of the land libellit as confest to extend to 12M lib., and inrespect of the singular merites of this caus, deserving ane particular consideratioune, will modifie ane competent sowme for the intertainement, conforme to the desyre of the supplicatione.
