Act in favour of Maister Williame Cwnighame of Brooniehill

Oure soverane lord, remembring the good, trew and thankfull service maid and done to his majestie and his most noble progenitors be Maister William Cwnighame of Brownehill and his predicessors, with advyse and consent of the thrie estates of this present parliament, hes ratifiet, allowit, approvine and confirmit and, be the tennor heirof, with consent forsaid, ratifies, allowes, approves and confirmes the chartor and infeftment maid, givin and grantit be Maister Walter Quhytefurd, minister of Failfurd, to the said Maister Williame Cwnighame of Brownhill, his airs and assignais quhatsumever heretablie, of all and sundrie the lands of Brownehill, Byrehill, Spittlesyd, Bourtrie, Mailling and of the uthers lands, teinds, office of bailliarie and uthers exprest and sett downe in the said chartor, quhilk chartor is of the dait at Edinburgh, the nynteine day of December, the yeir of God jM vjC tuentie aucht yeirs, with the precept of sasing thairincontenit and instrument of seasing following thairupon, and with all uthers chartors, infeftments, precepts, instruments of seasing, confirmationes, new giftes and uthers richtes, titles and secuirities quhatsumever maid and grantit to the said Maister Williame Cwnighame of Brownhill, or to any of his predicessors or authors, of and concerning the lands and uthers contenit in the said chartor, with the pertinents or any pairt thairof, of quhatsumever dait or daits, tennor or contents the samyne be of, in all and sundrie heads, articles, clauses, conditiones and circumstances thairof quhatsumever, willing and declaring this present generall ratificatioun to be als valeid, effectuall and sufficient to the said Maister Williame Cwnighame of Brownhill, his airs and assignais, for thair securitie of the lands and uthers contenit in the said chartor, as if the forsaidis chartors, infeftments, precepts, instruments of sasing, confirmationes, new giftes and uthers wreatts, speciall and generall, forsaidis and everie ane of thame, wer at lenth heirin insert and heirby ratifiet in speciall; quhairanent his majestie, for himselff and his hienes successors, with consent forsaid, hes dispensit and, be thir presents, dispenses for ever.

Oure soverane lord, with advyse of the thrie estates of this present parliament, hes ratifiet and approvine and, be thir presents, ratifies and approves the chartor grantit be his majestie, wnder his hienes great seale, to Maistir James Raith, advocat, and Eliza Fouller, his spous, and to the langest leivar of thame tua in conjunctfie, and to thair airs and assignais specifiet thairine, of all and sundrie the towne and lands of Edmonstoun, callit the Maynes of Edmonstoun, with maner place, mansioun houses, biggings, yeards, orcheards, medowes, dowcatt, cwninghair and all thair pertinents; and als of all and haill the lands of Cauldcoattes, with houses, biggings, yeards, toftes, croftes, pairts, pendicles and all thair pertinents, lyand within the regalitie of Mussleburgh and shirefdome of Edinburgh as principall, and of all and haill the thride pairt of the lands of Nuddrie Marschell, with the thride pairt of the mylne thairof, and that in speciall warrandice of the saidis lands of Cauldcoattes; and siclyk of all and haill the ile or buriall place situat within the kirk of Natoune within the parochine quhairof the saidis lands of Edmonstoun lyes, with the seat and dask within the said ile, biggit be umquhile Andro Edmonstoun of that Ilk and umquhile Sir Johne Edmonstoun, his sone, authors to the said Maister James Raith and his spous, of the dait the fyfteine day of July, the yeir of God jM vjC threttie yeirs, in all and sundrie heads, clauses, articles and conditiones contenit thairintill efter the forme and tennor thairof. And his majestie, with consent forsaid, wills, grants, decernes and declairs that the said chartor and infeftment sall be gude, valeid and sufficient richt to the said Maister James Raith, his said spous, thair airs and assignais for bruiking and joysing of the saidis lands and uthers abonewrittine in all tyme coming.

Oure soverane lord and estates of this present parliament, considering that umquhile Williame Maxwell, appearand of Tynwald, in ane justice court haldine within the towne of Drumfreis be umquhile George, earle of Dumbar, upon the tuentie fyft day of July, jM vjC nyne yeirs, was convict and foirfaultit for the crymes of lesimajestie committed be him and particularlie mentionat and contenit in the proces, sentence and doome of foirfaultrie led and deduicit againes him thairanent; and that his hienes umquhile darrest father, King James the Saxt, of worthie memorie, upon certane knawledge of the good gesture, fidelitie and affectione givin be umquhile Edward Maxwell, sone lawfull to the said umquhile Williame, towards his said umquhile hienes and peace of this his kingdome, of his grace and mercie, not being willing that the posteritie of the said umquhile Williame for the saidis offences sould be farder punischit, thairfor, his hienes said umquhile darrest father, of his hienes authoritie, regall favour, clemencie and kinglie benevolence, restorit and rehabilitat the said umquhile Edward Maxwell, his airs and successors and all uthers, the airs and posteritie of the said umquhile Williame, his father, againes the said foirfaultrie and maid and declarit thame worthie, able and capable to conqueis, acquire, posses, joyse and use benefices, teinds with quhatsumever lands, heretages, steidings, possessiones, honors, dignities and offices within the said kingdome of Scotland siclyk and als frilie as any uther faithfull and obedient subject, and as gif the said proces and doome of foirfaltor had never beine led and deduicit againes the said umquhile Williame; and for the said umquhile Edward and posteritie of the said umquhile Williame, thair better secuiritie, his hienes said umquhile father promitted in verbo regis to ratifie and approve to the said umquhile Edward or posteritie of the said umquhile Williame the said letter of grace, favour and rehabilitatione, as in the samyne wnder the great seale, of the dait the tuentie nynt day of Apryll, jM vjC nynteine yeirs, at mair lenth is contenit. And siclyk our said soverane lord, wnderstanding perfytlie that the crymes for the quhilk the said umquhile Williame Maxwell was convict and foirfault was not against his majesties said umquhile father, his sacred persone nor estate of the kingdome, bot onlie committed upon ane certane grudge againes certane persones with quhome he was standing in enmitie, and that the samyne being well knawine to his hienes said umquhile darrest father, he did not onlie rehabilitat the airs and successors of the said umquhile Williame, bot also did promitt to doe the samyne in this nixt parliament; and thairupon his majestie, being willing to follow that course intendit be his hienes said umquhile darrest father and to give the successors of the said umquhile Williame occasione to continew in thair dewtifull service in tyme coming, thairfor his majestie and estates forsaidis of this present parliament ratifies and approves the said letter of grace, favour, rehabilitatione, restitutione and restauratione thairin contenit in all and sundrie the heads, pointes, clauses, articles and conditiones thairof, and efter the forme and tennor thairof in all pointes, sua that it is or sall be leasome and lawfull to the airs and successors quhatsumever of the said umquhile Edward and posteritie of the said umquhile Williame quhatsumever peaciblie to bruik, joyse and posses all and quhatsumever lands, heretages, places, offices and dignities quhatsumever falling and perteining, and quhilks anywayes may fall and perteine to thame, enter thairto, sell, use and dispone thairupon at thair pleasure siclyk, als frilie and in all respects and conditiones as if the forsaid sentence, proces and doome of foirfaultrie had never beine led nor pronuncit, nor the crymes thairinspecifiet had never beine committit, or as if the said proces, sentence and doome of foirfaultrie and causes quhatsumever thairine contenit wer lauchfullie reduicit and takine away, notwithstanding of quhatsumever uther gift, presentatione and richt, if any be grantit in favours of any uther persone or persones upon the foirfaltor of the said umquhile Williame Maxwell of quhatsumever his lands or uthers perteining to him, or quhairwnto he was to succeid, and of quhatsumever actes of parliament, secreit counsall, uther actes, statuites or constitutiones, if any be, quhilks may be extendit in the contrair. And farder, for the airs and successors of the said umquhile Williame Maxwell, thair better secuiritie, his majestie and estates forsaidis of this present parliament rehabilitates, restores and reintegrates and als accepts, receaves and repones the saidis airs and successors of the said umquhile Williame Maxwell of new in and to his hienes mercie, favour and grace againes the said proces, sentence and doome of foirfaltour, haill occasiones and crymes contenit thairintill, and in and to all and sundrie lands, baronies, annuelrents, takes, steidings, rowmes, possessiones, guids, geir and uthers quhatsumever fra the quhilks they war debarrit or micht have beine debarrit be the said foirfaltour of the said umquhile Williame Maxwell; and wills and grants that they, thair airs and assignais may enter thairto, persew, thairfor bruik, joyse, use and dispone thairupon at thair pleasure, and makes and declairs the airs of the said umquhile Edward Maxwell and the posteritie of the said umquhile Williame able, worthie and capable to receave, bruik, joyse and use honors, dignities and offices in quhatsumever judgments and outwith the samyne in all tyme coming, siclyk and als frilie in all respects and conditiones as if the forsaid sentence, proces and doome of foirfaltour had never beine led nor pronuncit againes him nor the crymes thairin specifiet had never beine committit be him, notwithstanding quhatsumever actes of parliament, secreit counsall and uthers actes, statuites and constitutiones, if any be maid, quhilks may be extendit or interpretat in the contrair thairof; anent the quhilks, his majestie, for his hienes and his successors, with consent abonewrittine, dispenses for ever, and for that effect declairs the said proces and sentence and doome of foirfaltour to be null and of nane availl, force nor effect siclyk and as if the samyne had never beine led and deduicit. With power to the airs and successors of the said umquhile Williame and of the said umquhile Edward, his sone, to rais breives, proclame the samyne and thairupon obteine thameselffes servit and retourit airs to thair predicessors and infeft in thair lands and uthers haldine of the immediat lawfull superiors siclyk and in the same maner and als frilie in all respects as if the said umquhile Williame Maxwell had never beine foirfault, and as if thair had never beine gift, presentatione, infeftment or uther richt grantit upon his said forfaltour.

Oure soverane lord, with advyse and consent of the haill estates of parliament presentlie convenit, hes ratifiet, confirmit and approvine and, be the tennor heirof, for his majestie and his successors, ratifies, confirmes and approves ane chartor and infeftment wnder the great seale, of the dait at Edinburgh, the tuentie day of Februar, jM vjC and auchteine yeirs, maid, givin and grantit be umquhile King James, his majesties father, of eternall memorie, to umquhile Johne Erskeine of Balhagardie, his airs male and assignais quhatsumever, of all and haill the lands and baronie of Balhagardie, comprehending thairine the particular townes, lands, mylnes, fischings, chaplanries, advocatione, donatione, richt of patronage, with the teindscheaves of all and haill the lands of Balhagardie, Pitscurie, thrie pleuches of land of Drumdurno, with the haill croftes lyand at the chappell of Garioche, and of the lands of Dorlethine, Pittodrie, the croft of the mylne of Inverramsay, and of the land of Knokinglas, with thair outsetts and insetts specifiet in the said chartor, with the precept of sasing following thairupon and seasing of the same, togider with the service and retour, precept of sasing following thairupon and instrument of sasing of the foirnamit lands, teinds and uthers abonewrittine, grantit to his majesties lovitt Thomas Erskeine, now of Balhagardie, as eldest lawfull sone and air to the said umquhile Johne Erskeine, his father; togider also with all uther chartors, infeftments, richts, titles and secuirities quhatsumever maid and grantit be our said soverane lord or his hienes said umquhile father or any of his majesties predicessors or be any uther persone or persones to and in favours of the said Thomas Erskeine, now of Balhagardie, or of the said Johne Erskeine of Balhagardie, his father, or of his umquhile guidsir, gransir, foirgrandsir on any uthers his predicessors of the saidis lands and baronie of Balhagardie, teinds and uthers mentionat in the said chartor, in the haill heads, articles, clauses, conditiones and circumstances thairin contenit, admitting this present ratificatione to be als valeid and sufficient in all respects as if the forsaid chartor and infeftment and uthers richts and secuirities forsaidis wer at lenth ingrossit heirine; quhairanent his majestie, with consent of the saidis thrie estates of parliament, be thir presents, dispenses for ever, and ordaines ane act of parliament to be extendit heirupon with all clauses neidfull, and thir presents to be ane sufficient warrand thairanent and for inserting thairof in the register and bookes of parliament.

Act in favour of the kirk of Pittinweyme

Oure soverane lord and estates of this present parliament have ratifiet and approvine and, be the tennor of this present act, ratifies and approves the band and obligatioun maid and grantit be umquhile Alexander, lord Fentoun to the baillies and counsall of the burgh of Pittinweyme, quhairby he band and obleist him, his airs and successors to perfyt, subscryve and deliver to thame or to the minister at the kirk thairof ane sufficient secuiritie in sick ample forme as micht stand be law, be the quhilk he sould provyde the said minister serving the cure at the said kirk of Pittinweyme and his successors to ane yeirlie stipend of four hundreth merks and fyve hundreth merks money of this realme respective to be uplifted furth of the personage and viccarage teinds of the lordschip of Pittinweyme, or any pairt thairof, at the termes and in maner as is specifiet and sett downe in the said band, quhilk is of the dait the saxt day of Junii, the yeir of God jM vjC threttie tua yeirs, and registrat in the buikes of counsall and sessioun and ane decreit of the lords thairof interponit thairto upon the first day of Januar lastbypast, togider with the contract and appointment maid and perfyted betuix the baillies and counsall of the said burgh of Pittinweyme thairof, subscryvers for thameselffes and takand burdeine one thame for the commountie of the said burgh one the ane pairt, and Maister Johne Melvell, minister at the said kirk of Pittinweyme, one the uther pairt, of the dait the tuelf day of July, the yeir of God jM vjC threttie tua yeirs, and registrat in the saidis bookes of counsall and sessioun and ane decreit of the lords thairof interponit thairto upon the tuentie saxt day of Februar lastbypast, quhairby the saidis baillies and counsall of the said burgh of Pittinweyme provydit the said Maister Johne Melvell and his successors ministers at the said kirk thairof to ane yeirlie dewtie of ane hundreth and tuentie merks money forsaid farder nor the provisione abonespecifiet contenit in the said band, to be uplifted at the terme of Mertimes yeirlie furth of the reddiest of the grass, mealles, customes and commoun good of the said burgh, and designit to him the gleib specifiet in the said contract boundit in maner thairin contenit; quhairby the said Maister Johne Melvell, for him and his successors, accepted the provisione forsaid contenit in the said contract and band, with the designatione of the said gleib, in full satisfactione of all farder stipend, manse or gleib that could be cravit be him or his successors in any time thairefter, as the said band and contract in thameselfes at lenth beares. Attour, oure said soverane lord and estates of this present parliament statuites and ordaines the forsaidis tua provisiones of money contenit in the saidis band and contract and designatioun of the gleib designit be the said contract to stand and be ane perpetuall and sufficient locall stipend to the said Maister Johne Melvell and his successors ministers at the said kirk, and to serve him and thame in contentatione and full satisfactione of thair manse and gleib at the samyne kirk. Oure soverane lord, with advyse and consent of the estates of parliament, ratifies and approves the chartor and infeftment grantit be his majestie to Maister Andro Murray of Balvaird and to his airs male and of taillie specifiet thairintill, of all and haill the lands and baronie of Drumduff, comprehending thairintill the particular lands, kirkes, teinds, offices and superiorities at lenth specifiet and contenit in the said infeftment, all unite and annexit in ane haill and frie baronie, callit the baronie of Drumduff, to be haldine of his majestie in maner and forme mentionat in the said infeftment, as the samyne infeftment of the dait at Halyrudhous, the fourteine day of July, jM vjC threttie tua yeirs, at mair lenth beirs, in the haill heads, articles, clauses and conditiones thairin contenit; and wills and grants that this present ratificatioun sall be als valeid and effectuall to the said Maister Andro Murray of Balvaird and his forsaidis as if the said infeftment wer de verbo in verbum insert heirintill, notwithstanding the not inserting thairof; quhairanent oure said soverane lord hes dispensit and be thir presents dispenses for ever.
