Draught of the act ratifieing and approving the treaty of union of the two kingdomes of Scotland and England read a second tyme.

Then the act for security of the Protestant religion and presbyterian church government, which is insert in and ratified by the above act, was touched with the royall scepter by her majesties high commissioner in the usuall manner.

Representation and petition of the commission of the generall assembly of the church of Scotland given in and read, and, after reasoning upon the act and representation, the vote was stated approve the act or not.

And before voteing it was aggreed that the members votes be marked, and that the list of their names as they vote be printed and recorded. And the lord high chancellor was allowed to have his name marked, printed and recorded as an approver.

[Protestation against the loss of heritable offices; protest against protestation]

Likeas a protest was given in for the duke of Dowglass and read in these terms: Wee undersubscribers, tutors testamentars to his grace the duke of Dowglass, whereof three is a quorum, in name and behalf of the said duke, forasmuch as his grace the duke of Dowglass and his heirs has by his investitures and honours of the estate of Dowglass (in consideration of the great and faithfull services done and performed to this crown and kingdome by his ancestors) provided to them the honour of leading the van of the arms of Scotland in the day of battell, the caryeing of the crown of Scotland in processions and giving the first vote in all parliaments, councils or conventions in Scotland, and sicklike by the tuentieth article of the union all heretable offices are reserved to the owners as rights of property in the same manner as they are now enjoyned by the laws of Scotland, notwithstanding of this treaty, whereby his grace's foresaid offices and priviledges by parity of reason and justice ought to be preserved, yet seeing the intire union of the two kingdoms will be attended with an union of their arms, crowns and councils, whereby his grace's offices and priviledges may seem to be of more difficult explication, his grace's tutors and guardians in his pupillarity doe now before the treaty be ratified in this parliament judge it indispensablie their duty for his grace's interest, in his name and theirs, undersubscribers as tutors to him, with all humility, to protest that the said treaty may not in any sort prejudge the foresaid honours and priviledges belonging to his grace and successours, which have been the glorious rewards and marks of honour to the illustrious families of Dowglass and Angus for their loyalty, great and faithfull services to the crown and kingdom of Scotland, and that this their protest may be recorded and marked in the minuts and records of parliament.

As also another protest was given in by the duke of Hamilton in these terms: Forasmuchas there is a protestation made in behalf of the duke of Dowglass in relation to his pretensions of having the first seat and vote in parliament, which protestation being altogether groundless, therfore I, James, duke of Hamilton, doe protest in the contrair in regaird that none of the said duke of Dowglass, his predecessors, has or enjoyed any such priviledge since there were dukes or marqueses created in Scotland, and my predecessors were dignified with patents of marques and duke successively long before he or his predecessors had the same. Secondly, William, earle of Angus, the said duke, his predecessor, did upon the fourth day of June jM vjC and thirty three years resign all right and claim that he or his predecessors or successors had or should have to that priviledge of first sitting and voteing in parliament in his majesties hands, which resignation is registrat in the books of parliament, the tuentieth day of the said moneth of June jM vjC thirty three years. Thirdly, I and my predecessors have been in continuall possession of having the first seat and of first voteing in parliament and have been first called in the rolls of parliament past memory of man, and upon this protestation I take instruments and desire the same to be insert in the records of parliament.

And the severall protesters and ingivers took instruments upon their respective protests.

Then the vote was putt approve the act ratifieing and approving the treaty of union of the two kingdomes of Scotland and England, yea or not, and it caryed approve.

And the act was thereafter touched with the royall scepter by her majesties high commissioner in the usuall manner.

The committee appointed to meet to morrow at nyne of the clock.

Then the lord chancellor, by ordor of her majesties high commissioner, adjourned the parliament till Munday next at ten of the clock.
