Act in favour of the ministers of Portpatrick

Oure soverane lord, with advyse and consent of the thrie estates of this present parliament, be thir presents ratifies and approves the chartor or letters patent maid and grantit be his majestie, of the dait at Whytehall, the tent day of Maii, the yeir of God jM vjC and tuentie aucht yeirs, quhairby, and for the causes onerous thairin contenit, his majestie seperated, dismembered and devydit in all tyme thaireftir the lands of Portrie and Kinhilt and tuentie merk land callit Sorbies Lands, lyand withine the shirefdome of Wigtoun, fra the kirk and parochine of Inche, within the quhilk the samyne did ly of befoir, and erectit the saidis lands and baronie of Portrie and Kinhilt with the said tuentie merk lands callit Sorbies Lands and haill bounds within the samyne in ane severall and distinct parochine, and ordanit the kirk then bigging within the burgh of Portpatrick, alias Portmongumrie, to be the paroche kirk thairof in all tyme thaireftir, and ordanit the said kirk to be plantit with ane sufficient pastor and minister to serve the cure thairat as ane severall paroche kirk, and ordanit the haill inhabitants of the said burgh of Portpatrick, alias Port Mongumerie, with all uther inhabitants within the saidis lands and baronie of Portrie and Kinhilt and tuentie merk land forsaid callit Sorbies Land, to repair to the said kirk of Portpatrick, alias Portmongumrie, to the pious uses thairin mentionat, and quhairby his majestie erectit the said kirk in ane severall title and rectorie to be callit the rectorie of Portpatrick and gave, grantit and disponit to Hew, vicount Montgumrie of Airds, his airs and successors, the advocatione, donatione and richt of patronage of the said rectorie, with the richt of presentatione and nomination of the ministers to serve at the said kirk in all tyme thaireftir, and unit and annexit the samyne advocatioun, donatione and richt of patronage of the said rectorie to the forsaid baronie of Portrie and Kinhilt perteining heretablie to the said Hew, vicount Montgomrie. And siclyk, be thir presents, ratifies and approves the chartor of mortificatione maid and grantit be his majestie wnder his hienes great seale, of the dait at Hamtoun Court, the tuentie fyft day of October, the yeir of God jM vjC and threttie yeirs, quhairby his majestie supprest and extinguischit the name and title of the abbacie of Salsett, to the effect that the haill teinds, fruites, rents and dewties perteining to the said abbacie micht be mortifiet, unit and annexit to the kirk of Portpatrick, wnder the reservationes mentionat in the said chartor of mortificatione, and quhairby his majestie mortifiet, unit and annexit to the said kirk of Portpatrick, and to the minister serving the cure thairat and his successors for ever, the haill teinds, personage and viccarage great and small, kirks, rents, proffeitts, dewties and emoluments perteining of befor to the said abbacie and spiritualitie thairof, reservand to his majestie and his successors the presentatione of the ministers of the kirkes of Salsett and Kirkmadin in the Rinnes, quhilkes war of befor the onlie tua kirkes of the said abbacie, togider with the haill locall stipends and teinds of the saidis kirkes payit to the ministers serving the cure at the samyne kirkes and thair successors alreadie modifiet to thame, and quhairof they war in possessione befor the dait forsaid of the said last chartor, and quhairby his majestie gave, grantit and disponit to the minister serving the cure at the said kirk of Portpatrick and his successors the haill rest and remanent teinds, personage and viccarage, fruites and rents of the saidis tua kirkes of Salsett and Kirkmadin (over and abone the locall stipends abonementionat) to remaine with the said kirk of Portpatrick as ane pairt of the patrimonie thairof for ever, and quhairby his majestie gave, mortifiet and assignit to the said minister of Portpatrick and his successors the haill fewfermes and fewmaills of the haill temporall lands of the said abbacie of Salsett of the crope and yeir of God, jM vjC and threttie yeirs, Whitsunday and Mertimes termes thairof, and of all yeirs and cropes thaireftir wnder the declaratione and provisione mentionat in the said last chartor in all and sundrie pointes, articles and clauses contenit in the saidis tua chartors, efter the formes and tennors thairof. And declairs and ordaines that this present ratificatioun of the saidis tua chartors, baith wnder the great seale, is and sall be als guid and sufficient in all respects as if the samyne tua chartors wer at lenth and word be word insert and ingrossit heirintill, dispensand heirby with the not inserting thairof in this present ratificatioun. Lykas his majestie, with advyse and consent forsaid, be thir presents statuites and ordaines that the forsaid first chartor or letters patent and this present ratificatioun thairof ar, and sall be, sufficient richts and secuirities to the minister of the said kirk of Portpatrick, alias Portmongumrie, and his successors for bruiking and joysing of the teinds thairof provydit to him and to the said Hew, vicount Montgumrie of Airds and his forsaidis, for the peacible bruiking and joysing of the said advocatioun, donatioun and richt of patronage of the said paroche kirk or rectorie, and of the richt of presentatione and nominatione of the ministers to serve the cure at the said kirk in all tyme coming. And lykwayes that the forsaid last chartor and this present ratificatioun thairof ar, and sall be, ane sufficient, valeid and lawfull richt and secuiritie to the said minister of Portpatrick and his successors for bruiking, joysing and possessing of the teinds, personage and viccarage, fruites, rents, emoluments, fewfermes, fewmaills and uthers abonementionat mortifiet to thame be the said last chartor perpetuallie in all tyme coming wnder the declaratione and provisione thairin mentionat, ordaining thir presents to be ane sufficient warrand to the clerk of register and his deputtes for extending of ane act of parliament heirupon in dew and competent forme, with provisione alwayes that this present ratificatioun sall nawayes be prejudiciall to the Laird of Kinhilt, his richts and infeftments, bot that the samyne sall remaine with him wnhurt as of befor.

Oure soverane lord, with advyse and consent of the thrie estates of parliament presentlie convenit, ratifies, approves and confirmes ane contract and appointment, of the dait the tuentie fyft day of Maii, the yeir of God jM vjC threttie tua yeirs, registrat in the buikes of counsall and sessioune upon the tuentie aucht day of the said moneth of Maii and yeir of God forsaid, maid betuix Sir William Hamiltoun of Elistoun, knicht, sone and air servit and retourit to umquhile Sir Glaud Hamiltoun of Schawfield, knicht, his father, one the ane pairt, and Sir Arthur Dowglas of Quhittinghame, knicht, designit thairintill Arthur Dowglas of Quhittinghame, one the uther pairt, be vertew quhairof, and for the causes thairin contenit, the said Sir Williame Hamiltoun, sone and air forsaid, hes sauld, assignit, transferrit and disponit to and in favours of the said Sir Arthur Dowglas, his airs and assignais the assignatione and richt maid be Sir George Hamiltoun of Greinlaw, knicht, to and in favours of the said umquhile Sir Glaud Hamiltoun, father to the said Sir Williame, of the tak and assedatioun of the teinds, personage and viccarage, of Quittinghame, with the pairts, pendicles and pertinents thairof quhatsumever, and the said tak and assedatione assignit to the said umquhile Sir Glaud, be vertew thairof, of the daits, tennoris and contents specifiet in the said contract, togider with all uther richts, takes, assignationes, dispositiones and uthers quhatsumever maid and conceavit in favours of the said Sir Arthur Dowglas and his authors of and concerning the saidis teinds, personage and viccarage, of Quhittinghame, pairts, pendicles and pertinents thairof, in the haill heads, articles, clauses and conditiones of the samyne, willing and declaring that the generalitie heirof sall be nawayes prejudiciall to the said Sir Arthur and his forsaidis, bot the samyne to be als valeid and effectuall to him and his forsaidis as if the haill tenor and clauses thairof wer particularlie heirin ingrossit verbatim. And declairs the samyne richts to be guid, valeid and sufficient to the said Sir Arthur Dowglas and his airs, quhairby they may bruik the saidis teinds in all tyme coming during the tyme and yeirs contenit in the saidis takes and richtes of the saidis teinds.

Oure soverane lord, with advyse and consent of thrie estates of this present parliament, be thir presents ratifies and approves the chartor maid and grantit be his majestie wnder his hienes great seale to Maister William Drumond of Hathornden, his airs and assignais of all and haill that half of all and sundrie the lands of Newtoun of Rires and haill portioun thairof, with the maner place, houses, biggings, outsetts, orcheards, yeards, dowcatts, toftes, croftes, colls, coallheuches, mylnes, multurs, annexis, connexis, pairts, pendicles, priveledges, pastures and all thair pertinents quhatsumever, lyand within the lordschip and stewartrie of Fyffe, quhilkes pertenit of befor to umquhile Sir Williame Scott of Elie, knicht, ane of the ordinar clerks befor the lords of counsall and sessioun, or to some uthers, his pretendit mediat or immediat authors thairof, haldine be him or thame immediatlie of his majestie or his hienes predicessors, as being become in his majesties hands at his hienes gift and dispositione be diminutione of his hienes rentall thairof, and be omissioun be the said umquhile Sir Williame Scott and be some of his pretendit authors thairof, mediat or immediat, at the least be the said umquhile Sir Williame himselff in his or thair infeftments thairof grantit be his majestie or his predicessors of the claus anent the mariag of the fewars thairof contenit in the originall infeftment of fewferme of the samyne thairin specifiet in maner thairin mentionat. Quhilk chartor conteines ane new gift and few of the lands and uthers forsaidis maid, grantit and sett be his majestie to the said Maister Williame Drumond and his abonementionat of the lands and uthers abonespecifiet, cum supplemento omnium defectum in ample forme, and quhilk chartor is daitit at Denmarkhous, the tuentie day of July, jM vjC and tuentie nyne yeirs, with the precept and instrument of sasing following thairupon in all pointes, heads, articles and claus thairinmentionat, and decernes and ordaines this present ratificatioun thairof to be als sufficient in all respects as if the samyne war at lenth insert heirintill. And for the said Maister Williame Drumond and his forsaidis, thair better richt and secuiritie of the lands and uthers abonespecifiet, his majestie, with advyse and consent abonewrittine, be the tennor, heirof dissolves the lands and uthers abonewrittine fra his majesties crowne and patrimonie thairof, to the effect that his majestie may give, grant, dispone and sett in fewferme to the said Maister Williame Drumond and his abonespecifiet the lands and uthers abonementionat as being become in his majesties hands, at his hienes gift and dispositione in maner abone writtine, to be haldin of his majestie and his successors in fewferme for the yeirlie payment to his majestie and his successors, thair comptrollers, collectors, chamberlanes and factors present and that sall be for the tyme of the soume of thretteine punds usuall money of this realme of Scotland at tua termes in the yeir, Whitsunday and Mertimes in winter be equall portiones, ten bolls quheitt, tuelf bolls and tua firlottes beir, tuentie four pultries and tuelf capones at the termes of payment usit and wont, in name of fewferme, and also the airs of the said Maister Williame Drumond doubland the said fewferme the first yeir of thair entrie to the saidis lands, with the pertinents, as use is of fewferme, and lykwayes biggand and uphalding a sufficient mansioun, with hall, chalmer, kitchein, barne, byre, dowcatt and uther place necessar upon the grund of the saidis lands corresponding thairto, togider with the mariage of the airs of the said Maister Williame Drumond and his forsaidis quhen it sall happin, and payand all uthers dewties and keipand and fullfilland all uther clauses and conditiones (gif any be) contenit in the auld infeftments, takes or rentalles of the saidis lands, quhilks ar haldin as expressit in the said chartor, ordaining thir presents to be ane sufficient warrant to the clerk of register and his deputtes for extending of ane act of parliament heirupon in dew forme.

Oure soverane lord and estates of this present parliament ordaines ane ratificatioun to be maid in favour of the deacone and remanent brithereine, burgeses and friemen of the skinner craft within the burgh of Edinburgh and thair successors, in dew forme, ratifiand, approvand and, for his hienes and his successors, perpetuallie confirmand the letters, act, decreit and ratificatioun thairin contenit, maid, givin and grantit upon the tuentie saxt day of November, jM vjC and threttie yeirs, be the than proveist, baillies, deane of gild, thesaurer and remanent counsall and deacones of crafts within the burgh of Edinburgh convenit to counsall, upon supplicatione maid to thame be the deacone of the said skinner craft for the tyme, for himselff and in name and behalffe of the remanent brithereine, burgeses and friemen of the said craft within the said burgh, to the samyne deacone and remanent brithereine, burgeses and friemen of the said skinner craft within the said burgh and thair successors and in thair favours, quhairby the saidis proveist, baillies, counsall and deacones of craftes of the said burgh hes ratifiet and approvine the particular articles speciallie and particularlie exprest in the saidis letters and act maid alsweill for observing of ordour and policie amongs the said deacone and remanent brithereine, burgeses and friemen of the said craft, as for thair liberatione frome the injuries frome uthers, and great damnage sustenit be thame be the great multitude of wnfriemen of the said craft within the said burgh and outwith the samyne in the suburbes thairof, to the effect that good order and policie may be observit among the brithereine of the said craft, and that they may be preserved frome the injurie and oppressione quhilk may befall to thame be wnfriemen and straingers quha, without any warrand, usurpes the libertie and priveledge of the said craft, as the saidis articles at lenth insert in the saidis letters and act beirs. And all the clauses and circumstances of the saidis articles, as being fund be the saidis proveist and baillies, counsall and deacones of craft of the said burgh, efter thair reiding, consideratione, lang conference and consultatione had thairupon, and thairwith being ryplie advysit, to be maist reassonable, lawfull, and proffitable for the honour, weill and policie of the said craft, and the saidis proveist, baillies, counsall and deacones of croftes hes interponit thair authoritie thairto, and decernit tham to be keipit and observit in all tyme coming, and hes commandit the officiars present and to come to putt the samyne to dew executioun in all pointes againes the contraveners and breakers thairof wnder the paines thairin contenit in maner thairin mentionat, as in the saidis letters, act, decreit and ratificatioun thairin contenit of the dait forsaid, wnder the signe and subscriptione manuall of the commoun clerk and seale of caus of the said burgh, at mair lenth is contenit; and the confirmatioun grantit thairupon be our said soverane lord the king's majestie, with advyse and consent of his hienes principall thesaurar, deputtie thesaurar, and remanent lords of his hienes exchecker of Scotland, his majesties commissioners, to and in favours of the said deacone and remanent brithereine, burgeses and friemen of the said skinner craft within the said burgh of Edinburgh, and thair successors, wnder his majesties great seale, of the dait at the palace of Quhytehall in Ingland, the tuentie fyft day of Marche, the yeir of God jM vjC threttie ane yeirs, as the samyne confirmatioun also beirs in all and sundrie the heads, pointes, clauses, articles and conditiones thairin contenit, and efter the formes and tennors thairof in all pointes. And oure said soverane lord and estates of this present parliament willes, grants, decernes and ordaines all the heads and articles contenit in the saidis letters, act, decreit and ratificatioun thairin contenit, confirmit as said is, maid and grantit in favours of the said deacone and remanent brithereine, burgeses and friemen of the said skinner craft within the said burgh of Edinburgh and thair successors, and for thair good ordour, pollicie and utilitie in maner thairin contenit, to be dewlie observit, keipit and obeyit in all tyme coming, and to be putt to dew executioun in all pointes againes the contraveiners and breakers thairof, wnder the paines thairin contenit in maner thairin mentionat in all pointes. As also oure said soverane lord and estates of parliament wills, grants, declairs and ordaines that this present ratificatioun of the saidis letters, act, decreit and ratificatioun and articles thairincontenit, and of his hienes said confirmatione thairof, is, and sall be, als valeid and sufficient and of als great force, strenth and effect to the said deacone and remanent brithereine, burgeses and friemen of the said skinner craft within the said burgh of Edinburgh and thair successors for bruiking and using of the liberties thairin contenit in all tyme coming, as if the samyne letters, act, decreit, ratificatioun and articles thairin contenit and his hienes said confirmatione thairof wer all at lenth de verbo in verbum insert and contenit in the said ratificatione, notwithstanding the samyne sall not be sua done; quhairanent, our said soverane lord and estates of parliament hes dispensit and, be thir presents, dispenses for ever, and that the said ratificatioun be farder extendit in dew forme with all clauses necessar.
