Ratification of twa acts of the commission for the teinds

The estaits presentlie conveenned ratifeis, allowes and approves the twa acts underwrittin made upon the saxt day of August instant be the commissioners nominat be the king's majestie for the treatie anent the erectiouns, surrenders and teinds, the one thairof anent the partie or parteis, titulars or heretours, who hes not subscryved the generall submissiouns made to his majestie, and the other anent the securitie to be givin be the heretours who ar willing to pay to thair titulars and tacksmen of thair teinds the valued teind thairof in victuall, silver or other speces, in all and sindrie points, clauses and articles conteanit in the saids twa acts, and after the forme and tennour of the same in all points, of the whilks twa acts the tennour followes:

The whilk day the commissioners nominat be the king's majestie for the surrenders and teinds hes found, declared and ordained and, be the tennour of this present act, finds, declaires and ordaines that where anie partie or parteis, titulars or heretours, who hes not subscryved the generall submissiouns made to his majestie and notwithstanding hes compeired before the saids commissioners or before the subcommissioners and acknowledged the judgement by persute or defence and hes not declynned the judgement nor appealed thairfra, that everie suche parteis, titular or heretour, sall be repute and haldin as submitters and subscryvers of the said generall submissioun and processe sall be grantit for or aganis thame as if they had subscryved the said generall submissioun.

Item, the commissioners ordanis that where the heretours ar willing to pay to thair titulars and tacksmen of thair teind the valued teind thairof in victuall, silver or other speces, according as they ar valued before the great commissioun or subcommissioners, that they sall give a reall securitie by chartour or seasing out of thair lands to the said titular and tacksmen for payment of the said valued rent of teind in victuall, silver or other speces before they be denuded ather of right or possessioun of the same.
