Forsamekle as his sacred majestie, be warrand directed to me, his majesties heighe commissioner, off dait at Quhythall, the aucht of November instant, beiring his majesties full resolution to secure and setle the estate of religion and all church bussines, according as his majestie was gratiouslie pleased to promeise and was, and is, most willing to performe, but because diverse things hes occurrit in this present parliament which as his majestie conceaves does mainlie tuitch his majesties civill authoritie and government, and for that effect his majestie finds it necessarie that this present parliament be prorogat to ane certane day that in the meane tyme his majestie may be sufficientlie informed and cleired thairanent. And thairfoir, by the warrand foirsaid, hes willed and ordeaned that this present parliament be prorogat to the second day of Junii nixtocome, and because in the commissione granted be his majestie wnder the quarter seall of the dait the tuentie day of August lastbypast to his majesties commissioneris thairinmentionat for fenceing of the parliament, thair is power granted to them to prorogat the samene as ofte and so oft as shall be thought fit be his majestie for his majesties service and good of the kingdome, the samene being done by advyse and directione of his majesties heighe commissioner, thairfor I, Johne, erle of Traquair, lord Lyntoun and Caverstoune, his majesties heighe commissionar, haveing his majesties speciall warrand directit to me as said is, willis and ordeanes that the commissioners of parliament mentionat in the said commissione wnder the quarter seall, or any fyve or thrie of theme, with the memberis of parliament requisit, passe to the parliament house this fourteine day of November instant betuixt ellevine and tuelffe houris in the foirnoone, and thair, eftir the reiding of the said commissione and of this my warrand, continow and prorogate this present parliament with all articles, petitionis and otheris whatsomever allreddie givine in, treated and past thairin or to be givine in, treated or moved thairintill heirefter, unto the second day of Junii nixtocome, with continowatione of dayes; and ordeanes all the estates, commissionaris, all his majesties leiges, to attend the said day thairwpoun, to the effect his majestie and his estatis may proceid in the publict effaires of kirke and kingdom and wtheris parliamentarie bussiness according to the order and custom observeit in the lyke caiss, for the whilke thir presentes, with the said commission wnder the quarter seall, shall be ane sufficient warrand; and ordeans thir presentis to be insert in the bookis of parliament. Subscryveit at Halyrudhouse, the fourteine of November. Sic subscribitur: Traquair, commissioner, as the samene sua subscryveit in the selfe beires, quhilke was publictlie red be Maister Alexander Gibsone, clerke, togidder with the commissione wnder the quarter seall, quhairof the tennour falloweth:
Carolus Dei gratia Magne Britanniae, Franciae et Hiberniae rex fideique defensor, omnibus probis hominibus suis ad quos presentes litere pervenerint. Sciatis nos, considerantes supremam curiam nostri parliamenti in vigesimam sextam diem mensis Augusti instantis continuam fuisse eandemque dicto die solemni forma affirmandam esse et tenendam vell de tempore in tempus prout necessitas nostri servitii postulabit prorogandam, idque warranto et mandato supremi nostri commissionarii per nos pro sacro sancta nostra persona in dicto parliamento representanda constituti, idcirco fecisse, constituisse et ordinasse, tenoreque presentium facere, constituere et ordinare predilectos nostros consanguineos et consiliarios Robertum comitem de Roxburghe etc., nostri secreti sigilli custodem, Joannem comitem de Pearth, Joannem comitem de Lauderdaill, Davidem comitem de Southeske, Alexandrum dominum Elphingstone, Archibaldum dominum Naper et dilectos nostros familiares consiliarios dominos Thomam Hope de Craighall nostrum advocatum, Joannem Hammiltoun de Orbestone nostre justiciarie clericum, Jacobum Carmichaell de eodem, nostrum thesaurarium deputatum et Archibaldum Stewart de Blakehall, milites, vell quoscunque eorum quinque aut tres, nostros commissionarios ad effectum subscriptum, cum potestate iis infra civitatem nostram de Edinburghe dicto vigesimo sexto die mensis Augusti instantis conveniendi et ibidem dictam supremam curiam parliamenti secundum solemnitates in talibus casibus usitatas assigendi, affirmandi et tenendi et casu absentie quorumcunque necessariorum vell solitorum membrorum ejusdem, que parliamentis assigendis adesse solebant alios in eorum locum creandi et substituendi. Et immediate postea dictum parliamentum in vigesimum sextum diem mensis Augusti instantis continuandi et tunc vell sepius toties quoties nostrum servitium postulabit idem continuandi vell esse et fore currens declarandi idque mandato et warranto supremi nostri commissionarii nostram sacrosanctam personam representantis, ac toties quoties sibi ipsi visum fuerit. Datum sub testimonio nostri magni sigilli apud Aulam nostram de Quhythall vicesimo die mensis Augusti 1639 et anno regni nostri decimo quinto, per signaturam nostram supremi domini nostri regis suprascriptam.
Quhairupon Sir Thomas Hope, his majesties advocat, askit instrumentis, and desyrit the said Maister Alexander Gibsone actuallie to prorogate the parliament unto the said second day of Junii conforme to the foirsaid warrand; quhairwnto the said Maister Alexander Gibsone ansuert that he had allreddie red the said warrand conteineing the said prorogatione and was reddie to reid the same alse ofte as he should be commandit, but could no otherwayes prorogat the parliament.
And the Erle of Rothes, in name of the estatis, requyrit the said Maister Alexander that he should doe nothing bot as he would be ansuerable to the parliament upon paine of his lyfe. Than the said Sir Thomas Hope desyrit Maister Williame Scot that he would prorogate the parliament, quhairwnto he ansuerit that in the clerke of register, his absence from parliament, it was incumbent to the elder present clerke to supplie the place and dischairg whatsomevir is dew to be done be the clerke of register if he war present, so that now it was not his place, Maister Alexander Gibsone, the elder clerke, being present.
