Letter: king's letter to the estates

The whilk day, Sir George Hay of Kinfawnis, knight, lord heigh chancellor of this kingdome, producit and exhibite to the estaittis presentlie convenit his majesties missive letter underwrittin, of the whilk the tennour followis:

Charles R[ex]. Right trustie and right welbeloved cosens, right reverend and reverend fatheris in God, right trustie and welbeloved and otheris or trustie and welbeloved subjectis presentlie assmbled in conventioun, we greete you all and everie ane of you most hairtilie weele. As the love and speciall respect whiche from oure infancie we haif ever caried to that oure kingdome of Scotland hathe bene exceiding grite, so dureing this short tyme of oure reigne oure care for the floorisheing estate and welfare thairof hathe bene no lesse. And whairas now you ar mett togither in counsaill (as we hoip) for the generall goode of the same, we haif thoght goode by these presentis to certifie you that or calling you togither proceidit asmuche from oure said care of the estate and goode governament thairof as for the advancement of oure awne affairis. For proofe whairof, we haif sett downe certane articles to be imparted to you by oure chancellor, exspecting (and most earnestlie requireing you as you will gif testimonie of your dew obedience to ws and of youre love to your native cuntrey) that you will tak suche course for putting the same to dew executioun as thay may be observed in all tyme comeing as on oure pairt nothing salbe omitted either for reformatioun of whatsoever is amisse, or for removeing of ony grevance whiche ather hathe lyne, doeth or sall ly hevie upoun you and that without respect ather to oure awne commoditie or to the particulair benefite of ony persone whatsoever; a taste whairof we haif gevin in this distinctioun of oure privie counsell and sessioun whairin we haif not spared those whose grite and faithfull serviceis haif deserved at oure hand whatsoever could haif bene demandit if without the hinderance of a generall goode it could haif bene granted. And thairfore, if at this tyme you sall expresse your affectioun to ws as subjectis sensible of oure present conditioun and of oure love to you, yee may be assured and we faithfullie promise that at oure comeing to you to ressave oure crowne (whiche by the grace of God salbe this nixt yeir) youre eares sall not be troubled with the heiring of ony suche word as subsidie or taxatioun to be granted. Thus willing you to tak the premises to your speciall consideratioun, we bid you all and everie one of you farewell. Gevin at Sarusberie, the 22 of October 1625.

Whilk letter being red, hard and considderit be the estaittis, thay all to thair unspeakable comfort and contentmnent did with most submissive and humble thankis acknawledge his majesties singular care of this his native and ancient kingdome; and for the whilk, thay wer verie instant with thair prayeris unto God for his majesties long and happie reigne.

Anent the furnissing of ijM men with shipping

Anent the propositioun maid be Sir George Hay of Kinfawnis, knight, lord heigh chancellour of this kingdome, to the estaittis presentlie convenit that in regaird of the grite preparatioun of foreyne forceis through out diverse pairtis of Europe and that it was verie necessair and expedient that this kingdome sould be likewayes upoun thair gaird provydit to withstand and resist ony foreyne invasioun that sould be intendit, that thairfore the estaittis wald yeild to the furnishing of tua thowsand men with shipping for the space of thrie yeiris, to the intent thay micht be ever in reddines, alsweele for persute as defence, as the necessitie of thair imployment and service for the saulftie of the countrey sould require, and for the whilk, his majestie wald discharge the late taxatioun granitit be the estaittis unto his majestie, except so muche thairof as wald serve for defraying of the chargis of his majesties comeing to this kingdome to accept the royall crowne thairof. The estaittis, haveing hard and considderit the said propositioun, thay all exprest thair most earnest affectioun to extend the uttermost of thair abilities for his majesties contentment, especiallie in a matter so muche concerning thair awne saulftie; yitt the knawne povertie of the cuntrey by the calamitie of some hard yeiris could not in thair opinions affoorde ony grittar sowmes than the taxatioun presentlie grantit to, promiseing nevertheles to be reddie with thair personis to advance his majesties service in all interveneing and necessair occasionis concerning the defence and saulftie of the cuntrey.

That considderirng the necessitie of shipping bothe for benefite and saulftie of that kingdome, the estaittis wald tak to thair considderatiouin how the best incouragement may be gevin to merchantis and seafareing men to provyde store thairof, for it is a grite shame that nochtwithstanding the multitude of saulf and convenient harbouris in that oure kingdome, yitt if ony invasioun salbe maid by sea the least meanis of resistance cannot be used by shipping.

That seing the verie veshellis appoyntit onlie for cariage of coales affoordit ws plentie of serviceable shippis at the last setting oute of oure navie, and sieing thair is no small occasioun of haveing the like in that kingdome whairin thair is suche plentie of coale if oure subjectis had the onlie trafficque thairof and to prevent that hencefurth that kingdome be not prejudged as hitherto it hathe bene by haveing that commoditie onlie transported be strangearis, it is oure speciall pleasure that by act of conventioun the custome of fourtie eight shillingis Scottis be imposed on everie twne of coales transported in stranger bottomes at ony tyme heirafter, whiche is far les than thay pay heir in Englaind. Neither will we ony longer suffer that shamefull abuse whairby for the filthie gain of a few the whole kingdome is wronged and strangearis preferred to oure naturall subjectis.

Whairas we ar crediblie informed that diverse childreene, bothe of noblemen and otheris oure naturall subjectis of that oure kingdome, hathe bene heirtofore sent over into seminaries, colledgeis or other houses of popishe relligioun beyond the seas and ar thair remayning to be broght up, contrarie to oure lawis established, and also that thair be divers Jesuites and seminarie preistis frequenting and repairing to the houses of manie oure subjectis in that realme and that papistis do increase thair, whairof, knawing the dangerous consequenceis and being desireous that oure goode subjectis may tak notice of oure reddines and constant resolutioun to manteyne the true relligioun profest and by law established in that oure realme and upoun all occasionis to suppresse all contrarie, thairfore it is oure pleasure that with all convenient diligence you cause mak publict proclamatioun at the mercatt croceis of all the cheiff burrowis in that oure kingdome, chargeing and commanding that all the said childreene befoir the first day of Maii nixttocome returne into thair native cuntreyis and conforme thameselffis to live in suche dewtie and obedience as becometh goode subjectis; and that thair parentis, tutouris, governouris and suche otheris as haif bene or ar faultie ather in sending, permitting or manteneing thame thair tak present order to recall thame home and to provyde that thay be returned into thair awne cuntreyis upoun the day afoirsaid under the pane of the uttermost severitie of oure justice to be extendit in that behalf. Also, upoun the like pane, straitlie chargeing and commanding that no bishop, preist or other persone haveing taikin or whiche sall tak orders by or under ony authoritie or power derived from the sea of Roome, whether he or thay be naturall borne subjectis or stranrgearis, do presoome to conferre ony ecclesiasticall ordouris or exercise ony ecclesiasticall functioun or jurisdictioun whatsoever towardis, or upoun, ony oure naturall borne subjectis in that realme. Likewayes expreslie chargeing and commanding all and singular judges and justiceis to whome it apperteineth that all the lawes and statutes now standing in force be putt to dew executioun aganis all Jesuites, seminarie preistis and otheris haveing taikin ordouris by anie authoritie from the sea of Roome being oure subjectis who, from and after the first day of Februar nixttocome, salbe fund in that oure kingdome; whiche day we limite and prefix for the uttermost tyme of thair departour. And whereas the broyle whiche not long since fell out betuix the Hollanderis and Dunkirkeris in the verie haven of Leyth, to oure no small discontentment and publict disgrace of that whole kingdome, hathe gevin ws sufficient prooffe of the necessitie of fortis to defend the havens and townis thairunto adjacent from suddeyne surpryses, it is oure pleasure that you gif order to Sir Andro Gray, generall muster maister of that oure kingdome, to visite all the sea portis thairin with suche diligence as convenientlie may be and to advise and consider of the most convenient places whairupoun to raise bulwarkis and blokhouses for the best defence of the same, of what forme the severall fortificationis salbe and with the advise of skilfull workmen conclude to what chargis the building of everie ane of thaime will extend, and to certifie oure counsell thairof. Charles R[ex], right trustie and right welbeloved cosens, right reverend fatheris in God etc. Whereas we understand that that oure kingdome is so spoyled and destitute of money as litle or nane is left thairin, our awne coyne being transported to other cuntreyis and thair sold as ordinarie merchandice, to the grite hurt alsweele of oure self as that whole kingdome, we haif thoght goode by these presentis to require you to tak that matter to your considderatioun and advise and resolve upoun the best course how moneyis may againe be broght into that kingdome and increase thairin, eyther by causing all the transportaris of money be called before oure counsell and suche of thame as salbe convicted, ather by thair awne confessioun or by witneses, to be enjoyned to import asmuche money as thay transported and so muche more as salbe thoght fitte for a penaltie, or by ordaining oure thesauraris to tak na other satisfactioun for the bulyeoun bot the bulyeoun itself in foreyne moneys to be putt to the myntehouse as the inviolable custome wes heirtofore, or by making a restraynt of importatioun of unnecessarie waires to the effect that goodes whiche must be transported for imbringing of thame may be sent for necessarie commodities, or by making of societies and manuaries in all the principall burrowis for making of stuffes and other waires (whiche now ar usuallie broght from foreyne pairtis) whairwith to serve not onlie the inhabitantis of the cuntrey bot also forreyneris by transporting and selling or exchanging the same for other waires, for one of the best meanis to enriche a kingdome with moneyis is to sell muche ware for money and to bestow litle or no moneyis at all upoun waires to be imported, bot to interchange waires for otheris necessair waires, and the erecting of societies wald be a meane to hald mony poore and idle people at work and industrie. And seing otheris cuntreyis (speciallie those with whome oure subjectis haif dailie commerce) haif alreadie raised and daylie do raise thair moneyis to a heigh rate, whairby we ar muche prejudged so long as oure moneyis ar not raisit also for thair foreyne moneyis whiche wer a par to ouris being raised and not ouris thay mak gayne of oure moneyis before we be awarr or maid acquaynted with the raising of thair money, and thairfore advise and resolve if you think it a goode policie in respect of oure commerce with thame ever to raise oure moneyis to als heigh a rate. And whereas it may be objected that thair those wilbe prejudged who haif sett thair landis in few or long leases for a certane dewtie according to the rate of the moneyis than in use, you may advise if you think it goode and fitting for remedie heirof that ane act of parliament be maid ordayning that for everie shilling or pund whiche the tennent or debtour is obliged to pay of old he sall now and heirafter pay asmuche more as the moneyis ar raised unto; as for ane instance suppose the tuelve pense be raisit to saxtene pense, than he who befoir wes obliged to pay tuelve pense or tuelve pundis sall pay heirafter saxtene pense or saxtene pundis by his band, contract, tak or lease; at a word that you advise and resolve upoun all suche meanis as you sall think most fitting for increase of moneyis in that kingdome with least prejudice to ws and oure subjectis and mak ws acquaynted thairwith that we may gif way thairunto in suche maner as sall be most expedient. Charles R[ex], right trustie and right welbeloved cosens and counsellouris, right reverend and reverend fatheris in God etc. Althoght thair be mony goode lawis maid for intertenyment of the poore in that oure kingdome, yitt we understand that thair is no satled course taken for the same bot thay still go in begging throw the cuntrey and in burrough townes upoun the streettis, so as oure subjectis cannot passe in oure heigh wayes for thair importunitie and pitiefull crying, whereas other weele reformed kingdomes tak suche ordour with thair poore as thay go not in publict begging as youris do, to the grite scandall and shame of your natioun and to the dishonour of God in suffering all sorts of vices, athisme and impietie to reigne amongis thame without correctioun or discipline because thay duell in no certane place whair the magistrattis, ather civile or ecclesiasticall, might tak ordour with thame, whiche wer aneugh althoght thair wer not anie other crying sinne in that land to bring the fearfull judgementis of God upoun it. And seing we intend (God willing) to come into that kingdome shortlie for ressaveing of oure crowne (at whiche tyme it wer unseamlie that ather we or suche strangearis as sall accompanie ws sould sie suche uncheritable carelesnes and misregaird of the poore as thay sould be suffered to go abroade in suche pitiefull necessitie for want of competent meanis to intertenye thame in houses), it is thairfore oure pleasure and we require you with all convenient diligence to ordeyne by act of conventioun a proclamatioun to be publist in the most eminent placeis of that oure kingdome commanding all archibishoppis, bishoppis, ministeris, schireffis, justiceis of the peace and magistrattis of burrowis to putt the formar actis of parliament in executioun concerning the intertenyment of the poore within thair awne parocheis and the punishment of strong and idle vagaboundis; and that oure counsell call before thame suche personis as salbe fund ather remisse in putting of the afoirsaid actis in executioun or to dissobey suche ordouris as salbe prescryved unto thame for intertenyment of thair poore. And becaus thair be some thingis in the said former actis whiche, seeming to be obscurelie sett downe, haif not bene dewlie putt in executioun, thairfore, be act of conventioun, you sall cleare the saidis obscurities, as namelie whairas be the former actis all beggaris ar ordanit to repair to thair awne parocheis thair to be intertenyed, yit thair be mony who haif ever bene beggaris from thair youth and being begottin in begging never had ony residence at all and so haif no paroche to resort unto. For remedie whairof, you sall ordaine the names of all who haif no certane place nor paroche to be taikin up and thameselffis divydit amongis the parocheis in the kingdome to be intertenyed by thame pro rata as if thay had bene borne thairin. And to the effect that thair names may the better and more easilie be taikin up, lett all suche poore as have not certane parocheis be wairned publictlie be opin proclamatioun at all the mercatt croceis in the kingdome to compeir within the heid burgh of that schirefdome whairin thay salbe at the tyme of the proclamatioun upoun ane certane day befoir the justiceis of the peace of that shyre, whome you sall ordaine to convene at that day, and gif thame power to divide amongst the parocheis of thair shyre to be intertenyed in those parocheis whair they salbe placed, as if they had bene borne thairin, those begging straingearis who sall compeir befoir thame the day appoyntit, geving thair oathe that thay do knawe no certane paroche whairunto they can resort; with power alsua and commandement to the saidis justiceis to go with the said poore to the particular paroche kirkis of the parocheis whairunto they salbe appoyntit, and to see provisioun maid for thame among the native and kyndlie parrochynnaris, for seing the saidis begging strangearis ar a burdene to the whole kingdome, it wer better and muche easier for eache shyre and eache paroche to haif thair awne just pairt of that nomber to interteny in houses than to interteny thame going yeirlie as vagaboundis. Secondlie, whereas by the former actis eache paroche is ordanit to interteny thair awne poore, whairby cleirly it is to be understand that eache paroche sall interteny thair awne poore in houses within thair paroche and not suffer thame go abroade in begging, yitt mony parocheis do mak thair poore go in publict begging throw thair parocheis, commanding thame to keepe thameselffis within the same, whairupoun manie evillis doe follow, as namelie by that meane the poore ar held idle, whairas if thay wer held in houses thay might be exercised about some industrie for the help of thair intertenyment. Nixt, by that meane they ar manie tymes disapoyntit of thair intertenyment divers of the parrochynnaris, yea even of those who may best help bestowing ather litle or na almes at all, whairby the poore are compelled to brek lowse againe and go abroade in the cuntrey. For remedie whairof, lett it be ordanit be the said act of conventioun that the minister and elderis of eache paroche sall place thair poore in houses and according to thair nomber lett thame sett downe a stent upoun eache portioun of rent payed in the paroche and upoun eache fermer and housholder according to his worthe, whiche ather in victuall or money will extend to asmuche as will furnishe and advance the particular quantitie whiche salbe esteemed sufficient for intertenyment of eache persone to be delyvered weeklie to thame; with power also and commandement to the saidis justiceis of the peace to assist eache minister to sett downe the saidis stentis upoun the dewtie payed in eache paroche and upoun the induellaris thairof, and to command thair constables to poynd and distrenyie for the same incaise neid be. Thirdlie, whairas by former actis of parliament it is ordanit that all parocheis sall intertene thair awne poore, in the whiche act by all parocheis is not to be understoode onlie induellaris in the paroche, bot the rentis payed out of the paroche to the awneris thairof, whairsoever thay remayne, whither in burgh or abroad in the cuntrey, for otherwayes it sould fall out verie oftin that the burdene of the intertenyment of the poore sould ly upoun the poore labouraris of the ground in mony parocheis whairin nane are duelling bot poore labouraris and cottaris, thair maister to whome the rent of the paroche doeth belong being duelling abrode, yitt through not considderatioun heirof in mony parocheis the poore ar disapoyntit. For remedie whairof, you sall ordaine that the stent for intertenyment of the poore in each paroche salbe sett downe upoun the rent payed out of eache paroche whairsoever the maister thairof doeth duell and upoun the fermaris and otheris pro rata, and the constables be ordanit to haif power to distrenyie if neid be, alsweele the fermes of the heritouris for the portioun imposed upoun thame as the otheris induellaris for thair pairtis. Ane act anent the childrene of noble men and otheris remaning in seminaryis of popishe religioun beyond sea and aganis Jesuitis, messe preistis

Forsamekle as the kingis majestie is informed that divers childrene, bothe of noblemen and otheris his majesties naturall subjectis of this kingdomne, hes bene heirtofore send over into seminaries, colledgeis and otheris houses of popishe relligioun beyond sea and ar thair instructed, perswadit and strenthned in thair popishe errouris, whairthrow thay become not onlie corruptit and pervertit in relligioun, bot poisoned and infectit in thair dewtie and alledgeance to his majestie and alienated from thair naturall love and affectioun towardis thair cuntrey, whiche is so muche the more dangerous because the poisoun being infused into youthis and studentis as into new veshellis groweth in tyme into ane inveterat habite of malice aganis the present governament, as alsua that divers Jesuites and seminarie preistis hantis, frequentis and ar ressett in the houses of mony of his majesties subjectis of this kingdome and that thair is a daylie growthe and increase of papistis; and his majestie, knaweing the dangerous consequenceis that heirupoun may follow and being carefull to prevent the same and thairwithall being desireous that all his majesties goode subjectis may take notice of his majesties reddynes and constant resolutioun to manteyne the true relligioun profest and be law established in this kingdome and upoun all occasionis to suppres the contrarie, thairfore his majestie, with advise of the lordis of his secreit counsell, ordanis letters to be direct chargeing officiaris of armes to pas to the mercatt croceis of the heid burrowis of this kingdome and otheris placeis neidfull and thair be opin proclamatioun to mak publicatioun heirof, and to command and charge all the saidis childrene that befoir the first day of May nixttocome thay returne into this thair native cuntrey and conforme thameselffis to live in suche dewtie and obedience as becometh goode subjectis; and that thair parentis, tutouris, governouris and suche otheris as hes bene or ar faultie ather in sending, permitting or manteneing thame thair tak present ordour to recall thame home and to provide that thay be returned into this kingdome betuix and the day foirsaid under the pane of the uttermost severitie of his majesties justice to be extendit in that behalf and to be inflictit upoun thame. And sicklike to command, charge and inhibite that no bishop, preist or other persone haveing takin or whilk sall tak orderis by or under ony auctoritie or power deryved from the sea of Roome, whither he or thay be naturall borne subjectis or strangeris, do presoome to confer anie ecclesiasticall orderis or exercise ony ecclesiastiall functioun or jurisdictioun whatsomever towardis or upoun ony his majesties naturall borne subjectis of this kingdome. And likewayes to command and charge all and sindrie judgeis and justiceis to whome it appertenis to putt all his majesties lawis and statutes now standing in force aganis Jesuites, seminarie preistis and otheris haveing taikin orderis by anie auctoritie from the sea of Roome, being his majesties subjectis, to dew and full executioun aganis suche of thame as from and after the first day of Februar nixttocome salbe fundin in this kingdome, whilk day his majestie hes limit and prefixt for the uttermost tyme of thair depairtour. And sicklike to command, charge and inhibite all and sindrie his majesties leiges and subjectis that nane of thame presoome nor tak upoun hand after the said day to ressett, supplie, harbour, interteny, releive or conceale ony of the saidis Jesuites, seminarie preistis or otheris popishe preistis under the paneis provydit be his majesties lawis in that behalf, whilkis paneis salbe seveirlie inflictit upoun the offendaris without favour. And forder, to command and charge all his majesties subjectis of whatsoevir rank or degree to conforme thameselffis to the publict professioun of the trew relligioun, like as his majestie prohibitis the exercise of ony contrair professioun under the panes contenit in the lawis and statutes maid thairanent, and to command and charge all archibishoppis and bishoppis in thair severall dioceyis to proceid aganis all suche as ar knawne to be of a contrair professioun according to the lawis of the churche and realme. And ordanis the proclamatioun to be extendit heirupoun to be presented and affixed on all mercatt croceis that nane pretend ignorance thairof. Sic subscribitur: George, cancellarius.

And toucheing the remanent articles and missives send downe be his majestie, it is thoght meete and expedient that copyis of the same salbe delyverit to everie estate to the intent thay may be advysit thairwith and be the better prepairit; and resolved the morne to reasone, voitt and conclude upoun everie poynt and article mentioned in the same.
