Act in favour of Sir Thomas Hope of Craighall, knicht baronett

Oure soverane lord and estates of parliament ratifies and approves the act of commissioun of surranders and teinds, of the dait at Halyrudhous, the auchteine of Marche, jM vjC threttie ane yeirs, quhairof the tennor folloues: The quhilk day Maister Walter Buchannan, minister of Seres, craved of the commissioners for the surranders and teinds that sieing the lands and baronie of Kinninmonth and lands of Arnydie perteining heretablie to Sir Thomas Hope of Craighall, knicht barounet, his majesties advocat, wer of old a pairt of the parische of Sanctandrois and wer laitlie unit to the kirk of Seres, and the unioun thairof ratifiet in parliament, that the said Sir Thomas Hope, his airs and successors micht be tyed for the saidis unit lands and baronie to contribute to the ordinarie burdeins dew to a paroche kirk for reparatione thairof and bigging and reparing the kirk dykes, and that the viccarage teinds of the said baronie, the rait quhairof extends to fourteine pund sax schilling aucht pennies, micht be applyed to the use of the said kirk of Seres. With the quhilk desyre the said commissioners being weill and ryplie advysit, and they having seine the warrand and act of the said unioun ratifiet in parliament, the saidis commissioners hes thairfor ratifiet, allowed and approvin and, by thes presents, ratifies, allowes and approves the said unioun in all pointes and declairs the said Sir Thomas, his airs and successors to be frie of all burdeine, taxt or uther contributioun at the kirk of Sanctandrois and to be subject to the reparatione of the kirk and kirkyaird dykes of the said kirk of Seres in all tyme coming; and ordaines the rait and dewtie of the viccarage teinds of the saidis lands and baronie of Kinnynmonth to perteine to the said kirk of Seres in all tyme to come, to be applyit to the intertainment of the reader and skoolemaister at Seres. Quhairupon the said Maister Walter Buchannan, minister at Seres, askit instruments. Extractum de libris actorum commissionis predictis per me Jacobum Prymrois clericum eiusdem sub meis signo et subscriptione manualibus. And his majestie and estates forsaidis wills and ordaines that the said Sir Thomas and his successors is, and sall be, frie of all burdeine, taxt or uther contributioun at the kirk of Sanctandrois and to be subject to the reparatione of the kirk and kirk yaird dykes of the said kirk of Seres in all tyme coming; and ordaines the rait and dewtie of the viccarage teinds of the saidis lands and baronie of Kinnynmonth to perteine to the kirk of Seres in all tyme to come, to be applyit to the intertainment of the reidar and skoolemaister at Seres. Oure soverane lord and estates of this present parliament, having consideratione of the trew and thankfull service done to his majestie and his hienes most noble progenitors be Sir James Lokhart of Castellhill, knicht, gentleman of his majesties privie chalmer, and his predicessors, ordaines ane act to be maid, ratifiand and approvand and, for his hienes and his successors, perpetuallie confirmand that chartor and infeftment and donatione thairin contenit, grantit be Sir James Lokhart of Lie, knicht, in favours of the said Sir James, his sone, and umquhile Elizabeth Fairlie, his spous, the langer leivar of thame tua, in lyfrent and to his airs male and assignais thairin mentionat, of the dait the tuentie day of December, jM vjC and sevinteine yeirs, of certane peices and portiones of the lands and baronie of the Lie, and of the said Sir James and his forsaidis of the haill remanent of the samyn lands and baronie, extending in the haill to ane tuentie pund land of auld extent, tours, fortalice, mylnes, multors and uthers thairincontenit, and of the fyftie schilling land of Nemphlar, unite thairto in ane frie baronie, and of the ten pund land of Hewheids, the superioritie thairof, togider with the chartor of confirmatione of the forsaid infeftment grantit be our umquhile darrest soverane lord, King James the Saxt of blissed memorie, wnder the great seale, of the dait the penult day of Junii, jM vjC and nynteine yeirs, conteining thairintill ane new gift of the saidis lands and baronie, and of the burgh of Cairtland and lands of Hewheids, erecting thairby lykwayes the saidis lands of Lie, Nemphlar and Hewheids in ane frie baronie and the burgh of Cairtland in ane new burgh, all incorporat in ane frie baronie callit the baronie of Lie as said is; togider with the ratificatione in parliament grantit be our said last soverane lord and estates of parliament in favours of the said Sir James Lokhart, elder, his airs male and assignais of the lands, baronie and uthers abone and thairin mentionat, of the dait the tuentie thride day of October, jM vjC and tuelf yeirs, quhilks ar haldin heirby as ingrost verbatim, with the not inserting of the quhilks infeftments and act of ratificatioun our said soverane lord, with advyse and consent forsaid, hes dispensit and dispenses in all and sundrie heads, articles, clauses, obleisments, pointes, pases, circumstances, articles and conditiones of the samyn quhatsumever specifiet and contenit thairintill. Lykas our said soverane lord and estates forsaidis of this present parliament wills, grants, statuites and ordaines that the said Sir James Lokhart, his airs male and assignais forsaidis sall peaciblie bruik, joyse and posses the forsaidis lands and baronie, burgh of baronie and uthers respective forsaidis with the pertinents as thair awne propper heretage at thair pleasure in all tyme coming, conforme to the tennor of the saidis infeftments in all pointes, but any stope, trouble or impediment, nothwithstanding of any defect or infirmitie (if any be) contenit thairintill; quhairanent oure said soverane lord, for his hienes and his successors, with advyse and consent forsaid, hes dispensit and dispenses, ordaining the forsaid act to be ane sufficient supplement of all faults and defects (if any be) contenit in the saidis infeftments and againes all actioun and questioun quhatsumever that can be maid or moved in the contrair, ordaining the samyn act to be registrat in the buikes of parliament as effeirs.

Oure soverane lord, with advyse and consent of the thrie estates of this present parliament, ratifies and approves the chartor maid and grantit be his majesties umquhile darrest father wnder his hienes great seale, of the dait at Halyrudhous, the thretteine day of July, the yeir of God jM vjC and tuentie four yeirs, to and in favours of Sir Patrick Murray of Elibank, knicht baronett, his airs male and assignais quhatsumever heretablie, of all and haill the lands, place and steiding of Williamhap, with the pertinents and commodities thairof quhatsumever, lyand within the lordschip of Etrickforrest and shirefdome of Selkirk, and the new gift and few thairin contenit for payment of the dewtie thairin mentionat; and siclyk the chartor maid and grantit be his majestie wnder his hienes great seale, of the dait at Halyrudhous, the tuentie thrie day of Junii, the yeir of God jM vjC threttie tua yeirs, to and in favours of the said Sir Patrick Murray, his airs male and assignais heretablie quhatsumever, of all and haill the quarter or fourt pairt of the maynes of Balincreif, callit Lochehill, with houses, biggings and pertinents thairof quhatsumever, lyand within the constabularie of Hadingtoun and shirefdome of Edinburgh, as for the principall, and of the tenement of land and duelling hous perteining to Maister Robert Lindsay, second lawfull sone to umquhile Bernard Lindsay of Lochehill, than occupyit be Gilbert Huntar, induellar in the towne of Leith, with the close chalmers and haill pertinents thairof lyand in the said towne of Leith within the King's Wark thairof; and of all and haill that the said Maister Robert Lindsay his duelling hous, wnder and abone, with the pertinents, than occupyit be Marjorie Dempstar in Leith, lyand in the said towne of Leith within the said King's Wark thairof boundit in maner mentionat in the infeftment of the samyn maid to the said umquhile Bernard Lindsay, and that in speciall claus of warrandice and secuiritie to the said Sir Patrick Murray and his forsaidis of the samyn quarter or fourt pairt of the said maynes of Balincreif callit Lochehill, with the pertinents; and the new gift and few thairin contenit for payment of the few dewties thairin contenit, with the precepts and instruments of sasing respective, following upon baith the saidis chartors in all and sundrie heads, pointes, articles and clauses thairin contenit eftir the formes and tennors thairof. And declairs, statuits, ordaines this present ratificatione of the saidis tua chartors, with the precepts and instruments of sasing respective following thairupon, to be als valeid, effectual and sufficient in all respects, as if the samyne wer at lenth and word be word ingrost and insert heirintill, dispensand heirby with the not inserting thairof. Attour, our said soverane lord, with advyse and consent forsaid, (for the said Sir Patrick Murray and his forsaidis farder securitie anent the peacible bruiking and joysing of the lands and uthers forsaidis with the pertinents) hes dissolvit and be thir presents dissolves the haill lands and uthers contenit in baith the saidis chartors fra his majesties crowne and patrimonie thairof, to the effect that his majestie may give, grant and dispone to the said Sir Patrick Murray and his abonewrittine heretablie the lands and uthers respective forsaidis principallie and in claus of warrandice in maner abonewrittine, to be haldin of his majestie and his successors in fewferme for the few dewties contenit in the saidis tua chartors respective. And farder our said soverane lord, with advyse and consent forsaid, finds, declairs, statuits and ordaines that the forsaidis tua chartors, with the precepts and instruments of sasing following thairupon and this present ratificatioun thairof, ather but the said infeftment to follow heirupon or with the samyn, ar and sall be sufficient, valeid and lawfull richts and secuirities to the said Sir Patrick Murray and his forsaidis for the peacible bruiking and joysing in all tyme coming of the lands and uthers forsaidis principallie and in claus of warrandice in maner abonespecifiet for the dewtie contenit in the saidis chartors, notwithstanding of quhatsumever actes of parliament, uthers actes, lawes or constitutiones maid or to be maid in the contrair; quhairanent his majestie, with consent forsaid, be thir presents, dispenses in that pairt for ever, ordaining thir presents to be ane sufficient warrand to the clerk of register and his deputts for extending ane act heirupon in dew forme.

Oure soverane lord and estates of this present parliament ordaines ane ratificatioun to be maid thairin in favours of his hienes lovitt Sir Johne Dalmahoy of that Ilk, knicht, ane of his majesties maisterhousholds in Scotland, ratifiand, approvand and, for his hienes and his successors, perpetuallie confirmand the chartor maid and grantit be his majesties umquhile darrest father, James than king of Scottes, thaireftir king of Great Britane, France and Ireland, defendar of the faith, of worthie memorie, to umquhile Alexander Dalmahoy, than of that Ilk, father to the said Sir Johne Dalmahoy, his airs and assignais quhatsumever heretablie, of all and haill the lands and baronies of Dalmahoy and Over Libbertoun, with thair pertinents, lyand within the shirefdome of Edinburgh, upon the said umquhile Alexander Dalmahoy his awin resignatioun thairof, maid be him in the hands of his hienes said umquhile darrest father, his superior thairof, and new gift thairincontenit, maid and grantit be his hienes said umquhile darrest father of worthie memorie to the said umquhile Alexander Dalmahoy of that Ilk and his forsaidis of the saidis lands and baronies, with the castells, tours, fortalices, maner places, houses, biggings, mylnes, wodes, fischings, tennents, tennandries, service of frie tennents and uthers pertinents thairof, and unioun of the samyn in ane haill and frie baronie, to be callit the baronie of Dalmahoy in tyme coming, to be haldine of our soverane lord and his hienes successors in fie heretage and frie baronie for ever, for payment of the richts and services usit and wont, quhairby the waird, releiff and mariage ar taxt and liquidat to the particular soumes of money mentionat in the said chartor, as the samyn wnder the great seale of the dait the tent day of August, the yeir of God jM vC fourscoir auchteine yeirs at mair lenth beirs. And our said soverane lord and estates of parliament wills and grants and, for his hienes and his successors, decernes and ordaines that this present ratificatioun of the saidis chartors, precepts and seasings following thairupon and confirmatioun abonewrittine is, and sall be, of als great force, strenth and effect to the said Sir Johne Dalmahoy, his airs male, successors and assignais for bruiking of the saidis lands, baronie and uthers abonewrittine, with the pertinents thairin contenit, according thairto in tyme coming as if the samyne war all at lenth speciallie and particularlie heirin contenit, ratifiet and approvin; quhairanent, and with all uther defects and imperfectiones quhilks may be proponit againes the saidis richts or any of thame or this present ratificatioun of the samyne and validities thairof, our said soverane lord and estates of parliament hes dispensit and, be thir presents, dispenses for ever, provyding alwayes that this present ratificatioun is, nor sall, nowayes be extendit to the richt of patronage of the prebendaries of half Dalmahoy, half Haltoun, half Bonyngtoun and half Plat situat in the colledge kirk of Corstorphine, alternatis vicibus, disponit be the said chartor, bot the said patronage of the saidis prebendaries to be expreslie reservit and exceptit furth of this present ratificatioun, and that the said ratificatioun be farder extendit with all clauses necessar.

And our said soverane lord and estates of parliament wills and grants and, for his hienes and his successors, decernes and ordaines that this present ratificatioun of the saidis decreits, act of consignatioun of the pryces of the saidis teinds, discharge givin be the said Lord of Balmerinoche thairon and contract conteining the assignatione forsaid is and sall be of als great strenth, force and effect to the said Henrie Nisbett and his forsaidis for bruiking of the saidis teindscheaves of his saidis lands abonespecifiet, with the pertinents according thairto, as if the samyne haill richts wer all at lenth speciallie and particularlie heirin contenit, ratifiet, and approvin; quhairanent, and with all uther defects and imperfectiones quhilks may be proponit or alledgit againes the samyn or this present ratificatioun thairof, oure said soverane lord and estates of parliament hes dispensit and, be thir presents, dispenses for ever, and that the said ratificatioun be farder extendit in the best forme.
