Protestation by [John Elphinstone], lord Balmerino and earls [Charles Hay, earl of] Erroll and [William Keith, earl] Marischal

The Lord Balmerino gave in the protest following, that the nomination of this commission or council of trade by the estates separately, being a late practise and founded upon no law, shall not be drawn in consequence in prejudice of the right and privilege of parliament to name by the whole house, whereupon he took instruments, to which protest the earls of Erroll and Marischal adhered.

Moved that any member of parliament may have the privilege to be present at the meetings of the council of trade, and the same agreed to.

Then the lord chancellor, by order of her majesty's high commissioner, adjourned the parliament until tomorrow at 10 o'clock.
