Order: ratifications and warrants for fairs

Ordered that the ratifications and warrands for fairs, to be craved this session of parliament, be given in to be revised, and her majesties' high commissioner appoints the earle of Glasgow, lord thesaurer deput, the lord advocat, the lord justice clerk, and any one of the solicitors, or any two of the whole, to revise the same.

Thereafter the first sederunt of parliament (after passing the act setleing the manner of electing and sumonding the representatives for Scotland to the parliament of Great Brittain) was appointed for private bussiness.

Procedure: clause on expenses for attending parliament rejected

Then the motion made the former sederunt anent allowing no charges nor expensses to the representatives from the shyres and burrows of this kingdome to the parliament of Great Brittain resumed. And, after debate thereon, the vote was putt, whither there shall be a clause in relation to the charge and expensses of the representatives for shyres and burghs insert in the act setling the manner of electing etc., yea or not, and it caryed not.

Procedure: debate and approval of procedure for electing peers and shire and burgh members

Thereafter, it was moved that at all meetings of the peers for electing of their representatives, such peers as are absent be allowed to have votes in the said election by proxies, the said proxies being peers, and they and their constituents being qualified at the tyme by takeing the oaths required by law, and that the said absent peers may either vote by their proxies or by sending up lists subscribed by them. And, after reasoning thereon, the vote was putt, allow proxies in the above terms, yea or not, and it caryed allow. Aggreed that the meeting of the peers for the said elections shall be at any place her majestie shall appoint within the limits of Scotland.

Aggreed also that in case of the decease or legall incapacity of any of the fourty-five comoners to be chosen out of this session of parliament to the parliament of Great Brittain, the shyre or stewartrie or district of burrows, for which he is a member, shall choise another in his place.

Aggreed likewayes that, in case of the decease or legall incapacity of any of the sexteen peers, the peers shall meet and elect another in place of the deceaser.

Moved that such peers of Scotland who are likewayes peers of England, or who, after the union, shall be created peers of Great Brittain, have no vote in the election of the sexteen peers from Scotland to the parliament of Great Brittain.

And, after debate thereon, it was putt to the vote, whether any clause in relation to the said motion shall be insert in the above act setleing the manner of election etc., yea or not, and it caryed not.

Thereafter, it was aggreed that when the votes of the commissioners for burrows, who shall meet for electing their representative, are equall the president of the meeting shall have a casting or decisive vote besyde his vote as a commissioner representing the burgh from whom he is sent, and that the commissioner for the eldest burrow shall preside at the first meeting, and the commissioner for the other burghs by turns as the burrows are now called in the rolls of parliament.

Then the lord chancellor, by order of her majesties' high commissioner, adjourned the parliament till to morrow at ten of the clock.
