Anent the article toucheing the imposeing of fourtie eight shillingis of custome upoun everie twne of coale exportit in strangeris boddomes, the estaittis, haveing hard the awneris of the coalheughis upoun bothe sydis of the watter of Forthe concerning that article, thay constantlie affirmed and declairit in presence of the estaittis that thay wer at suche extraordinar chargis in the intertenying of thair watter workis that the whole cuntrey seale and dispatche of thair coale in a yeir will not interteny thair watter workis ane moneth and that thay ar not able to uphold thair workis without ane aboundant dispatche of thair coale by strangearis; and that thair is not shipping in this cuntrey to transport a verie small pairt of coale, and if this new custome be imposed it wilbe a scar and hinder to strangearis to come heir for coale, whairunto thay ar allured more by the ease thay haif in the pryce nor for ony necessitie thay haif of oure coale; and if the trade fall, without the whilk the awnaris ar not able to interteny thair workis and coilheughis, the same will perishe without ony possibilitie of recoverie at ony tyme heirafter, not onlie to the utter undoing of the awneris bot to the extreame hurt and prejudice of the cuntrey, whilk by this occasioun wilbe destitute of all the sea coale within the kingdome, besydis the miserable wraik of mony hundreth families of poore people whose onlie mantenance dependis upoun thir workis and without the whilk thay wilbe all turnit beggaris. The estaittis haveing at lenth hard the saidis awnaris upoun this poynt and the trewth of thair affirmatioun being knowne to sindrie of thame and the matter being putt to voitting, it was fund that without a seine and evident hurt to the cuntrey this custome could not be impoised upoun the coale.

Whereas thair hes bene divers actis of parliament, conventioun and secreit counsell maid and publist heirtofore whairby all his majesties subjectis wer dischargit to repair to the towne or place whair his majesties parliament, conventioun, counsell or justice sittis with grittar traynes nor is allowed unto thame be the saidis actis, under certane paneis mentionat and contenit thairintill, nochtwithstanding the not executioun of the saidis actis and punisheing of the offendaris hes procurit the brek and violatioun of the same actis to the heigh contempt of his majesties auctoritie and lawis; thairfore the estaittis ordanis all the saidis actis to be putt in executioun aganis the contravenaris thairof, and recommendis the prosequutioun of the same to the lordis of secreit counsell. And sicklike the estaittis statutes and ordanis that no persone nor personis of what rank or qualitie soever thay be present thameselffis befoir his majesties counsell, outher as persewaris or defendaris, bot be thameselffis allone, accompanied with one at the most whan the counsell sall allow thairof, under the pane to be punist thairfore at the arbitriment of the counsell.

The estaittis, considering that one of the cheiff causes whilk hes procurit the scarcitie and penurie of moneyis within this kingdome hes proceidit from the importatioun of unnecessair waires, whairof the cuntrey standis not in neid, and from the exportatioun of the proper moneyis of the kingdome and selling of the same as ordinarie merchandice in forreyne cuntreyis, whairas yf the native commodities of the cuntrey wer verteouslie used and imployed upoun the importatioun of necessair commodities, and if this wicked and mischevous trade of exporting of moneyis wer advertit unto and punist, the penurie and scairstie of moneyis wald not be so universallie sensible and apparent. And seing thair is goode actis alreadie maid and standing in force bothe aganis the importatioun of unnecessair wairis and the exportatioun of moneyis, the not executioun whairof hes produceit this comoun evill and want of moneyis, thairfore the estaittis ordanis all the saidis actis, togither with the actis maid anent the pryceis of sownis and Englishe beir, to be putt to executioun and the contravenaris thairof to be seveirlie punist. And the estaittis recommendis to the lordis of secreitt counsell the dew prosequutioun of the saidis actis and the discoverie and punisheing of the offendaris. And sicklike, the estaittis ordanis and commandis the maister of his majesties cunyehous that he at no tyme heirafter tak ony other satisfactioun for bulyeoun bot the bulyeoun itself in foreyne money as he will answeir upoun the contrarie at his perrill.

The estaittis presentlie convenit, considdering the grite hurt and inconvenient that his majesties goode subjectis of all rankis and degrees hes sustenit thir divers yeiris bigane by the rebellioun and contemptuous lying at the horne of so grite nomberis of undewtifull personis of whome a grite nomber haveing filled thair handis with otheris menis goodes and haveing ingadgeit thair freindis as cautionaris for thame, thay not onlie become careles of thair credite and sensles of the distreses and miseryis whilk thair creditoris and cautionaris underlyis, bot mony of thame pases the tyme in ryott and contentment and in prodigall houshalding and feasting, unnecessarlie spending that upoun thair tables whilk in some measure wald pay a pairt of thair debt, and otheris lyis at the horne for criminall causes and for insolencyis and ryottis committit be thame; and it hes oftintymes fallin oute whan thir rebellis hes bene persewit to be apprehendit be his majesties schireffis and otheris officiaris to burgh and land that thay haif maid oppositioun and resistance with unlaughfull waponis, for remeid whairof in tyme comeing, the estaittis statutes and ordanis that all schireffis and otheris officiaris to whome it appertenis salbe commandit to tak the rebellis and thair houses and to putt and hald the rebellis, thair wyffis and bairnis furth of the same dureing thair rebellioun, and to mak inventar of thair goodes and geir being thairin. And if oppositioun and violent resistance salbe maid be the rebellis, that thay sall be thairupoun callit to thair answeir befoir his majesties counsell. And if thay compeir and upoun a laughfull tryall sall prove guiltie, thay salbe exemplarlie punist. And if thay be absent and so tak the cryme upoun thame, thay salbe declairit rebellis and fugitives and commissioun salbe gevin oute aganis thame, as in caises criminall, to the schireffis and otheris officiaris for persute of thame with fyre and sword, and proclamationis salbe direct commanding the cuntrey to assist the magistrattis.

The estaittis presentlie convenit, considdering how that the commissioneris nominat be the parliament haldin at Edinburgh in the moneth of Junii 1617 for reduceing of the weightis and measouris of this kingdome to ane conformitie hes, with grite panes and travellis and with sound judgement, mature advise and deliberatioun, broght that work to ane goode and happie conclusioun by establisheing and setting downe ane perfyte and just forme of measour and weight, whairby all his majesties leiges ar commandit to buy and sell, ressave and delyver thair victuall and otheris commodityis under certane panes contenit in the act and the ordinance maid thairanent, as in the same insert and registratt in the bookes of parliament and dewlie publist at all placeis neidfull, whairthrow nane of his majesties subjectis can with reasone pretend ignorance of the same, at lenth is contenit. Nochtwithstanding whairof, it is cleirlie understand to the estaittis that this act importing so far the generall goode of the kingdome is in a maner become in dissuetude throughout mony pairtis of this kingdome and people hes tane the bauldnes, without feare of the law or regaird of his majesties royall auctoritie, to renew the formar abuse of buying and selling, ressaveing and delyverie of victuall and otheris goodes with different weightis and measouris, everie one making choise of measouris according to thair unrewlie appetite and as thair avaritious and greedie humour leadis thame. And besydis this publict contempt and brek of the law thair is ane other abuse renewed, whiche formarlie wes dischairgit be act of counsell and proclamationis publist throughout the kingdome, to witt the exacting of ane peck or more under the name of cheritie to the boll; and this abuse is foisterit and intertenyed be nomberis of the rude and godles multitude as namelie be maltmen, mailmakeris, baxteris and otheris personis, couparis and tradaris with victuall, who, out of thair avaritious and godles humour, will nouther buy nor ressave victuall unles thay gett ane peck or more of cheritie to the boll, doing thairby what in thame lyis to frustratt and mak voyde the executioun of the said act of parliament and to draw upoun his majesties subjectis and namelie upoun the poore fermoraris and labouraris of the ground such ane havy yoke and burdene as thay ar not able to underly making thame losse ane boll or more of everie chalder of thair fermes. For remeid whairof, the estaittis, according to thair formar actis and proclamationis maid heiranent, chargeis and inhibitis all his majesties leiges that nane of thame presoome nor tak upoun hand to ressave or delyver ony victuall or otheris merchandice and goodes bot with the measouris and weightis appoyntit and sett downe be the said act of parliament and conforme to the preceis reull, forme and ordour mentionat thairin, without exacting, craveing or ressaveing of ony cheritie to the boll or useing ony other forme of cousanage, policie or circumventioun to abuse his majesties subjectis in ressaveing and delyvering of thair victuall or to frustratt the executioun of the said act of parliament, under the panes contenit in the actis and proclamationis formarlie maid heiranent, whilkis panes salbe execute upoun thame without favour. Chargeing heirby all his majesties officiaris and magistratis to burgh and land and otheris to whose office and charge the executioun of the saidis actis appertenis, to cause diligent attendance be gevin, everie one of thame within thair awne boundis, whair and be whome the saidis actis ar violatt and to tak suche course and ordour for punisheing of the same as by the tennour of the saidis actis is enjoyned unto thame as thay and everie one of thame will answeir to his majestie and his counsell upoun the duetifull discharge of thair office.

Anent the article bearing that the lordis of counsell and sessioun sall repair to the sessioun hous in a seamlie maner on horse with thair foote cloathis, findis that mony of the lordis of sessioun hes thair duellingis verie neir the sessioun house and some of thame duellis in narrow cloises whair thair is not ane convenient passage for horse, and the calsay being dangerous to be ridden upoun, it is thairfore not thoght convenient that thay salbe tyed to this necessitie of ryding.

Thairfore, the estaittis nominat the Earlis of Rothes, Kinghorne and Lauderdaill, the Lord Ross, Yester, Lowdoun, Balmerinoch and Carnegy, or ony foure of thame, for the nobilitie; the Bishoppis of Galloway, Brechin and Caithnes, or ony tua of thame, for the clargye; the Lairdis of Keir, Tracquair, Lag, Amisfeild, Balcome, Westnisbett, Sir James Dundas and Sir Johne Hamiltoun of Lettrick, or ony foure of thame, for the small barronis; and the commissionaris to be appoynted be the burrowis of Edinburgh, Dundee, Abirdeene and Glasgow, to convene and meete with his majesties counsell upoun the last counsell day of Februar, to conferr, treate and ressoun upoun the goode and expediencie of this article to the intent a report may be maid of thair opinionis to his majestie.

Anent the supplicatioun gevin in be the small barronis to the estaittis presentlie convenit proporting that thay wer informed that his majestie intendit to mak some alteratioun in the sessioun whiche wes a soverane and heigh court, whairof the fundatioun wes with grite wisdome and judgement built by his majesties grite grandfather of happie memorie with the consent of the estaittis of parliament, and that the auctoritie of this court hes bene sensyne illustratt with mony priveledgeis flowing from succeiding princes, and speciallie from his majesties darrest father of blissed memorie, and thairfore desyreing that the estaittis wald joyne with thame in thair humble petitioun to his majestie that his majestie wald be pleasit not to mak ony alteratioun thairof without the advise of the estaittis of this kingdome. Thair petitioun being hard and some objectionis maid aganis the same that as his majestie wes a just and upright prince who soght nothing bot the goode and weele of his people, so thair wes no subject that with reasone could suspect or mistruste the sinceritie of his majesties proceidingis outher in that or ony other thing els, yitt thay continewit verie instant to haif the voices of the estaittis thairupoun. Whilk being grantit and thair voitis tane, thay all agreed to joyne with the barronis in thair petitioun that his majestie sould be humblie intreated that if he intendit ony alteratioun in the sessioun from that whilk wes established in parliament, that his majestie wald be graciouslie pleasit to follow oute the same be the advise of the estaittis of this kingdome in parliament.

Anent the petitioun gevin in be the small barronis proporting that thay sustenit verie grite prejudice by this new erectit ordour of barronettis and the precedencie grantit to thame befoir all the small barronis and freehalderis of this kingdome, whairin thay pretendit grite prejudice in thair priviledgeis and dignityis possest be thame and thair predicessouris in all preceiding aiges and thairfore thay desyrit that the estaittis wald joyne with thame in thair humble petitioun that his majestie might be intreatted to suspend the precedencie grantit to thir barronettis untill the tyme that the plantatioun for the whilk this dignitie is conferred be first performed be the undertakeris. Whairupoun Sir Williame Alexander, cheiff undertaker of this plantatioun, being hard, and he haveing objectit unto thame his majesties royall prerogative in conferring of honnouris and titlis of dignitie in matteris of this kynd, importing so far the honnour and credite of the cuntrey and that his majesties prerogative wald not admitt ony sort of oppositioun and that this suspensioun of the undertakeris precedencie wald frustratt the whole plantatioun, after that the small barronis had most humblie protestit that the least derogatioun of his majesties royall prerogative sould never enter in thair hairtis and that thair petitioun wes in no sort contrair to the same, and that thay acknawledged that the conferring of honouris did properlie belong to his majestie as a poynt of his royall prerogative, and thay undertook that if it wer fund meete be his majestie and the estaittis that this plantatioun sould be maid that thay upoune thair awne chargis wald undertak the same without ony retributioun of honnour to be gevin, thairfore, the estaittis haveing at lenth hard bothe the pairtyis, it wes fund be pluralitie of voittis that the estaittis sould joyne with thame in thair petitioun foirsaid.
